PART II Amendments to The Land Titles Act RSS 1978, c L-5 amended 2 The Land Titles Act is amended in the manner set forth in this Part. 1999, c L‑3.01, s 2. Section 2 amended 3 Subsection 2(1) is amended: (a) by adding the following clause after clause (a.1): “(a.2) “corporation” means the Crown corporation created by the Lieutenant Governor in Council pursuant to The Crown Corporations Act, 1993 as the Crown corporation through which the minister shall administer this Act and The Land Surveys Act”; and (b) by adding the following clause after clause (m.1): “(m.2) “minister” means the member of the Executive Council to whom for the time being the administration of this Act is assigned”. 1999, c L‑3.01, s 3. New section 2.1 4 The following section is added after section 2: “Administration of Act 2.1(1) The corporation is responsible to the minister for the performance of the duties imposed on the corporation, and in the exercise of the powers conferred on the corporation, for the purpose of administering this Act. (2) All revenues derived from fees, levies, rates and other charges imposed or collected pursuant to this Act are to be paid to and are the property of the corporation, unless the Lieutenant Governor in Council directs that all or any of the revenues be paid to the general revenue fund”. 1999, c L‑3.01, s 4. 4 c L-3.01 LAND INFORMATION SERVICES FACILITATION Section 9 amended 5 Section 9 is amended by striking out “or by the Minister of Justice” and substituting “, the minister or the corporation”. 1999, c L‑3.01, s 5. New section 17.1 7 The following section is added before section 18: “Superannuation 17.1 The Public Service Superannuation Act and The Public Employees Pension Plan Act apply, with any necessary modification, to the persons employed by the corporation for the purpose of administering this Act”. 1999, c L‑3.01, s 7. Section 29 amended 8 Subsection 29(3) is amended by striking out “Minister of Justice” and substituting “minister”. 1999, c L‑3.01, s 8. Section 263 amended 19 The following clause is added after clause 263(f): “(f.1) respecting any matter necessarily incidental to the carrying out of the corporation’s powers and the performance of its duties for the purpose of administering this Act”. 1999, c L‑3.01, s 19. Second Schedule, Form E amended 20 Paragraph 1 of Form E of the Second Schedule is amended by striking out “Attorney General” and substituting “minister”. 1999, c L‑3.01, s 20. PART III Amendments to The Land Surveys Act RSS 1978, c L-4 amended 21 The Land Surveys Act is amended in the manner set forth in this Part. 1999, c L‑3.01, s 21. Section 2 amended 22 The following clause is added after clause 2(b): “(b.1) ‘corporation’ means the Crown corporation created by the Lieutenant Governor in Council pursuant to The Crown Corporations Act, 1993 as the Crown corporation through which the minister shall administer this Act and The Land Titles Act”. 1999, c L‑3.01, s 22. 6 c L-3.01 LAND INFORMATION SERVICES FACILITATION New section 3 23 Section 3 is repealed and the following substituted: “Administration of Act 3 The corporation is responsible to the minister for the performance of the duties imposed on the corporation, and in the exercise of the powers conferred on the corporation, for the purpose of administering this Act”. 1999, c L‑3.01, s 23. New sections 4 and 4.01 24 Section 4 is repealed and the following substituted: “Controller of Surveys 4 There may be appointed an officer to be known as the Controller of Surveys, who shall be a Saskatchewan land surveyor and who, under the direction of the minister and the corporation, shall administer the provisions of this Part and the regulations made pursuant to this Part. “Superannuation 4.01 The Public Service Superannuation Act and The Public Employees Pension Plan Act apply, with any necessary modification, to the persons employed by the corporation for the purpose of administering this Act”. 1999, c L‑3.01, s 24. Section 4.1 amended 25 Section 4.1 is amended in the portion preceding clause (a) by striking out “minister” and substituting “corporation”. 1999, c L‑3.01, s 25. Section 5 amended 26 The following clause is added after clause 5(f): “(f.1) respecting any matter necessarily incidental to the carrying out of the corporation’s powers and the performance of its duties for the purpose of administering this Act”. 1999, c L‑3.01, s 26. Section 43 amended 27 Subsection 43(1) is amended by striking out “director of the Central Survey and Mapping Agency” and substituting “Controller of Surveys”. 1999, c L‑3.01, s 27. 7 LAND INFORMATION SERVICES FACILITATION c L-3.01 New section 48 28 Section 48 is repealed and the following substituted: “Minister’s order approving plan 48(1) On a report of the Master of Titles, the minister may, by order: (a) approve the plan; (b) direct the Master of Titles to cause the order and plan to be registered in the proper land titles office; and (c) confirm the apportionment of costs made by the surveyor or, in view of special circumstances peculiar to any particular case, confirm the apportionment with any modification or alteration that the minister deems advisable. (2) An order of the minister pursuant to subsection (1) is final”. 1999, c L‑3.01, s 28.
