Yorkton Airport Zoning Regulations

Regulations Respecting Zoning at Yorkton Airport Whereas, pursuant to section 4.5 of the Aeronautics Act, a copy of the proposed Zoning Regulations respecting Yorkton Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette Part I on May 16th and 23rd, 1987, and in two successive issues of the Yorkton Enterprise on June 29th and July 6th, 1987, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto. Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 4.4 of the Aeronautics Act, is pleased hereby to make the annexed Regulations respecting zoning at Yorkton Airport. These Regulations may be cited as the Yorkton Airport Zoning Regulations. In these Regulations, airport means the Yorkton Airport, in the vicinity of Yorkton, in the Province of Saskatchewan; (aéroport) airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport) approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche) Minister means the Minister of Transport; (ministre) outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure) strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande) transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule; (surface de transition) For the purposes of these Regulations, the elevation of the airport reference point is 487 m above sea level. These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described as follows: the lands within the outer limits of lands described in Part VI of the schedule; and the lands directly under that portion of the approach surfaces that extend beyond the said outer limits. No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point the approach surfaces; the outer surface; or the transitional surfaces. Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may require that the owner or occupier of the land on which that object is growing remove the excessive growth. No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds. The airport reference point, shown on Public Works Canada Yorkton Airport Zoning Plan No. E.1876 dated March 7, 1985, is a point lying perpendicular distant 61.4 m southwesterly from a point on the centre line of runway 12-30 and distant 270.1 m measured southeasterly along the centre line of runway 12-30 from the intersection of the centre lines of runways 03-21 and 12-30. The approach surfaces, shown on Public Works Canada Yorkton Airport Zoning Plan No. E.1876 dated March 7, 1985, are surfaces abutting each end of the strip associated with the runways designated 12-30 and 03-21 and are described as follows: a surface abutting the end of the strip associated with runway approach 12, consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295 m from the projected centre line; said imaginary horizontal line being 62.5 m measured vertically above the elevation at the end of the strip; a surface abutting the end of the strip associated with runway approach 30, consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295 m from the projected centre line; said imaginary horizontal line being 62.5 m measured vertically above the elevation at the end of the strip; a surface abutting the end of the strip associated with runway approach 03, consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 375 m from the projected centre line; said imaginary horizontal line being 60 m measured vertically above the elevation at the end of the strip; and a surface abutting the end of the strip associated with runway approach 21, consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 375 m from the projected centre line; said imaginary horizontal line being 60 m measured vertically above the elevation at the end of the strip. The outer surface, shown on Public Works Canada Yorkton Airport Zoning Plan No. E.1876 dated March 7, 1985, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground. The strips associated with runways 12-30 and 03-21, as shown on Public Works Canada Yorkton Airport Zoning Plan No. E.1876 dated March 7, 1985, are described as follows: the strip associated with runway 12-30 is 90 m in width, 45 m on each side of the centre line of the runway and 1 156.3 m in length; and the strip associated with runway 03-21 is 150 m in width, 75 m on each side of the centre line of the runway and 1 583 m in length. The transitional surfaces, shown on Public Works Canada Yorkton Airport Zoning Plan No. E.1876 dated March 7, 1985, are described as follows: the transitional surface associated with runway 12-30, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 5 m measured horizontally at right angles to the centre line and projected centre line of the strip extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip; and the transitional surface associated with runway 03-21, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip. The boundary of the outer limits of lands, shown on Public Works Canada Yorkton Airport Zoning Plan No. E.1876 dated March 7, 1985, is described as follows: Commencing at the North West corner of the North West Quarter of Section Twenty-eight (28), Township Twenty-six (26), Range Four (4), West of the Second (2nd) Meridian in the Province of Saskatchewan; thence Easterly along the Northerly limit of the said Quarter Section to the North East corner thereof; thence Northerly across the intervening road allowance and along the Westerly limit of the South East Quarter of Section Thirty-three (33), to the North West corner thereof; thence Easterly along the Northerly limit of the said Quarter Section and its production across the intervening road allowance to the South West corner of the North West Quarter of Section Thirty-four (34); thence Northerly along the Westerly limit of the said Quarter Section to the North West corner thereof; thence Easterly along the Northerly limits of Sections Thirty-four (34), Thirty-five (35), and across the intervening road allowance to an intersection with the Southerly production of the Westerly limit of the South East Quarter of Section Two (2), Township Twenty-Seven (27), Range Four (4), West of the Second (2nd) Meridian; thence Northerly across the intervening road allowance and along the Westerly limit of the South East Quarter of Section Two (2) to the North West corner thereof; thence Easterly along the Northerly limit of the said Quarter Section to its intersection with the Westerly limit of the road, as shown on Registered Plan BY 5472; thence Southerly along the said road plan to its intersection with the Northerly limit of the North East Quarter of Section Thirty-five (35), Township Twenty-six (26), Range Four (4), West of the Second (2nd) Meridian; thence Easterly along the Northerly limits of the said Quarter Section, and Section Thirty-six (36) of the said Township Twenty-six (26), Range Four (4), West of the Second (2nd) Meridian, and the North West Quarter of Section Thirty-one (31), Township Twenty-six (26), Range Three (3), West of the Second (2nd) Meridian, and across the intervening road allowance to the North East corner thereof;
