Commissioner of Yukon/Commissaire du Yukon YUKON REGULATIONS 1 RÈGLEMENTS DU YUKON March 31, 2022 O.I.C. 2022/41 DÉCRET 2022/41 FIRST NATIONS (YUKON) SELF-GOVERNMENT ACT LOI SUR L’AUTONOMIE GOUVERNEMENTALE DES PREMIÈRES NATIONS DU YUKON SCHEDULE Section 15.0 of the Carcross/Tagish First Nation Self-Government Agreement is amended as follows: 1. The phrase “within Settlement Land” is deleted in 15.7.1. 2. 15.8, 15.8.1 and 15.8.2 are replaced with the following: 15.8 A refund of tax under 15.7 will not be paid to a claimant referred to in that clause unless, at the time at which the tax is paid, the claimant does not engage in any business or other activity for profit or gain, other than a business or an activity, the primary purpose of which is to provide goods or services to the Carcross/Tagish First Nation, Citizens, individuals resident on Settlement Land, corporations wholly owned by the Carcross/Tagish First Nation or by Citizens, or such other businesses or activities as the Parties may from time to time agree. 3. The following sections are added immediately after 15.12: 15.13 Commencing for the taxation year in which 15.13 comes into effect, and for subsequent taxation years, an amount received from a registered pension plan, or from a registered retirement savings plan or registered retirement income fund as these terms are defined by the Income Tax Act (Canada) to which amounts were transferred from a registered pension plan in accordance with the Income Tax Act (Canada), by a Citizen who is an Indian as defined by the Indian Act (Canada), shall be exempt from income tax under the Income Tax Act (Canada), to the extent that the amount is attributable to employment income to which one of the following conditions applies: 15.13.1 it was exempt from tax under section 87 of the Indian Act (Canada) or under any similar provision of any other Act of Parliament; or 15.13.2 it was income for which income tax was remitted under a regulatory instrument which provided tax treatment comparable to that provided under section 87 of the Indian Act (Canada). 15.14 Income exempt from income tax because of 15.13 will be administered by Canada on the same basis as if it were exempt from income tax because of section 87 of the Indian Act (Canada). L’expression « dans les terres visées par le règlement » à l’article 15.7.1 est supprimée. 2. Les articles 15.8, 15.8.1 et 15.8.2 sont remplacés par ce qui suit : 15.8 Le remboursement de taxe prévu à l'article 15.7 n'est versé au demandeur visé à cet article que si, au moment où la taxe est payée, aucune entreprise n'est exploitée, ni aucune activité exercée, par le demandeur à des fins lucratives, à l'exception d'une entreprise exploitée ou d'une activité exercée dont le but principal consiste à fournir des biens ou des services à la Première nation de Carcross/Tagish, aux citoyens, aux particuliers résidant sur les terres visées par le règlement ou aux filiales possédées en propriété exclusive par la Première nation de Carcross/Tagish ou par des citoyens, et de toute autre entreprise ou activité relativement à laquelle les parties peuvent convenir. 3. Les articles suivants sont ajoutés immédiatement après l’article 15.12 : 15.13 À compter de l’année d’imposition au cours de laquelle le présent article entre en vigueur, et pour les années d’imposition suivantes, un montant reçu d'un régime de pension agréé, ou d’un régime enregistré d’épargne-retraite ou d’un fonds enregistré de revenu de retraite au sens que la Loi de l’impôt sur le revenu (Canada) donne à ces termes, vers lequel des montants ont été transférés d'un régime de pension agréé conformément à la Loi de l'impôt sur le revenu (Canada), par un citoyen qui est un Indien au sens de la Loi sur les Indiens (Canada), est exempté de l'impôt sur le revenu en vertu de la Loi de l'impôt sur le revenu (Canada), dans la mesure où le montant est attribuable à un revenu d'emploi auquel s'applique l'une des conditions suivantes : 15.13.1 il était exempté d’impôt en application de l’article 87 de la Loi sur les Indiens (Canada) ou d’une disposition semblable prévue par une autre loi du Parlement; ou 15.13.2 il s’agissait de revenus pour lesquels l’impôt sur le revenu a été remis à un Indien en application d’un instrument réglementaire qui avait un effet fiscal similaire à celui obtenu en application de l’article 87 de la Loi sur les Indiens (Canada). 15.14 Les revenus exemptés de l'impôt sur le revenu en raison de l’article 15.13 seront administrés par le Canada de la même manière que s’ils étaient exemptés de l'impôt sur le revenu en raison de l'article 87 de la Loi sur les Indiens (Canada).
