Definition 2 In these regulations, “Act” means The Film Content Information Act. 20 Mar 2026 SR 12/2026 s2. Display of film content information on website 3 For the purposes of subsection 3(1) of the Act, if a person exhibiting a film advertises or otherwise promotes the film on the person’s website, the information described in clauses 3(1)(a) to (c) of the Act must, in advance of the person exhibiting the film, be displayed: (a) at the place where the person exhibits the film; and (b) on the person’s website. 20 Mar 2026 SR 12/2026 s3. No access to physical copies of adult films for persons under 18 years of age 5(1) A person who sells, rents or otherwise makes available physical copies of adult films and of no other films shall: (a) display in a conspicuous manner at all entrances to the person’s business premises a sign reading “No admittance to persons under 18 years of age”; and (b) not allow a person under 18 years of age to enter the business premises. (2) A person who sells, rents or otherwise makes available physical copies of adult films in addition to physical copies of other films shall: (a) on the business premises, segregate all physical copies of adult films, and all advertising material for adult films, from the area in which persons under 18 years of age are allowed; (b) display in a conspicuous manner at all entrances to the segregated area a sign reading “No admittance to persons under 18 years of age”; and (c) not allow a person under 18 years of age to enter the segregated area. 20 Mar 2026 SR 12/2026 s5. 4 SR 12/2026 FILM CONTENT INFORMATION Recovery or destruction of forfeited items or things 6(1) For the purposes of subsection 15(2) of the Act: (a) a person may submit a written application to the director for the recovery of a forfeited item or thing within 60 days after the later of the following dates: (i) the date on which the applicable appeal period expires; (ii) the date on which a conviction is upheld on appeal; and (b) the application mentioned in clause (a) must include the following: (i) the name of the person who claims to be entitled to the item or thing; (ii) a description of the item or thing; (iii) the date on which the item or thing was seized; (iv) the reason why the item or thing was seized; (v) the reason why the person claiming entitlement to the item or thing believes it should be returned to that person. (2) For the purposes of subsection 15(5) of the Act, the director may destroy a forfeited item or thing if the item or thing is not returned to the person from whom it was seized pursuant to subsection 15(3) or (4) of the Act. (3) If the director does not approve an application mentioned in clause (1)(a), the director shall, before destroying the forfeited item or thing pursuant to subsection (2), provide written notice of the director’s decision together with reasons to the person who submitted the application. 20 Mar 2026 SR 12/2026 s6. Coming into force 7(1) Subject to subsection (2), these regulations come into force on the day on which section 1 of The Film Content Information Act comes into force.
