Withdrawal of Certain Lands (North Baffin Island, N.W.T.) from Disposal Order

Withdrawal of Certain Lands (North Baffin Island, N.W.T.) from Disposal Order His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands Act, is pleased hereby to order the withdrawal from disposal of the lands described in the schedule hereto, for the reason that the lands are required to facilitate the establishment of a National Park, including all mines and minerals, whether solid, liquid or gaseous, construction material that may be disposed of pursuant to the Territorial Quarrying Regulations, and timber that may be disposed of pursuant to the Forest Management Act (Northwest Territories), without prejudice to the following interests, including any renewals, replacements, extensions or transfers thereof: located or recorded mineral claims or prospecting permits in good standing under the Canada Mining Regulations; the right to obtain a surface lease on located or recorded mineral claims pursuant to the Territorial Lands Regulations; rights in good standing created pursuant to section 8 of the Territorial Lands Act or the Territorial Lands Regulations; permits, special renewal permits and leases in good standing under the Canada Oil and Gas Land Regulations; permits in good standing under the Territorial Quarrying Regulations; existing rights and interests granted pursuant to the Canada Petroleum Resources Act; existing rights issued pursuant to the Territorial Coal Regulations and the Territorial Dredging Regulations; and interests in lands described in “Exhibit 2” to the Acquisition Agreement dates May 5, 1988, among Her Majesty in right of Canada, the Northern Canada Power Commission, the Government of the Northwest Territories and the Northwest Territories Power Corporation. In the Northwest Territories; North Baffin Island; all those parcels of land shown as “TYPE 2 LANDS” on the following maps which were signed and approved by Jim Umpherson, Regional Manager, Land Resources, Northern Affairs Program, Yellowknife, Northwest Territories and Gordon M. Hamre, Northern Parks Advisor, National Parks System Planning, Canadian Parks Service, Environment Canada, Yellowknife, Northwest Territories, which are on file with the Land Manager, Department of Indian Affairs and Northern Development, Regional Office, at Yellowknife, in the Northwest Territories, copies of which have been deposited with the Land Management Division, Department of Indian Affairs and Northern Development, Northern Affairs Program, in Ottawa: SAVING, EXCEPTING AND RESERVING thereout and therefrom any tract of territorial lands described in the schedule which is subject to a lease or agreement for sale made pursuant to the Territorial Lands Act and the Territorial Lands Regulations.
