Withdrawal of Certain Lands (Mackenzie Delta Region, N.W.T.) from Disposal Order

Withdrawal of Certain Lands (Mackenzie Delta Region, N.W.T.) from Disposal Order His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, for the reason that the lands are required to facilitate the settlement of native land claims, is pleased hereby, pursuant to paragraph 23(a) of the Territorial Lands Act, to order the withdrawal from disposal of the lands described in the schedule hereto, excluding construction material that may be disposed of pursuant to the Territorial Quarrying Regulations and timber that may be disposed of pursuant to the Forest Management Act (Northwest Territories), and including all mines and minerals as defined in the Canada Mining Regulations for the period terminating on September 30, 1993, or on the date of settlement legislation implementing the Gwich’in Agreement, whichever comes first, without prejudice to the following interests, including any renewals, replacements, extensions or transfers thereof: located or recorded mineral claims or prospecting permits in good standing under the Canada Mining Regulations; rights in good standing created pursuant to section 8 of the Territorial Lands Act or the Territorial Lands Regulations; rights to obtain a surface lease on located or recorded mineral claims, pursuant to section 8 of the Territorial Lands Act or the Territorial Lands Regulations; permits, special renewal permits and leases in good standing under the Canada Oil and Gas Land Regulations; permits in good standing under the Territorial Quarrying Regulations; existing rights and interests granted pursuant to the Canada Petroleum Resources Act; existing rights issued pursuant to the Territorial Coal Regulations and the Territorial Dredging Regulations and the Forest Management Act (Northwest Territories); and interests in lands described in “Exhibit 2” to the Acquisition Agreement dates May 5, 1988 among Her Majesty in right of Canada, the Northern Canada Power Commission, the Government of the Northwest Territories and the Northwest Territories Power Corporation. In the Northwest Territories; Gwich’in Claim; Mackenzie Delta Withdrawal Order, all those parcels of land shown as “RURAL LANDS”, “AREAS FOR SITE SPECIFIC SELECTION” and “MACKENZIE DELTA SUBSURFACE WITHDRAWAL AREA” as said parcels are shown on the following maps on file at the office of the Regional Manager, Land Resources Division at Yellowknife, Northwest Territories: National Topographic Series Maps SAVING, EXCEPTING AND RESERVING thereout and therefrom any tract of territorial lands described in the Schedule which is subject to a lease or agreement for sale made pursuant to the Territorial Lands Act and the Territorial Lands Regulations.
