1 ROYAL SASKATCHEWAN MUSEUM c R-23.01 The Royal Saskatchewan Museum Act being Chapter R‑23.01 of The Statutes of Saskatchewan, 2007 (effective May 17, 2007) as amended by the Statutes of Saskatchewan, 2022, c 36. Interpretation 2 In this Act: (a) “Aboriginal sacred and culturally sensitive object” means any object that: (i) has been used in an Aboriginal ceremony; (ii) reflects the spiritual power of an Aboriginal person; (iii) was left as an offering in an Aboriginal ceremony or practice; or (iv) has ongoing historical or cultural importance to an Aboriginal community; (b) “department” means the department over which the minister presides; (c) “director” means the Director of the Royal Saskatchewan Museum designated pursuant to subsection 3(2); (d) “minister” means the member of Executive Council to whom for the time being the administration of this Act is assigned; (e) “museum” means the Royal Saskatchewan Museum continued pursuant to subsection 3(1). 2007, c R‑23.01, s 2. Continuation of branch, director 3(1) The branch of the department called the Royal Saskatchewan Museum is continued. (2) The minister shall designate an employee of the department as the Director of the Royal Saskatchewan Museum. (3) The staff of the museum is to consist of the director and any other employees that the minister considers necessary to carry out the mandate and activities of the museum. 2007, c R‑23.01, s 3. 4 c R-23.01 ROYAL SASKATCHEWAN MUSEUM Museum mandate and powers 4(1) Subject to the direction of the minister, the museum is responsible for undertaking any measures that the museum considers advisable to increase interest in, knowledge and understanding of, and appreciation and respect for Saskatchewan’s natural history and Aboriginal cultures. (2) For the purposes set out in subsection (1), the museum may do all or any of the following: (a) establish, study, document, preserve and exhibit collections of objects of natural and cultural origin; (b) generate and disseminate new knowledge; (c) inform the public and the academic and scientific communities of its discoveries and its understanding of Saskatchewan’s natural history and Aboriginal cultures throughout Canada and the world through education, exhibition and communication; (d) use the museum’s collections and expertise to promote social and scientific change and understanding; (e) support the activities and programs of persons, institutions and organizations with a purpose similar to its own by providing expert advice and professional and technical services; (f) perform any other functions that the minister considers advisable to carry out the mandate of the museum. 2007, c R‑23.01, s 4. Power to charge fees, accept funds etc. 4.1 The museum may: (a) Not yet in force. (b) accept grants, payments, subscriptions, donations, gifts and bequests, whether of real or personal property from any person, including funds appropriated by the Legislature or by the Parliament of Canada, for any purpose related to the fulfilment of the museum’s mandate and purposes; and (c) subject to the terms of any trust imposed by the testator or donor of real or personal property, sell, lease, convey or otherwise dispose of and convert into money any real or personal property given or bequeathed for any purpose related to the fulfilment of the museum’s mandate and purposes. 2022, c 36, s 3. 5 ROYAL SASKATCHEWAN MUSEUM c R-23.01 Role of director 5(1) The director is responsible for implementing the mandate of the museum. (2) Subject to The Heritage Property Act and any regulations made pursuant to that Act, the director may do all or any of the following: (a) collect specimens, artifacts, objects, other material evidence, and information, originating primarily but not exclusively within Saskatchewan, that illustrate and increase an understanding of Saskatchewan’s natural history and Aboriginal cultures; (b) develop and oversee the scientific and cultural research of the museum; (c) maintain the museum’s collections by preservation, conservation and restoration and by establishment of records and documentation; (d) assume stewardship responsibility for the protection and preservation of the palaeontological and archaeological objects under the ownership of the Crown in right of Saskatchewan; (e) exchange, give away, destroy or otherwise dispose of specimens, artifacts, objects and other museum material within the museum’s collections: (i) after considering the scientific and cultural significance of the objects and the public interest in retaining the objects; and (ii) in accordance with ethical and other standards adopted by the museum; (f) exchange with, lend to or borrow from any other person, institution or organization specimens, artifacts, objects, exhibits, museum material, knowledge or information. 2007, c R‑23.01, s 5. Aboriginal sacred and culturally sensitive objects 6(1) Subject to the direction of the minister and any regulations made pursuant to this Act, and after consultation with Aboriginal peoples determined appropriate by the minister, the museum is responsible for developing a policy to address the concerns of Aboriginal peoples about the access to and the care, use and repatriation of sacred and culturally sensitive objects originating with their cultures in the museum collections. (2) In administering its collections and in developing the policy mentioned in subsection (1), the museum shall consider the following principles: (a) Aboriginal peoples have a connection with Aboriginal sacred and culturally sensitive objects, regardless of where those objects are held; (b) Aboriginal sacred and culturally sensitive objects in the museum collections are vital to the maintenance of traditional ways; (c) the deeper meanings associated with Aboriginal sacred and culturally sensitive objects are known only to Aboriginal members of their cultures of origin. 2007, c R‑23.01, s 6. 6 c R-23.01 ROYAL SASKATCHEWAN MUSEUM Regulations 7 The Lieutenant Governor in Council may make regulations: (a) defining, enlarging or restricting the meaning of any word or expression used in this Act but not defined in this Act; (b) respecting the policy mentioned in subsection 6(1); (c) respecting any other matter or thing that the Lieutenant Governor in Council considers necessary to carry out the intent of this Act. 2007, c R‑23.01, s 7.
