NOTE: This consolidation is not official. Definitions 1-2 In these regulations: “Act” means The Saskatchewan Firearms Act; “significant shareholder” means an individual who, directly or indirectly, owns 25% or more of a corporation’s outstanding shares. 27 Oct 2023 SR 98/2023 s1-2. PART 2 Regulation of Firearms and Related Activities Non-application of section 3-3 of the Act 2-1 Subsection 3-3(1) of the Act does not apply to a seizure agent who is licensed pursuant to Part 4 of the Act, in the course of the seizure agent’s duties as a seizure agent. 27 Oct 2023 SR 98/2023 s2-1. Prescribed form re alternative penalties 2-2 An order pursuant to section 3-18 of the Act is to be in Form A of the Appendix. 27 Oct 2023 SR 98/2023 s2-2. 2-3 Repealed. 1 May 2026 SR 25/2026 s3. Medical professionals 2-4 The following categories of medical professionals are prescribed for the purposes of section 3-21 of the Act: (a) individuals who hold a valid licence to practise issued by one of the following regulatory bodies: (i) the Saskatchewan College of Psychologists; (ii) the Saskatchewan Association of Social Workers; (iii) the College of Registered Nurses of Saskatchewan; (iv) the College of Registered Psychiatric Nurses of Saskatchewan; 4 SR 98/2023 SASKATCHEWAN FIREARMS (v) the College of Licensed Practical Nurses of Saskatchewan; (vi) the Saskatchewan Association of Optometrists; (b) individuals who provide counselling services or therapy services but who are not mentioned in clause (a). 1 May 2026 SR 25/2026 s4. Designations re section 117.08 of the Criminal Code 2-5(1) For the purposes of subsection 2-2(5) of the Act, a designation by the commissioner may only be with respect to the following: (a) possession of a firearm, a prohibited device or prohibited ammunition pursuant to paragraph 117.08(a) of the Criminal Code; (b) alteration of a serial number on a firearm pursuant to paragraph 117.08(g) of the Criminal Code, but only for the purpose of conducting forensic and ballistic training in relation to the activities of the commissioner. (2) A designation by the commissioner pursuant to subsection 2-2(5) of the Act may contain any terms or conditions that the commissioner considers appropriate. 1 May 2026 SR 25/2026 s4. PART 3 Seizure Agents Definition of specified law 3-1 For the purposes of sections 4-1, 5-1 and 6-1 of the Act, the definition of “specified law” includes section 4.1 of the Conditions of Transferring Firearms and Other Weapons Regulations (Canada). 27 Oct 2023 SR 98/2023 s3-1. Application for licence 3-2(1) For the purposes of section 4-5 of the Act, an application for a licence is to include: (a) a fee of $150; (b) confirmation of the following: (i) the applicant has obtained an insurance policy in accordance with section 4-14 and subsection 4-22(2) of the Act; (ii) if the licence is with respect to an individual, the individual holds a valid licence issued by the chief firearms officer in accordance with clause 4-15(a) of the Act; (iii) if the licence is with respect to a person other than an individual, the person holds a valid licence or licences issued by the chief firearms officer in accordance with clause 4-15(b) of the Act; (iv) the person to be licensed has successfully completed training in accordance with section 4-16 of the Act; and 5 SR 98/2023 SASKATCHEWAN FIREARMS (c) if the licence is with respect to: (i) a person other than an individual, or a sole proprietor who is an individual: (A) a current list of all the applicant’s employees; and (B) a copy of a criminal record check, dated not more than 30 days before the date on which the application is submitted, with respect to: (I) if the applicant is a sole proprietor who is an individual, the individual; (II) if the applicant is a sole proprietor that is a corporation, each significant shareholder, director and officer of the corporation; (III) if the applicant is a corporation, each significant shareholder, director and officer of the corporation; (IV) if the applicant is a partnership, each partner of the partnership who is an individual; or (V) if the applicant is a co-operative, each director of the co- operative; or (ii) an individual: (A) a recent photograph of the person to be licensed; and (B) a copy of a criminal record check of the person to be licensed dated not more than 30 days before the date on which the application is submitted. 27 Oct 2023 SR 98/2023 s3-2. No refund 3-3 Application fees mentioned in section 3-2 are non-refundable. 27 Oct 2023 SR 98/2023 s3-3. PART 4 Compensation and Testing re Firearms Firearm amnesty programs 4-1(1) In this section, “firearm amnesty program” means a program operated by a police service or the Royal Canadian Mounted Police that allows a person to voluntarily surrender firearms to the police service or the Royal Canadian Mounted Police. (2) A police service or the Royal Canadian Mounted Police must obtain the approval of the commissioner before operating a firearm amnesty program. 6 SR 98/2023 SASKATCHEWAN FIREARMS (3) The commissioner may approve a firearm amnesty program pursuant to subsection (2) on any terms and conditions the commissioner considers appropriate, including terms and conditions respecting: (a) advertising and communications respecting the firearm amnesty program; (b) the collection of firearms by the police service or the Royal Canadian Mounted Police; and (c) the destruction or deactivation of firearms by the police service or the Royal Canadian Mounted Police. (4) If a police service or the Royal Canadian Mounted Police takes possession of a firearm pursuant to a firearm amnesty program, the police service or the Royal Canadian Mounted Police must, before destroying or deactivating the firearm, offer the firearm to the commissioner for: (a) destruction; (b) any scientific, research or educational purpose; (c) any forensic or ballistic testing or tracing of the firearm to determine if the firearm may have been used in the commission of an offence pursuant to any Act, Act of the Parliament of Canada or regulation made pursuant to any Act or Act of the Parliament of Canada, including preserving evidence of any potential offence pursuant to any Act, Act of the Parliament of Canada or regulation made pursuant to any Act or Act of the Parliament of Canada; or (d) preservation as a historical firearm. (5) Parts 4 and 5 of the Act do not apply in the case where a police service or the Royal Canadian Mounted Police takes possession of a firearm pursuant to a firearm amnesty program that is conducted in accordance with this section. 27 Oct 2023 SR 98/2023 s4-1. PART 5 Coming into Force Coming into force 5-1(1) Subject to subsections (2) to (4), these regulations come into force on the day on which section 5-2 of The Saskatchewan Firearms Act comes into force. (2) Subject to subsections (3) and (4), if these regulations are filed with the Registrar of Regulations after the day on which section 5-2 of The Saskatchewan Firearms Act comes into force, these regulations come into force on the day on which they are filed with the Registrar of Regulations. (3) Subject to subsection (4), section 2-2 and the Appendix come into force on the day on which section 3-18 of The Saskatchewan Firearms Act comes into force. (4) If these regulations are filed with the Registrar of Regulations after the day on which section 3 18 of The Saskatchewan Firearms Act comes into force, section 2-2 and the Appendix come into force on the day on which these regulations are filed with the Registrar of Regulations. 27 Oct 2023 SR 98/2023 s5-1. 7 SR 98/2023 SASKATCHEWAN FIREARMS Appendix FORM A [Section 2-2] PROVINCIAL COURT OF SASKATCHEWAN ORDER (Alternative Penalties pursuant to section 3-18 of The Saskatchewan Firearms Act) In the matter of R v. __________________________________________________________ Information(s): _______________________________________________________________ Before the Honourable Judge ________________________________________________ Judicial Centre: ______________________________________________________________ THE COURT ORDERS THAT: (items that are not included within the Order may be deleted.
