اختصاص هيئة قضايا الدولة الطعن رقم 0057 لسنة 02 مكتب فنى 06 صفحة رقم 1065 بتاريخ 15-05-1961 الموضوع : اختصاص ان ادارة قضايا الحكومة " تنوب عن الحكومة و المصالح العامة فيما يرفع منها او عليها من قضايا لدى المحاكم على اختلاف انواعها و درجاتها و لدى الجهات الاخرى التى خولها القانون اختصاصاً قضائياً " طبقاً للمادة الثانية من قرار رئيس الجمهورية بالقانون رقم 58 لسنة 1959 فى شان تنظيم ادارة قضايا الحكومة فهى و الحالة هذه تنوب نيابة قانونية عن الحكومة فى رفع الطعن و غنى عن البيان ان كتاب التزكية الصادر من وزير الخزانة الى مجلس التاديب لصالح احد الموظفين المحالين اليه لا يخرج عن كونه مجرد ابداء راى فى الموضوع لا يؤثر على رفع الدعوى التاديبية و لا على قبول الطعن المقدم فى القرار الصادر عن مجلس التاديب فضلاً عن ان الوزير لم يصدر قراراً بعدم الطعن . الطعن رقم 1316 لسنة 34 مكتب فنى 34 صفحة رقم 1250 بتاريخ 01-07-1989 الموضوع : اختصاص الموضوع الفرعي : اختصاص هيئة قضايا الدولة فقرة رقم : 1 القانون رقم 10 لسنة 1986 فى شان تعديل القانون رقم 75 لسنة 1963 فى شان تنظيم ادارة قضايا الحكومة - " الادارات القانونية بالمؤسسات و الهيئات العامة " . نيابة هيئة قضايا الدولة عن الدولة بكافة شخصياتها الاعتبارية العامة فيما يرفع منها او عليها من قضايا تمتد لتشمل جميع الاشخاص الاعتبارية العامة فى الدولة و هو ما يمتد ليشمل الجامعات - لا تعارض بين هذا الاختصاص و الاختصاص المعقود للادارات القانونية المنشاة بالهيئات العامة بموجب القانون رقم 47 لسنة 1973 .
