And Whereas the Public Service Commission recommends that, pursuant to subsection 41(1) of the Public Service Employment Act, the Governor in Council approve the exclusion by the Public Service Commission from the operation of section 10 and subsection 21(1) of the Public Service Employment Act of certain persons and positions. Therefore, Her Excellency the Governor General in Council, on the recommendation of the Secretary of State, pursuant to subsection 41(1) of the Public Service Employment Act, is pleased hereby to make the annexed Order approving the exclusion by the Public Service Commission from the operation of section 10 and subsection 21(1) of the Public Service Employment Act of certain persons and positions. This Order may be cited as the Exclusion Approval Order for Certain Employees and Certain Positions (Air Traffic Control Group), 1989. The exclusion by the Public Service Commission, from the operation of section 10 of the Public Service Employment Act, in relation to qualifications other than language skills, of training positions in the Department of Transport to which will be appointed employees of that Department who participate in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program, during the period beginning on May 1, 1989 and ending on April 30, 1991, is hereby approved.
