Definitions 2(1) In these regulations, “Act” means The Heritage Property Act. (2) For the purposes of the Act and in these regulations: “boulder effigy” means any site that contains or contained lines, clusters, configurations or patterns of stones, rocks, cobbles or other lithic objects that: (a) depict zoomorphic or anthropomorphic figures or other representations; and (b) are or were constructed for ceremonial or other non-domestic use; “burial object” means any archaeological objects that are or were found in association with a burial place; “burial place” or “burial mound” means any site that contains or contained or on inspection can be reasonably expected to contain human skeletal material or burial objects; “human skeletal material” means all osseous parts or elements of the human anatomy; “medicine wheel” means a site that contains or contained lines, clusters, configurations and circular or semi-circular patterns of stones, rocks, cobbles or other lithic objects that are or were constructed for ceremonial or other non-domestic use; “petroglyph” means any picture, design, symbol, art work or other representation pecked, carved or incised on a natural rock surface for at least 75 years; “pictograph” means any picture, design, symbol, art work or other representation painted on a natural rock surface for at least 75 years. 23 Sep 2016 cH-2.2 Reg 1 s2. 4 H-2.2 REG 1 HERITAGE PROPERTY, 2016 PART 2 Review Board Definition for Part 3 In this Part, ‘review board member’ means a member of the Foundation who is appointed to the review board pursuant to subsection 5.3(2) of the Act. 21 Sep 2018 SR 70/2018 s4. 4 Repealed. 21 Sep 2018 SR 70/2018 s4. Duties of review board members 5 In conducting the business and carrying out the duties of review board members, each review board member shall: (a) comply with the provisions of the Act and these regulations; and (b) exercise the care, diligence, skill and impartiality that a reasonably prudent person would exercise in comparable circumstances. 21 Sep 2018 SR 70/2018 s6. Filing of referrals 6 Every referral to the review board pursuant to the Act is to be in writing and to be filed with the secretary of the review board at the address set out on the review board’s website. 21 Sep 2018 SR 70/2018 s7. Request for review 7 A request for a review must state the affected property, the person requesting the review and the reasons for the request. 23 Sep 2016 cH-2.2 Reg 1 s7. Decision 10 Every decision of the review board must state the date it is issued. 23 Sep 2016 cH-2.2 Reg 1 s10; 21 Sep 2018 SR 70/2018 s10. 5 HERITAGE PROPERTY, 2016 H-2.2 REG 1 Adjournment of public hearing 11(1) On the request of a party to a public hearing and the designating authority, the review board may adjourn any public hearing and, in that case, the review board shall: (a) not prepare a decision; and (b) notify all parties participating in the hearing and any other person who requests the notice of the adjournment. (2) The chairperson of the review board may adjourn a public hearing if the review board considers it necessary or appropriate to do so. (3) If a public hearing is adjourned, the review board shall notify all parties to the public hearing of the date, location and time the public hearing will be recommenced. 23 Sep 2016 cH-2.2 Reg 1 s11; 21 Sep 2018 SR 70/2018 s11. PART 3 Permits Application fee 11.1(1) For the purposes of subsection 67(2) of the Act, the application fee for the following permits is $300 for each permit: (a) Archaeological Impact Assessment Investigation Permit; (b) Archaeological Mitigation Investigation Permit; (c) Palaeontological Impact Assessment Investigation Permit; (d) Palaeontological Mitigation Investigation Permit. (2) The application fee mentioned in subsection (1) is non-refundable. 12 Jne 2026 SR 37/2026 s4. Cancellation of permit 12(1) For the purposes of subsection 68(8) of the Act, the permit holder, in a request for the cancellation of a permit, shall: (a) provide, in writing, an explanation of the reason for the request; (b) provide, in writing, a description of the activities completed in accordance with that permit; (c) describe all measures required to: (i) complete the activities proposed in the application for that permit; and (ii) if applicable, return, insofar as it is possible, the site to its original state; and (d) provide reasonable assurance that the work described in clause (c) has been completed. 6 H-2.2 REG 1 HERITAGE PROPERTY, 2016 (2) At the time that a request is made for the cancellation of a permit, the permit holder shall: (a) provide the curatorial repository identified in that permit with copies or, if required by the minister, originals of all records, maps, forms and photographs amassed; and (b) provide to that repository all objects recovered and acquired in the course of the permitted work. 23 Sep 2016 cH-2.2 Reg 1 s12.
