الترخيص باستغلال كازينو الطعن رقم 2801 لسنة 30 مكتب فنى 35 صفحة رقم 1163 بتاريخ 24-02-1990 الموضوع : ترخيص المادة 790 من التقنين المدنى - لا يجوز التعدى على الاموال الخاصة المملوكة للدولة او الاشخاص الاعتبارية العامة - للوزير المختص ازالة التعدى ادارياً - اذا تعدى المرخص له باستغلال كازينو على مساحة اكبر من المساحة محل الترخيص فان هذا التعدى يعتبر اخلالاً بالتزام عام يقع على الكافة اساسه المادة 790 من التقنين المدنى و يعتبر ايضاً اخلالاً بالتزام خاص اساسه العقد محل الترخيص - اذا اتجهت المحافظة بعد التعدى الى الابقاء على المساحات موضوع التعدى كلها او بعضها تحت يد مستغل الكازينو فى مقابل جعل بحيث يشملها ترخيص استغلال الكازينو الى نهاية مدته فان الامر يخرج عن نطاق اتخاذ الاجراءات اللازمة لحماية المال العام لياخذ ذات الطبيعة القانونية للترخيص بالاستغلال .
