Definition 2 In these regulations, “Act” means The Health Shared Services Saskatchewan (3sHealth) Act. 2 Dec 2022 SR 85/2022 s2. Prescribed amounts 3(1) The amount prescribed for the purposes of clause 2‑6(1)(a) of the Act is $1,000,000. (2) The amount prescribed for the purposes of clause 2‑6(1)(b) of the Act is $1,000,000. (3) The amount prescribed for the purposes of clause 2‑6(1)(c) of the Act is $1,000,000. (4) The amount prescribed for the purposes of clause 2‑6(1)(d) of the Act is $1,000,000. (5) The amount prescribed for the purposes of clause 2‑6(1)(e) of the Act is $1,000,000. (6) The amount prescribed for the purposes of subsection 2‑6(2) of the Act is $1,000,000. 2 Dec 2022 SR 85/2022 s3. Board of directors 4(1) In this section, “capacity” means the ability: (a) to understand information relevant to making a decision; and (b) to appreciate the reasonably foreseeable consequences of making or not making a decision. (2) To be eligible for appointment as a member of the board, a person must be: (a) a Canadian citizen; and (b) at least 18 years old. (3) A person is disqualified from being a member of the board if the person: (a) lacks capacity; (b) is an undischarged bankrupt; 4 HEALTH SHARED SERVICES SR 85/2022 SASKATCHEWAN (3sHEALTH) (c) is an employee of the corporation; (d) holds office as a member of the Legislative Assembly, the House of Commons or the Senate of Canada; (e) is a judge of the Court of King’s Bench or Court of Appeal; (f) has been convicted of an offence pursuant to section 123, 124 or 125 of the Criminal Code and has not received an absolute discharge or pardon with respect to the offence; or (g) has been convicted of an offence that is punishable by imprisonment for 5 years or more and has not received an absolute discharge or pardon with respect to the offence. 2 Dec 2022 SR 85/2022 s4. Insurance 5(1) In this section, “automobile insurance” does not include the insurance evidenced by a certificate of insurance issued pursuant to The Automobile Accident Insurance Act. (2) The corporation shall maintain insurance of the following types and amounts: (a) insurance covering the full replacement cost of all buildings, equipment and furnishings against loss or damage by fire or other perils normally insured against under all‑risk coverage; (b) general liability insurance, in an amount not less than $1,000,000 per occurrence, against liability arising from injury to or the death of persons and loss of or damage to property occurring in facilities owned or operated by the corporation; (c) with respect to the motor vehicles owned or leased by the corporation, automobile insurance, in an amount not less than $1,000,000 per occurrence, insuring the corporation and the operator against liability arising from: (i) bodily injury to or the death of a person, including a person carried for compensation, or loss of or damage to property, caused by a motor vehicle or the use or operation of a motor vehicle; or (ii) loss of or damage to a motor vehicle and the loss of use of a motor vehicle. 2 Dec 2022 SR 85/2022 s5. Auditor 6 For the purposes of section 6‑4 of the Act, the auditor must: (a) in the case of an individual, be a member in good standing of a recognized accounting profession that is regulated by an Act; or (b) in the case of a firm, have at least one partner who is a member in good standing of a recognized accounting profession that is regulated by an Act. 2 Dec 2022 SR 85/2022 s6. 5 HEALTH SHARED SERVICES SASKATCHEWAN (3sHEALTH) SR 85/2022 Coming into force 7(1) Subject to subsection (2), these regulations come into force on the day on which section 1‑1 of The Health Shared Services Saskatchewan (3sHealth) Act comes into force.
