Statute overview

About this statute

FEVE’s new assets may be added to its patrimony either by the Government through the Ministry of Finance or by FEVE itself, depending on the type and purpose of the assets. El Consejo de Administración puede acordar el desguace y, en su caso, la venta de material inservible, instalaciones y otros bienes muebles, sin necesitar una declaración expresa de desafectación del servicio. FEVE’s board must declare railway-irrelevant immovable property unnecessary and move it into the State’s patrimony. It may also propose keeping such property as reserve assets, with that plan reviewed at least every five years. FEVE may be authorized to sell or swap certain assets, but the sale proceeds must be used for permitted purposes, and swaps cannot be authorized if the value difference is more than 50%. The goods covered by Articles 11 and 13 must be sold by public auction, unless FEVE is authorized to sell directly in special circumstances.
