هيئة النقل العام مرفق عام الطعن رقم 0245 لسنة 26 مكتب فنى 13 صفحة رقم 246 بتاريخ 15-02-1962 الموضوع : اشخاص اعتبارية الموضوع الفرعي : هيئة النقل العام مرفق عام فقرة رقم : 1 لما كانت ادارة النقل العام بمدينة الاسكندرية قد انشئت بالقانون رقم 22 سنة 1954 الذى اضفى عليه الشخصية المعنوية وهى تباشر مرفقاً عاماً من مرافق الدولة فهى بذلك تعتبر من اشخاص القانون العام . و قد تاكد ذلك بما قررته المذكرة الايضاحية للقانون المذكور من ان" مرفق النقل فى منطقة الاسكندرية مؤسسة عامة او شخص مصلحى ذو شخصية معنوية مستقلة عن شخصية الدولة وعن شخصية البلدية ". الطعن رقم 0013 لسنة 27 مكتب فنى 13 صفحة رقم 403 بتاريخ 04-04-1962 الموضوع : اشخاص اعتبارية الموضوع الفرعي : هيئة النقل العام مرفق عام فقرة رقم : 3 لادارة النقل المشترك بمنطقة الاسكندرية الشخصية المعنوية و هى مؤسسة عامة و لذلك تكون علاقتها بموظفيها علاقة تنظيمية تحكمها القوانين و اللوائح - و اذا كان الحكم المطعون فيه قد استند فى قضائه الى احكام قانون عقد العمل الفردى دون تلك القوانين و اللوائح فان ذلك لايعيبه طالما ان النتيجة التى انتهى اليها تتفق مع احكام القانون الواجب التطبيق .
