Statute overview

About this statute

Certain design disclosures are disregarded for applying articles 6 and 7, including disclosures made by the author, successor, or a third party in specified circumstances, unless the disclosure resulted from abuse. A design registration does not grant rights over product appearance features dictated solely by technical function or features that must be reproduced exactly for mechanical connection, except for modular systems that meet the stated conditions. No se registrarán los diseños que sean contrarios al orden público o a las buenas costumbres. A design registration must be denied, or cancelled if already granted, in the listed cases. El derecho a registrar un diseño corresponde al autor o a su causahabiente.
