AECB Cost Recovery Fees Remission Order, 1997 His Excellency the Governor General in Council, on the recommendation of the Minister of Natural Resources and the Treasury Board, pursuant to subsection 23(2.1)a of the Financial Administration Act, hereby makes the annexed AECB Cost Recovery Fees Remission Order, 1997. S.C. 1991, c. 24, s. 7(2) Words and expressions in this Order have the same meaning as in the AECB Cost Recovery Fees Regulations, 1996. This Order applies in respect of fees paid pursuant to the AECB Cost Recovery Fees Regulations, 1996; the AECB Cost Recovery Fees Regulations, 1994; the AECB Cost Recovery Fees Regulations, 1993; and the AECB Cost Recovery Fees Regulations. Remission is hereby granted of that portion of fees that was refunded prior to the coming into force of this Order to any person pursuant to a regulation referred to in section 2; and of that portion of the fees paid pursuant to the AECB Cost Recovery Fees Regulations, 1996, that is equal to the refund made in the following circumstances, namely any person who pays a fee for a licence or approval, and the licence or approval issued is subsequently revoked or amended thus reducing the term of the licence or approval, or changing the licensed or approved activity thereby reducing the fee, shall be refunded by the Board the portion of the fee paid that is equal to the product obtained by multiplying the quotient obtained by dividing the amount of the fee paid by the number of days in the fee period by the number of days remaining in the fee period, beginning with the day on which the Board or designated officer approves the revocation or amendment, any person who pays a quarterly, annual or biennial fee for a licence or approval, and the fee is subsequently changed to an hourly rate fee, shall be refunded by the Board the portion of the fee paid that is equal to the product obtained by multiplying the number of days remaining in the fee period, as of the day of the change to an hourly rate fee, and any person who pays a fee for a licence or approval, and the fee for the licence or approval is subsequently reduced, shall be refunded by the Board the portion of the fee paid that is equal to the product obtained by multiplying the quotient obtained by dividing the difference obtained by subtracting the current fee from the fee paid by the number of days in the fee period, the number of days remaining in the fee period, as of the day of the reduction of the fee.
