Las entidades sujetas deben mantener un capital principal mínimo del 9 % y remitir trimestralmente al Banco de España el estado CP. This provision repeals Banco de España Circular 2/2011 when the present circular enters into force. Until the fiscal year closed on 31 December 2015, any excess of the mandatory reserve fund that arose from bylaws-based allocations exceeding the required amount is treated as free-disposition reserves, if using them to pay members’ contributions was authorized by the Bank of Spain. This circular takes effect on 1 January 2013, except the first final provision, which takes effect on the day it is published in the BOE. Certain entities under the circular must exceptionally prepare a CP statement as of 1 January 2013 and submit it to Banco de España by 28 February 2013.
