Statute overview

About this statute

Las fianzas o garantías financieras del procedimiento sancionador en pesca marítima del Estado se constituyen a favor de la Secretaria General de Pesca, que puede adoptar acuerdos sobre ellas. Regulates what the competent authority must do when an infringement has prescribed: not start proceedings, close and archive ongoing proceedings, notify affected persons, and archive if two months pass without notifying the accused. Los órganos competentes must tell the public prosecutor when facts may be criminal, seek court information when there is a criminal case on the same facts, suspend the sanctioning case in certain overlapping cases, and resume it if no offence is found. Maritime fishing conduct counts as an administrative offence if it is listed as such in Chapter II of Title V of Law 3/2001. This article sets how pecuniary sanctions are graded for leve, grave, and very grave infringements, and lists factors that can aggravate the sanction.
