Definitions and interpretation 2(1) In these regulations: “Act” means The Management and Reduction of Greenhouse Gases Act; “annual report” means a report that includes: (a) the quantified greenhouse gas emissions from a regulated facility for a particular year; and (b) any other information specified in each applicable standard; “facility” means: (a) all buildings, units, equipment, structures, on-site transportation machinery and stationary items that: (i) are located on a single site, on multiple sites or between multiple sites that are owned or operated by the same person; and (ii) function as a single integrated site; or (b) a pipeline transportation system; but does not include public roads; “regulated facility” means, unless otherwise specified, a facility owned or operated by a regulated emitter described in section 3; “standard” means: (a) The Management and Reduction of Greenhouse Gases (Reporting) Standard, as amended from time to time; or (b) any other standard developed or adopted pursuant to subsection 6(1). (2) Part 3 of The Management and Reduction of Greenhouse Gases (General and Electricity Producer) Regulations applies, with any necessary modification, to these regulations. 17 Oct 2025 c M-2.01 Reg 5 s 2. 4 MANAGEMENT AND REDUCTION OF GREENHOUSE M-2.01 REG 5 GASES (REPORTING AND GENERAL) 2025 Application of regulations 3(1) Subject to subsections (2) and (3), every person who owns or operates a facility that emits 10,000 tonnes or more of CO e each year is a regulated emitter with 2 respect to the facility and is subject to these regulations. (2) If the baseline emissions intensity has been established for a regulated industrial facility in accordance with The Management and Reduction of Greenhouse Gases (Standards and Compliance) Regulations, 2023, these regulations do not apply to the regulated industrial facility. (3) These regulations do not apply to a regulated electricity facility within the meaning of The Management and Reduction of Greenhouse Gases (Standards and Compliance) Regulations, 2023. (4) For greater certainty, if a regulated emitter described in subsection (1) is not subject to other reporting requirements respecting greenhouse gas emissions pursuant to other regulations made pursuant to the Act, the regulated emitter must comply with the requirements set out in these regulations. 17 Oct 2025 c M-2.01 Reg 5 s 3. PART 2 Reporting of Greenhouse Gases by Regulated Emitters Emissions measured in tonnes of COe 2 4 For the purposes of the Act and these regulations, greenhouse gas emissions must be measured, calculated and expressed in tonnes of CO e. 2 17 Oct 2025 c M-2.01 Reg 5 s 4. Submission of annual report 5(1) For the purposes of section 21 of the Act, a regulated emitter must submit to the minister an annual report, in the manner established by all applicable standards, for each regulated facility that the regulated emitter owns or operates. (2) A regulated emitter must submit an annual report to the minister on or before: (a) June 1 of the year following the year to which the annual report relates; (b) another date that is requested by the regulated emitter and that the minister is satisfied is appropriate; or (c) another date that the minister may direct in writing. 17 Oct 2025 c M-2.01 Reg 5 s 5. Adoption of standard 6(1) The minister may develop or adopt one or more standards respecting the following matters: (a) annual reports; 5 MANAGEMENT AND REDUCTION OF GREENHOUSE GASES (REPORTING AND GENERAL) 2025 M-2.01 REG 5 (b) quantification methodologies for greenhouse gases; (c) audits and inspections; (d) any other matter dealt with in these regulations. (2) In addition to publishing notice of each standard in accordance with subsection 7(4) of the Act, the minister shall publish notice of each standard on the ministry’s website. (3) The minister may consult with any regulated emitter before amending an applicable standard. 17 Oct 2025 c M-2.01 Reg 5 s 6. Compliance with standard 7 Every regulated emitter must comply with the standards developed or adopted pursuant to these regulations. 17 Oct 2025 c M-2.01 Reg 5 s 7. PART 3 General Administrative penalties 8(1) For the purposes of section 78 of the Act, the minister may assess a penalty for a contravention of a provision of the Act or these regulations that is set out in the Appendix. (2) The maximum penalty that the minister may assess with respect to each contravention is $10,000. 17 Oct 2025 c M-2.01 Reg 5 s 8. Record keeping 9 Every person who submits an annual report to the minister pursuant to these regulations must retain and make available for inspection by the minister all documents and information used to prepare the annual report, including a record of each methodology, procedure and instrument used, for 7 years after the date on which the annual report is submitted. 17 Oct 2025 c M-2.01 Reg 5 s 9. Confidentiality requests 10(1) For the purposes of subsections 61(3) and (4) of the Act, requests to the minister to keep confidential all or part of an annual report must be made in writing in conjunction with the submission of the annual report. (2) After receiving a request for confidentiality pursuant to subsection (1), the minister shall, as soon as is practicable, provide a written response to the regulated emitter indicating if the request has or has not been accepted together with reasons for the minister’s decision. 6 MANAGEMENT AND REDUCTION OF GREENHOUSE M-2.01 REG 5 GASES (REPORTING AND GENERAL) 2025 (3) Subject to subsection (4), during the period in which the minister is considering a request for confidentiality made pursuant to subsection (1), the information contained in the annual report to which the request relates shall be kept confidential. (4) The following information contained in an annual report is not subject to the confidentiality requirement mentioned in subsection (3): (a) the name of the regulated facility; (b) the ownership of the regulated facility; (c) the location of the regulated facility; (d) the annual emissions for the regulated facility; (e) any other information specified in the applicable standard that the minister is satisfied should not be kept confidential. (5) If the minister does not accept the request for confidentiality pursuant to subsection (2), the minister shall give the regulated emitter 7 business days after the date of receipt of the written response mentioned in that subsection to make written representations to the minister. (6) After reviewing any written representations made pursuant to subsection (5) or, if no written representations are made, after the expiry of the 7-day period mentioned in that subsection, the minister shall: (a) make a final decision to accept or not accept the request for confidentiality; and (b) provide written notice to the person of the minister’s decision. 17 Oct 2025 c M-2.01 Reg 5 s 10. Audit and inspection 11 For the purposes of section 67 of the Act, an audit or inspection of a regulated facility must be undertaken in accordance with the applicable standard. 17 Oct 2025 c M-2.01 Reg 5 s 11.
