Definitions 2 In these regulations: “home” means a facility designated as a special-care home pursuant to The Facility Designation Regulations; “nurse practitioner” means a registered nurse who is entitled pursuant to The Registered Nurses Act, 1988 to practise in the nurse practitioner category; “operator” means: (a) the provincial health authority; or (b) a designated health care organization as defined in section 4‑10 of The Provincial Health Authority Act; “pharmacist” means a licensed pharmacist as defined in The Pharmacy and Pharmacy Disciplines Act; “physician” means a duly qualified medical practitioner; “physician assistant” means a physician assistant as defined in The Medical Profession Act, 1981 who is practising under the supervision of a physician as approved by the College of Physicians and Surgeons of Saskatchewan; “registered nurse” means a person who is currently registered with the College of Registered Nurses of Saskatchewan; “registered psychiatric nurse” means a person who is currently registered with the Registered Psychiatric Nurses Association of Saskatchewan; “resident” means a person who lives in a home for the purpose of receiving care. 6 Sep 2024 cP-30.3 Reg 4 s2. Safekeeping of resident’s valuables 3(1) If a resident turns cash over to the operator of a home for safekeeping, the operator shall: (a) deposit the cash at a bank or credit union in a trust account for the resident; (b) give a receipt to the resident or the resident’s representative respecting the deposit of the cash in the trust account; and (c) maintain proper records of the trust account. (2) If a resident turns bonds, documents and other valuables over to the operator of a home for safekeeping, the operator shall maintain a clear and accurate record of those items. 6 Sep 2024 cP-30.3 Reg 4 s3. 4 P-30.3 REG 4 SPECIAL-CARE HOMES, 2024 Nursing care 4(1) The care of every resident is to be carried out by or under the direction of a registered nurse or registered psychiatric nurse and under the supervision of the resident’s personal physician, a physician assistant or a nurse practitioner. (2) Every home shall employ at least one full-time registered nurse or registered psychiatric nurse. (3) Nursing care by a registered nurse or a registered psychiatric nurse shall be provided on a 24-hour basis. 6 Sep 2024 cP-30.3 Reg 4 s4. Medical care 5(1) Every resident or the resident’s guardian, or failing this, the agency responsible for the resident’s care, shall designate a physician, physician assistant or nurse practitioner for the provision of medical care and treatment of the resident during the resident’s stay in a home. (2) Every resident shall be examined by a physician, physician assistant or nurse practitioner on admission to the home. (3) After admission to the home, the resident shall receive medical attention as often as the resident’s condition requires, but in any event at least once every year. (4) The results of all examinations shall be recorded on the medical record of the resident. (5) A physician, physician assistant or nurse practitioner shall at all times be on call for emergency care in the home. (6) In case of serious illness or accident in the home: (a) the nurse in charge at the time that an emergency arises shall be responsible for securing immediate medical care by a physician, physician assistant or nurse practitioner for residents in the home; and (b) arrangement for prompt transfer to a hospital shall be made as recommended by the attending physician, physician assistant or nurse practitioner. (7) In case of serious illness or accident in the home, the next of kin shall be notified immediately. (8) A resident having or suspected of having a communicable disease, either at the time of admission or after admission, may: (a) be isolated on the recommendation of a physician, physician assistant or nurse practitioner; and (b) be transferred to an appropriate facility on the recommendation of a physician, physician assistant or nurse practitioner. 6 Sep 2024 cP-30.3 Reg 4 s5. Medications 6(1) Subject to subsection (2), all medications and treatments for residents shall be given only on the written order of a physician, physician assistant, nurse practitioner or pharmacist. 5 SPECIAL-CARE HOMES, 2024 P-30.3 REG 4 (2) If it is necessary to take the order of a physician, physician assistant, nurse practitioner or pharmacist by telephone: (a) the person who takes the order shall: (i) on the form provided, write the order, the name of the physician, physician assistant, nurse practitioner or pharmacist who gave the order, and the date and time of the order; and (ii) sign the form; and (b) the physician, physician assistant, nurse practitioner or pharmacist who gave the order shall verify the order by signing the form on the next visit to the home. (3) All medications in the home shall be kept in locked cabinets. (4) Medications requiring refrigeration shall: (a) be kept in a refrigeration unit; and (b) be kept in a special locked tray or container that is clearly marked, if the refrigeration unit is also used for storing food. (5) All medications shall be retained in their original container. (6) The medication container of every resident shall have a clear and adequate label of the issuing pharmacy that includes the following information: (a) the prescription number; (b) the name of resident; (c) the name of physician, physician assistant, nurse practitioner or pharmacist; (d) the directions for administration of the drug; (e) the date of issue; (f) the name of the pharmacy. (7) Any medication container having a soiled or damaged label shall be returned to the issuing pharmacy for re-labelling. (8) If the attending physician, physician assistant or nurse practitioner so authorizes in writing, pharmaceuticals belonging to a resident shall be given to the resident when discharged or transferred. (9) Unused quantities of prescription drugs that are not given to a discharged resident or that remain in the home after a resident has died shall be destroyed or otherwise disposed of in accordance with pharmaceutical regulations. (10) Narcotics or controlled drugs left by a discharged or deceased resident shall be disposed of in accordance with applicable laws. (11) A home may stock, or have on hand, only those medications that are regularly available without prescription at a commercial pharmacy. 6 Sep 2024 cP-30.3 Reg 4 s6. 6 P-30.3 REG 4 SPECIAL-CARE HOMES, 2024 Sask Reg 34/66 repealed 7 The Housing and Special-care Homes Regulations, being Saskatchewan Regulations 34/66, are repealed. 6 Sep 2024 cP-30.3 Reg 4 s7.
