( الطعن رقم 264 لسنة 23 ق ، جلسة 1956/11/29 ) الطعن رقم 0264 لسنة 23 مكتب فنى 07 صفحة رقم 927 بتاريخ 29-11-1956 الموضوع : تموين الموضوع الفرعي : غش دخان فقرة رقم : 2 المادة الرابعة من القانون رقم 74 لسنة 1933 المعدل بالقانون رقم 86 لسنة 1948 بشان تنظيم صناعة الدخان و تجارته لم ترتب بطلاناً على النقص فى عدد العينات او صورتى محضر الضبط ما دام من ضبط لديه الدخان لم يبد اعتراضاً على ذات العينات التى جرى التحليل عليها و لا اعتراضاً على ما دون بالمحضر فمتى اطمان القاضى الى صحة الدليل المستمد من التحليل و لم يساوره الشك فى ناحية من نواحيه خصوصاً من جهة اخذ العينة او من تحرير المحضر من صورة واحدة او من عملية التحليل ذاتها اصدر حكمه على هذا الاساس بغض النظر عن عدد العينات التى اخذت كما جرى قضاء هذه المحكمة .
