وقف دعوى الحراسة الطعن رقم 0074 لسنة 04 مجموعة عمر 1ع صفحة رقم 867 بتاريخ 20-06-1935 الموضوع : حراسة الموضوع الفرعي : وقف دعوى الحراسة فقرة رقم : 2 اذا اوقفت محكمة الاستئناف دعوى الحراسة المتقدمة الذكر لوفاة احد الخصوم ، ثم قضى ببطلان المرافعة فيها فى مواجهة النظار الذين حلوا محل الناظر المعين حارساً ، فان حكم الحراسة المستانف اذا كان قد اصبح نهائياً فما هذا الا بالنسبة لمبدا الحراسة القضائية فقط ، و لكنه غير ملزم من جهة الشخص المعين حارساً و عدم الزامه لا يمكن القول معه بنهائيته بالنسبة لهذا التعيين ، و لا بان وضع يد الناظر على الاطيان المتنازع عليها قد تغير من كونه النظر على وقف هذه الارض الى كونه الحراسة القضائية عليها . و لا بان ناظر الوقف او نظاره مسئولون عن الحساب مسئولية الحراس القضائيين .
