Interpretation 2 In these regulations: (a) “Act” means The Highways and Transportation Act; (b) “control line” means a control line established pursuant to section 5; (c) “controlled area” means the area: (i) bounded by a control line or a special control line; or (ii) located between a control line or a special control line and the provincial highway mentioned in connection with: (A) the control line in Part II of the Appendix; or (B) the special control line in Part III of the Appendix; as the case may be; (c.1) “permit” means a permit issued by the minister pursuant to section 8; (d) “special control line” means a special control line established pursuant to section 6. 26 Apr 85 cH-3 Reg 7 s2; 17 Mar 89 SR 8/89 s3. Controlled access highways 3 The lands described in Part I of the Appendix which include: (a) provincial highways and parts of provincial highways; and (b) land over which the minister proposes to construct a highway and in respect of which there is a plan in the department indicating the route of the proposed highway; are designated as controlled access highways pursuant to clause 2(b) of the Act. 26 Apr 85 cH-3 Reg 7 s3. Special controlled area 4 Every part of a controlled access highway listed in Part I of the Appendix that lies within a town or a village is designated as a special controlled area pursuant to section 79 of the Act. 26 Apr 85 cH-3 Reg 7 s4. 4 H-3 REG 7 CONTROLLED ACCESS HIGHWAYS Control lines 5 The lines described in Part II of the Appendix are established as control lines pursuant to section 78 of the Act. 26 Apr 85 cH-3 Reg 7 s5. Special control lines 6 The lines described in Part III of the Appendix are established as special control lines pursuant to section 80 of the Act. 26 Apr 85 cH-3 Reg 7 s6. Prohibitions 7 No person shall: (a) erect or place or cause to be erected or placed a structure of any kind including: (i) an embankment; or (ii) a lighting or reflecting device; (b) make or cause to be made any addition or alteration to a structure described in clause (a); on land lying within a controlled area without first obtaining a permit. 17 Mar 89 SR 8/89 s4. Permits 8(1) Subject to section 9, a person may apply to the minister for a permit authorizing the erection or placement of a structure described in clause 7(a) on land lying within a controlled area. (2) Every person who applies for a permit pursuant to subsection (1) shall submit with the application for a permit the plans, including specifications, of the proposed structure along with any other information that the minister may require. (3) Where the minister considers it appropriate the minister may: (a) issue a permit to the applicant authorizing the erection or placement of a structure on land lying within a controlled access area; and (b) impose any terms and conditions on the permit that the minister considers necessary. (4) Subject to the Act or any other regulations made pursuant to the Act: (a) the permit expires on the date specified on the permit; and (b) the holder of the permit shall comply with any terms and conditions specified on the permit. 17 Mar 89 SR 8/89 s4. 5 CONTROLLED ACCESS HIGHWAYS H-3 REG 7 Public improvements 9 No permit is to be issued for any building, structure or gas, oil or sewer and water pipe which will encroach on or interfere with a public improvement that: (a) the minister proposes to construct within a controlled area; or (b) in the opinion of the minister, is likely to be constructed within a controlled area. 26 Apr 85 cH-3 Reg 7 s9. The termini of the line are the intersection of the line with the east and the north boundaries of the incorporated area of the Town of Moosomin. Moosomin: A line parallel to the proposed bypass route for Provincial Highway No. 1 through the Town of Moosomin as shown by control of access plan P-1-01 at a distance of 150 metres from the highway centre line measured perpendicular to the proposed bypass route in a generally southerly direction. The termini of the line are the intersection of the line with the east, the west and the south boundaries of the incorporated area of the Town of Grenfell. The termini of the line are the intersection of the line with a circle with radius 426.7 metres and centre at the centre line intersection of Provincial Highway No. 1 and the road allowance along the west boundary of Section 3, Township 17, Range 8, West of the Third Meridian. Herbert: A line parallel to Provincial Highway No. 1 at a distance of 150 metres from the highway centre line measured perpendicular to Provincial Highway No. 1 in a generally northerly direction. ALONG PROVINCIAL HIGHWAY NO. 10 Fort Qu’Appelle: A diamond shaped controlled area formed by straight lines joining extreme points located as follows: at the intersection of Broadway Avenue and Highway No. 35 in the Town of Fort Qu’Appelle; on No. 10 Highway 609.6 metres east of its intersection with Highway No. 35; at a point 195.0 metres south of Highway No. 10 measured perpendicular to Highway No. 10 from its intersection with Highway No. 35; and on No. 10 Highway 457.2 metres west of its intersection with Highway No. 35. 13 CONTROLLED ACCESS HIGHWAYS H-3 REG 7 ALONG PROVINCIAL HIGHWAY NO. 11 Kenaston: A line parallel to Provincial Highway No. 11 at a distance of 150 metres from the highway centre line measured perpendicular to Provincial Highway No. 11 in a generally westerly direction. The northern terminus of the line is the point of intersection of the line with the north boundary of the incorporated area of the Village of Kenaston. The southern terminus of the line is the point of intersection of the line with a circle of 426.7 metres radius with centre at a point 365.7 metres west and 243.8 metres north of the south-east corner of Section 30, Township 29, Range 2, West of the Third Meridian. Davidson: A line parallel to Provincial Highway No. 11 at a distance of 150 metres from the highway centre line measured perpendicular to Provincial Highway No. 11 in a generally westerly direction. The termini of the line are the points of intersection of the line with the south boundary of the incorporated area of the Town of Davidson, and a circle of 426.7 metres radius with centre at the centre line intersection of Provincial Highway No. 11 and the quarter line which runs east-west of Section 27, in Township 26, in Range 29, West of the Second Meridian. Osler: A line parallel to Provincial Highway No. 11 at a distance of 150 metres from the highway centre line measured perpendicular to Provincial Highway No. 11 in a westerly direction. The termini of the line are the north boundary of the incorporated area of the Village of Osler and a point 1493.5 metres south of the north-east corner of Section 20, Township 39, Range 4, West of the Third Meridian. Hague: A line parallel to Provincial Highway No. 11 at a distance of 150 metres from the highway centre line measured perpendicular to Provincial Highway No. 11 in a westerly direction. The termini of the line are the south boundary of the incorporated area of the Village of Hague and a point 655.3 metres north of the northern boundary of Section 6, Township 41, Range 3, West of the Third Meridian.
