Statute overview

About this statute

In urgent cases, the requesting State may ask for the requested person’s preventive detention in writing through INTERPOL or the requested State’s competent authorities. The requested State must take the necessary measures and notify the requesting State quickly. The detained person must be released after 60 days if the extradition request and required documents have not arrived. Extradition may be granted if the person sought consents, even if the conditions in articles 7 and 8 have not been met. Objects found in the requested State that were obtained through the offence or are needed as evidence must be handed over to the requesting State when extradition is granted or the requested person consents, subject to the requested State’s law and third-party rights.
