1 SCHOOL BUS OPERATING H-3.1 REG 5 The School Bus Operating Regulations, 1987 being Chapter H-3.1 Reg 5 (effective August 11, 1987) as amended by Saskatchewan Regulations 80/98, 99/2003 and 44/2014. NOTE: This consolidation is not official. Interpretation 2 In these regulations: (a) “Act” means The Traffic Safety Act; (b) “bus” means a school bus; (c) “driver” means a driver of a school bus. 6 Jne 2014 SR 44/2014 s3. Prohibitions 3 No driver shall: (a) consume alcohol in the eight-hour period immediately preceding the time when he drives a bus; (b) operate a bus unless it is in a clean and sanitary condition; (c) leave a bus that contains passengers unless: (i) the bus has an interlock ignition system or a device that prevents the bus from being moved or operated by anyone other than the driver and the driver has activated that system or device; or (ii) the driver has turned off the engine of the bus, removed the ignition key and engaged the parking brake; (d) operate a bus unless the headlamps and tail lamps of the bus are activated; (e) operate the bus unless all passengers are seated in a seat designed for the purposes of transporting passengers; (f) back up the bus on school grounds except with the direction of a responsible person who is positioned in such a manner that he can see that the bus can be safely backed up; (g) transport firearms, explosives or other dangerous commodities on a bus; (h) enter a provincial highway without: (i) stopping the bus not less than four and not more than 10 metres from the travelled portion of the provincial highway; and (ii) ensuring that it is safe to proceed; 4 H-3.1 REG 5 SCHOOL BUS OPERATING (i) activate the safety lights unless the bus is stopped or in the process of stopping for the purpose of loading or unloading passengers; or (j) activate the stop arm unless the bus is stopped for the purpose of loading or unloading passengers. 21 Aug 87 cH-3.1 Reg 5 s3; 26 Sep 2003 SR 99/2003 s3. Duties 4 Every driver shall: (a) except where prohibited by municipal bylaw, activate the safety lights: (i) on a highway with a speed limit of more than 50 kilometres per hour, not less than 100 metres; and (ii) on a highway with a speed limit of 50 kilometres per hour or less, not less than 25 metres; before stopping to load or unload passengers and shall not discontinue the operation of the safety lights until it is safe to do so; (a.1) on and after September 4, 2004, activate the strobe lights on the bus any time the driver is transporting passengers outside a city, town or village; (b) except where prohibited by municipal bylaw, activate the stop arm when the bus is stopped for the purpose of loading or unloading passengers; (c) maintain discipline and report any misconduct of passengers to the principal of the school; (d) when loading or unloading passengers: (i) exercise due caution; (ii) on a highway, move the bus as far to the right as is practical; and (iii) at a school on any street that allows traffic in both directions, stop on the side of the street nearest the school; (e) when approaching a railroad crossing that does not have an automatic signal indicating the approach of a train: (i) move the bus as far to the right as is practical; (ii) activate the hazard warning lamps: (A) on a highway with a speed of more than 50 kilometres per hour, not less than 100 metres from the railroad crossing; (B) on a highway with a speed limit of 50 kilometres per hour or less, not less than 25 metres from the railroad crossing; (iii) stop the bus not less than four and not more than 10 metres from the railroad crossing; (iv) open the front door of the bus and look in both directions; 5 SCHOOL BUS OPERATING H-3.1 REG 5 (v) close the door and proceed across the tracks when it is safe to do so and, in the case of standard transmissions, remain in first gear until the bus is completely clear of the tracks; and (vi) move back into the travelled portion of the highway when it is safe to do so and deactivate the hazard warning lamps; (f) each day before operating the bus, perform the maintenance duties on the bus prescribed pursuant to the Act; and (g) ensure that every object that is carried onto the bus for transportation and that cannot be held by a passenger is placed as close to the front barrier as is practical and as low as is practical, and, in any event, that those objects do not exceed the height of the barrier and are placed, where possible, in front of or under a seat that is close to the front of the bus. 21 Aug 87 cH-3.1 Reg 5 s4; 30 Oct 98 SR 80/98 s2; 26 Sep 2003 SR 99/2003 s4; 6 Jne 2014 SR 44/2014 s4. Driver to notify employer of certain matters 4.1 No driver shall fail to promptly notify the school board, municipality or person who employs or has engaged the driver to drive a bus of any of the following: (a) any conviction against the driver pursuant to: (i) the Act or any regulations made pursuant to the Act; (ii) The Alcohol and Gaming Regulation Act, 1997 respecting the operation of a motor vehicle; (iii) the Criminal Code; or (iv) any regulations made pursuant to the Acts mentioned in subclauses (ii) and (iii); (b) any suspension or revocation of the driver’s licence, a refusal by the administrator to issue a driver’s licence or a licence restriction imposed on the driver pursuant to the Act or any regulations made pursuant to the Act; or (c) any medical condition that in the opinion of the driver’s physician or health care provider could have an impact on the driver’s ability to safely operate a bus. 26 Sep 2003 SR 99/2003 s5; 6 Jne 2014 SR 44/2014 s5.
