Social Security (Scotland) Act 2018 An Act of the Scottish Parliament making provision about social security. The Scottish social security principles are— social security is an investment in the people of Scotland, social security is itself a human right and essential to the realisation of other human rights, the delivery of social security is a public service, respect for the dignity of individuals is to be at the heart of the Scottish social security system, the Scottish social security system is to contribute to reducing poverty in Scotland, the Scottish social security system is to be designed with the people of Scotland on the basis of evidence, opportunities are to be sought to continuously improve the Scottish social security system in ways which— put the needs of those who require assistance first, and advance equality and non-discrimination, the Scottish social security system is to be efficient and deliver value for money. The Scottish social security principles are set out in section 1 so that— they can be reflected in the Scottish social security charter as required by section 15(3), and the Scottish Commission on Social Security can have regard to them as required by section 97(6). A court or tribunal in civil or criminal proceedings may take the Scottish social security principles into account when determining any question arising in the proceedings to which the principles are relevant. Breach of the principles does not of itself give rise to grounds for any legal action. The Scottish Ministers must— keep under consideration what steps they could take to ensure that individuals are given what they are eligible to be given through the Scottish social security system, and if the Ministers consider it appropriate to do so, take any of the steps identified by that consideration. In fulfilling their duty under section 3(a), the Scottish Ministers must have regard to the importance of communicating in an inclusive way. In subsection (1), “communicating in an inclusive way” means communicating in a way that ensures individuals who have difficulty communicating (in relation to speech, language or otherwise) can receive information and express themselves in ways that best meet each individual's needs. In fulfilling their duty under section 3(a), the Scottish Ministers must have regard to the importance of providing information in a way that is accessible for individuals who have a sensory, physical or mental disability. The steps taken by the Scottish Ministers under section 3(b) must include steps in relation to ensuring that— the information this Act requires the Scottish Ministers to give to an individual is given in a format that is accessible to the individual, and all information which this Act requires the Scottish Ministers to make publicly available is available in formats that are accessible to individuals who have a sensory, physical or mental disability. In fulfilling their duty under section 3(a), the Scottish Ministers must have regard to the role that— independent information and advice, and independent advocacy, can play in ensuring that individuals are given what they are eligible to be given through the Scottish social security system. The steps taken by the Scottish Ministers under section 3(b) must include steps in relation to providing, or ensuring the provision of, information about— for individuals applying for, or receiving, assistance through the Scottish social security system. The steps taken by the Scottish Ministers under section 3(b) must include steps in relation to ensuring the availability of independent information and advice (that is accessible to, and proportionate to the needs of, the individuals to whom it is given) about the Scottish social security system, and the following matters in particular— how to apply for assistance, the process by which entitlement to assistance is determined, the types of assistance available, income maximisation, the content of the Scottish social security charter. For the purposes of this section, information, advice and advocacy are independent if they are provided by a person other than the Scottish Ministers. In fulfilling their duty under section 3(a), the Scottish Ministers must have regard to the possibility that information obtained for the purpose of determining an individual's eligibility for one type of assistance might be used to identify the individual's eligibility for other types of assistance. The Scottish Ministers are to prepare a strategy to promote take-up in accordance with this section and section 9. A strategy to promote take-up is to set out— the Scottish Ministers' best estimate of the extent to which, at the time the strategy is prepared, all individuals who are eligible to be given assistance through the Scottish social security system are being given the assistance they are eligible to be given, the steps under section 3(b) that the Ministers intend to take during the strategy's lifetime. Having prepared a strategy to promote take-up, the Scottish Ministers must— lay it before the Scottish Parliament, and make it publicly available by such means as they consider appropriate. The Scottish Ministers must prepare— the first strategy to promote take-up within 1 year of this section coming into force, the second strategy within 3 years of this section coming into force, and thereafter, a new strategy within 5 years of the last strategy being laid before the Parliament in accordance with section 8(3)(a). In preparing a strategy to promote take-up, the Scottish Ministers must consult such persons as they consider appropriate. The persons consulted must include— individuals who have received assistance through the Scottish social security system, and persons who work with or represent individuals living in households whose income is adversely affected, or whose expenditure is increased, because a member of the household has one or more protected characteristics within the meaning of section 4 of the Equality Act 2010. Every individual to whom subsection (3) applies has a right of access to independent advocacy in connection with the determination of the individual's entitlement to be given assistance through the Scottish social security system. It is the duty of the Scottish Ministers to ensure that independent advocacy services are available to the extent necessary for that right to be exercised by the individuals who have it. This subsection applies to an individual if, owing to a disability, the individual requires an advocate's help to engage effectively with the process for determining entitlement to be given assistance through the Scottish social security system. For the purposes of this section— “advocacy services” means services of support and representation that are made available for the purpose of enabling an individual to whom they are provided to have as much control of, or capacity to influence, the decisions that determine the individual's entitlement to be given assistance through the Scottish social security system as is, in the circumstances, appropriate, advocacy services are independent if they are provided by a person other than the Scottish Ministers. It must be a term of any agreement that the Scottish Ministers enter into with a person for the provision of advocacy services in connection with their duty under section 10(2), that the person undertakes to comply with the advocacy service standards. The advocacy service standards are to be set by the Scottish Ministers in regulations and may, in particular, include provision in relation to— the training and experience individuals providing advocacy services must have, service quality, quality assurance processes, record keeping. The advocacy service standards, or a part of them, may be set by reference to another document (whether or not prepared by the Scottish Ministers). An individual may not be required, in order to be given assistance through the Scottish social security system, to undergo an assessment of physical condition or mental health that is carried out by another individual who is not acting in the course of employment by a public body. In subsection (1), “public body” means any of the following— a Minister of the Crown, a person established by an enactment, a body comprised solely of persons described by this subsection, a body corporate that has no members other than (either or both)— persons described by this subsection, persons acting on behalf of persons described by this subsection. For the purposes of this section, an individual may be regarded as carrying out an assessment in the course of employment by a body if the individual carries out the assessment pursuant to an agreement between the body and the individual; it is immaterial that the individual would not be regarded as an employee of the body for the purposes of any other enactment. Subsection (1) does not preclude its being made a requirement for being given assistance through the Scottish social security system that an individual be— in receipt of, or eligible or entitled to receive, other assistance, despite entitlement to that other assistance depending on the fulfilment of a requirement that subsection (1) would preclude from being imposed in relation to the giving of assistance through the Scottish social security system. In subsection (4), “other assistance” means assistance other than assistance given through the Scottish social security system. The Scottish Ministers must ensure that any assessment to which subsection (2) applies is carried out by a suitably qualified person. This subsection applies to an assessment that— is arranged— by the Scottish Ministers, in connection with making a determination of what assistance an individual is eligible to be given through the Scottish social security system, and is an assessment of physical condition or mental health. The Scottish Ministers may by regulations specify who is to be regarded as a suitably qualified person within the meaning of subsection (1) by reference to a person's— training, experience, or holding a particular position. Regulations under subsection (3) must make different provision about who is suitably qualified to carry out an assessment depending on what the assessment is about. It is implicit in the principle (expressed in section 1(d)) that respect for the dignity of individuals is to be at the heart of the Scottish social security system that— an individual should not be required to undergo an assessment in order to be given assistance unless that is the only practicable way to obtain the information needed to determine what assistance the individual is eligible to be given, and the Scottish Ministers should take into consideration any preferences an individual has expressed to them about where and how any assessment is carried out. A Scottish social security charter is to be prepared, published and from time to time reviewed in accordance with sections 16 to 18. The charter is to set out what should be expected— from the Scottish Ministers when— developing social security policy, and exercising the functions conferred on them by this Part and Parts 2 and 3, and from the individuals who apply for, and receive, assistance through the Scottish social security system. The charter is to reflect the Scottish social security principles. The Scottish Ministers are to prepare the charter within 6 months of this section coming into force. In preparing the charter, the Scottish Ministers must consult such persons as they consider appropriate. The Scottish Ministers must ensure, as far as is reasonably practicable, that the persons consulted include, in particular, a representative proportion of persons such as are mentioned in subsection (4)(a)(i), (ii) and (iv) who have— a physical impairment, a mental impairment. individuals who are in receipt of— disability living allowance as provided for by sections 71 to 76 of the Social Security Contributions and Benefits Act 1992, personal independence payment as provided for by Part 4 of the Welfare Reform Act 2012, severe disablement allowance as provided for by sections 68 and 69 of the Social Security Contributions and Benefits Act 1992, attendance allowance as provided for by section 64 of that Act, industrial injuries benefits within the meaning of Part 5 of that Act, child benefit as provided for by Part 9 of that Act, carer's allowance as provided for by section 70 of that Act, payments under section 138 of that Act in respect of— maternity expenses, funeral expenses, heating expenses, and For the purpose of subsection (2), it is immaterial that anything done by way of consultation was done before the Bill for this Act was passed or after that but before this section comes into force. The Scottish Ministers may not make the charter unless a draft of it has been laid before, and approved by resolution of, the Scottish Parliament. The Scottish Ministers are to make the charter publicly available by such means as they consider appropriate. The Scottish Ministers must review the charter— within 5 years of its being made, and thereafter, within 5 years of the report of the last review being laid before the Parliament in accordance with subsection (4)(b). In carrying out a review, the Scottish Ministers must consult— the Scottish Commission on Social Security, and any other persons they consider appropriate. Following a review, the Scottish Ministers must— decide whether or not to make any changes to the charter, and lay before the Scottish Parliament a report setting out— the consultation undertaken in carrying out the review, the reasons for their decision to make changes, or not make changes, to the charter, and if the Ministers have decided to make changes to the charter, a draft of the charter showing the changes they intend to make. The Scottish Ministers may not make changes to the charter unless a draft of the charter showing the changes they intend to make has been laid before, and approved by resolution of, the Scottish Parliament. A court or tribunal in civil or criminal proceedings may take the Scottish social security charter into account when determining any question arising in the proceedings to which the charter is relevant. Breach of the charter does not of itself give rise to grounds for any legal action. As soon as practicable after the end of each financial year, the Scottish Ministers are to— lay before the Scottish Parliament, and make publicly available by such means as they consider appropriate, a report on the performance of the Scottish social security system in that year. The report is to contain— information about the performance of the Scottish social security system in that year, a description of what the Scottish Ministers have done in that year to meet the expectations of them set out in the Scottish social security charter, an assessment of how the Scottish social security system has affected the circumstances of persons living in households whose income is adversely affected, or whose expenditure is increased, because a member of the household has one or more protected characteristics within the meaning of section 4 of the Equality Act 2010, and a description of the data for the purpose of monitoring equality of opportunity used in preparing the report. The first report under this section is to include a plan setting out the Scottish Ministers' intentions to collect and publish data for the purpose of monitoring equality of opportunity where existing data sources are not sufficient for the preparation of the report. The Scottish Commission on Social Security is established. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Schedule 1 makes further provision about the Commission. The Scottish Commission on Social Security has the following functions— to scrutinise legislative proposals in accordance with section 97, to prepare and submit to the Scottish Ministers a report on any matter, relevant to social security, that the Ministers request the Commission to report on, to prepare and submit to the Scottish Parliament a report on any matter, relevant to social security, that the Commission is requested to report on by the Parliament after the Parliament has resolved that the request should be made, to prepare and submit to the Ministers and the Parliament, from time to time, a report containing— an assessment of the extent to which any or all of the expectations set out in the Scottish social security charter are being fulfilled, and recommendations for improvement where the assessment is that those expectations are not being fulfilled, any functions the Ministers confer on the Commission by regulations. In performing any of the functions mentioned in subsection (1), the Commission may have regard to any relevant international human rights instruments (see also section 97(6)). The Commission must make publicly available by such means as it considers appropriate any report that it prepares in pursuance of a function mentioned in subsection (1). The Commission must consider preparing a report under subsection (1)(d) if it receives evidence which suggests that expectations set out in the charter are frequently not being fulfilled. As soon as practicable after the end of each financial year, the Commission must— prepare and publish a report containing information on the carrying out of its functions during that year, and send a copy of the report to the Scottish Ministers. The Scottish Ministers must lay before the Scottish Parliament a copy of each report sent to them by the Commission under subsection (4A)(b). In subsection (2), “international human rights instruments”— means any international convention, treaty or other international instrument ratified by the United Kingdom, subject to— any amendments in force in relation to the United Kingdom for the time being, and any reservations, objections or interpretative declarations by the United Kingdom for the time being in force, and includes, in particular, the International Covenant on Economic, Social and Cultural Rights adopted and opened for signature, ratification and accession by General Assembly resolution 2200A (XXI) of 16 December 1966. In this Part, “Scottish social security system” means the system for the Scottish Ministers giving assistance to individuals in accordance with any of the following— Part 2, regulations made under Part 3, a provision of any other Act of the Scottish Parliament if it is only by virtue of exception 10 of Section F1 of Part 2 of schedule 5 of the Scotland Act 1998 that the provision does not relate to reserved matters as defined in section 127 of that Act. The Scottish Ministers must give an individual whatever assistance of a type described in Chapter 2 the individual is entitled to be given under a determination of the individual's entitlement to assistance. References in this Part to a determination of an individual's entitlement to assistance are to a determination made— by the Scottish Ministers— under section 37, or (following a request for a re-determination) under section 43, by the First-tier Tribunal for Scotland— under section 49 in an appeal against a determination made by the Scottish Ministers, or (subsequent to such an appeal) under its Tribunals Act powers, by the Upper Tribunal for Scotland under its Tribunals Act powers (subsequent to an appeal against, or following a review of, a decision of the First-tier Tribunal), by the Court of Session under its Tribunals Act powers (in an appeal against a decision of the Upper Tribunal), or by the Supreme Court of the United Kingdom— in an appeal under section 40 of the Court of Session Act 1988 against a decision of the Court of Session, or on a reference made by the Court of Session under schedule 6 of the Scotland Act 1998. In this section, “Tribunals Act powers” means powers under Part 6 (review or appeal of decisions) of the Tribunals (Scotland) Act 2014. An individual may request that the Scottish Ministers cancel a determination of the individual's entitlement to assistance. On being requested to do so under subsection (1), the Scottish Ministers must cancel a determination— with immediate effect, or with effect from a later date specified in the request. An individual is not entitled, and is not to become entitled, to be given assistance by a determination after it has been cancelled. A request under subsection (1) must be made in such form as the Scottish Ministers require. The Scottish Ministers must publicise any requirements for the time being set under subsection (4). The latest determination of an individual's entitlement to a particular type of assistance in respect of a given period or event supersedes any earlier determination insofar as it deals with the individual's entitlement to that type of assistance in respect of the same period or event. Accordingly the individual is not entitled, and is not to become entitled, to be given any assistance in respect of that period or event by the earlier determination insofar as it has been superseded. Carer's assistance is assistance (which may or may not take the form of money) given by the Scottish Ministers under section 24 to an individual who provides, or has provided, care to another individual who has a disability. The Scottish Ministers are to make regulations prescribing— the eligibility rules that are to be applied to determine whether an individual is entitled to carer's assistance, and what carer's assistance an individual who is entitled to it is to be given. Schedule 2 makes provision about the exercise of the power conferred by subsection (2). Cold-spell heating assistance is assistance (which may or may not take the form of money) given by the Scottish Ministers under section 24 to an individual to meet, or help towards meeting, the individual's heating costs during a period of cold weather. the eligibility rules that are to be applied to determine whether an individual is entitled to cold-spell heating assistance, and what cold-spell heating assistance an individual who is entitled to it is to be given. Schedule 3 makes provision about the exercise of the power conferred by subsection (2). Winter heating assistance is assistance (which may or may not take the form of money) given by the Scottish Ministers under section 24 to an individual to meet, or help towards meeting, the individual's heating costs during the winter months. the eligibility rules that are to be applied to determine whether an individual is entitled to winter heating assistance, and what winter heating assistance an individual who is entitled to it is to be given. Schedule 4 makes provision about the exercise of the power conferred by subsection (2). Disability assistance is assistance (which may or may not take the form of money) given by the Scottish Ministers under section 24 to an individual on account of the individual having— a disability arising from a physical or mental impairment, or a terminal illness. the eligibility rules that are to be applied to determine whether an individual is entitled to disability assistance, and what disability assistance an individual who is entitled to it is to be given. Schedule 5 makes provision about the exercise of the power conferred by subsection (2). Early years assistance is assistance (which may or may not take the form of money) given by the Scottish Ministers under section 24 to help towards meeting some of the costs associated with having, or expecting to have, a child in the family. the eligibility rules that are to be applied to determine whether an individual is entitled to early years assistance, and what early years assistance an individual who is entitled to it is to be given. Schedule 6 makes provision about the exercise of the power conferred by subsection (2). Employment-injury assistance is assistance (which may or may not take the form of money) given by the Scottish Ministers under section 24 to an individual on account of the individual, or another individual, having suffered an injury, or contracted a disease, in the course of employment. the eligibility rules that are to be applied to determine whether an individual is entitled to employment-injury assistance, and what employment-injury assistance an individual who is entitled to it is to be given. Schedule 7 makes provision about the exercise of the power conferred by subsection (2). Funeral expense assistance is assistance (which may or may not take the form of money) given by the Scottish Ministers under section 24 to an individual to meet, or help towards meeting, funeral expenses. the eligibility rules that are to be applied to determine whether an individual is entitled to funeral expense assistance, and what funeral expense assistance an individual who is entitled to it is to be given. Schedule 8 makes provision about the exercise of the power conferred by subsection (2). Housing assistance is assistance (which may or may not take the form of money) given by the Scottish Ministers under section 24 to an individual to meet, or help towards meeting, housing costs. the eligibility rules that are to be applied to determine whether an individual is entitled to housing assistance, and what housing assistance an individual who is entitled to it is to be given. Schedule 9 makes provision about the exercise of the power conferred by subsection (2). Short-term assistance is assistance (which may or may not take the form of money) given by the Scottish Ministers under section 24 to an individual on a short-term basis. the eligibility rules that are to be applied to determine whether an individual is entitled to short-term assistance, and what short-term assistance an individual who is entitled to it is to be given. Schedule 10 makes provision about the exercise of the power conferred by subsection (2). The Scottish Ministers are to make a determination of an individual's entitlement to a type of assistance described in Chapter 2— on receiving an application for that type of assistance from the individual, or when required to do so by regulations under section 52. An application for assistance must be— made to the Scottish Ministers in such form, and accompanied by such evidence, as the Scottish Ministers require. The Scottish Ministers must publicise any requirements for the time being set under subsection (1). Once— an individual has applied for a particular type of assistance in respect of a period or (as the case may be) event, and the Scottish Ministers have made a determination of the individual's entitlement to that type of assistance in respect of the period or event, the individual cannot make another application for that type of assistance in respect of the period or event. Despite subsection (3), an individual may make another application for a particular type of assistance in respect of an event if the latest determination of the individual's entitlement to that type of assistance in respect of the event states that the individual may make another application. If the Scottish Ministers reject something purporting to be an application for assistance, they must inform the individual concerned of— the decision to do that, the reasons for it, and the individual's right to appeal under section 61. An individual who has made an application for assistance may request that the Scottish Ministers disregard it. If an individual requests that an application be disregarded— the Scottish Ministers are not to make a determination of the individual's entitlement to any type of assistance on the basis of the application, and accordingly, their duty to do so under section 37 ceases to apply. The Scottish Ministers must publicise any requirements for the time being set under subsection (3). Having made a determination under section 37 of an individual's entitlement to assistance, the Scottish Ministers must inform the individual— of the determination, of the reasons for it, of the individual's right under section 41 to request that the Scottish Ministers re-determine the individual's entitlement to the assistance, that the individual will have the right under section 46 to appeal to the First-tier Tribunal against the determination should the Scottish Ministers fail to deal with a request for a re-determination within the period allowed for re-determination, and if relevant, that the individual has the right to request a copy of an assessment report under section 60. The Scottish Ministers must fulfil their duty under subsection (1) in a way that leaves the individual with a record of the information which the individual can show to, or otherwise share with, others. An individual may request that the Scottish Ministers re-determine the individual's entitlement to a particular type of assistance after being informed (in accordance with section 40) of a determination by the Ministers of the individual's entitlement to that type of assistance. A request for a re-determination is valid only if the conditions set out in the following subsections are satisfied— subsection (3), and subsection (4) (read with section 52A). The condition referred to in subsection (2)(a) is satisfied if the request is made in such form as the Scottish Ministers require. The condition referred to in subsection (2)(b) is satisfied if— the request is made before the end of the period prescribed by the Scottish Ministers in regulations, or in a case where the request is made after that period has ended— the individual has a good reason for not requesting a re-determination sooner (see section 42), and the request is made before the end of the day that falls one year after the day on which the individual is informed (in accordance with section 40) of the determination (but see section 52A). If the Scottish Ministers decide that something purporting to be a request for a re-determination does not satisfy the condition in subsection (3), they must inform the individual concerned of— the decision, It is for— the Scottish Ministers, or on appeal under section 61, the First-tier Tribunal for Scotland, to decide whether, for the purpose of section 41(4)(b), an individual has a good reason for not requesting a re-determination sooner. Having made a decision under subsection (1), the Scottish Ministers must inform the individual concerned— of the decision, and if the decision is that the individual has no good reason for not requesting a re-determination sooner, of— the reasons for the decision, and On being requested under section 41 to re-determine an individual's entitlement to a particular type of assistance, the Scottish Ministers are to make a determination of the individual's entitlement to that type of assistance. The Scottish Ministers must aim to make the determination within the period allowed for re-determination. If the Scottish Ministers fail to make the determination within the period allowed for re-determination— their duty to make the determination ends (but they may still make it), and section 45 applies. If the Scottish Ministers make the determination (whether or not within the period allowed for re-determination), section 44 applies. The period allowed for re-determination is to be prescribed by the Scottish Ministers in regulations. The reference in subsection (1) to a request under section 41 is to a request that is valid according to subsection (2) of that section. Having made a determination under section 43 of an individual's entitlement to a particular type of assistance, the Scottish Ministers must— inform the individual— of the individual's right to appeal to the First-tier Tribunal under section 46 against the determination, if relevant, that the individual has the right to request a copy of an assessment report under section 60, and provide the individual with a form that the individual can complete and submit to the Scottish Ministers in order to bring an appeal against the determination. The Scottish Ministers must fulfil their duty under subsection (1)(a) in a way that leaves the individual with a record of the information which the individual can show to, or otherwise share with, others. Having failed to make a determination under section 43 of an individual's entitlement to a particular type of assistance within the period allowed for re-determination, the Scottish Ministers must— that the individual's request for a re-determination has not been dealt with within the period allowed, and that the individual therefore has the right to appeal to the First-tier Tribunal against the determination under section 37 which prompted the request for a re-determination, and An individual may appeal to the First-tier Tribunal for Scotland— against a determination under section 43 of the individual's entitlement to assistance, or in a case where subsection (2) applies, against the determination under section 37 referred to in that subsection. This subsection applies where— having been informed of a determination under section 37 of the individual's entitlement to assistance, the individual has made a request for a re-determination under section 41, and the Scottish Ministers have failed to make a determination under section 43 in consequence of that request within the period allowed for re-determination. In order to bring an appeal under section 46 against a determination, an individual must submit to the Scottish Ministers the form provided under section 44 or (as the case may be) 45 in relation to the determination. On receiving a form that they provided under section 44 or 45, the Scottish Ministers must send— the form, and the information held by them that they used to make the determination in question, to the First-tier Tribunal. Having complied with subsection (2), the Scottish Ministers must inform the individual to whom the determination in question relates that they have done so. In this section, references to a form include a copy of a form. For the avoidance of doubt, the form that the Scottish Ministers provide under section 44 or 45 need not be a physical form. Scottish Tribunal Rules providing for the form and manner in which an appeal under section 46 is to be brought may not displace the effect of subsection (1), but this section is otherwise without prejudice to what may be provided under any power to make Scottish Tribunal Rules. An appeal under section 46— may be brought without the First-tier Tribunal's permission if an appeal application is made within the period of 31 days beginning with the day the relevant event occurred, may be brought only with the First-tier Tribunal's permission if an appeal application is made after the period mentioned in paragraph (a), may not be brought if an appeal application has not been made within the period of one year beginning with the day the relevant event occurred (but see section 52A). In subsection (1)— “the relevant event” means— in the case of an appeal against a determination under section 43, the individual to whom the determination relates being informed of it in accordance with section 44, in the case of an appeal against a determination under section 37, the individual to whom the determination relates being informed (in accordance with section 45) that the individual has the right to appeal against it, an appeal application is made when a form, that relates to the determination in question and has been completed to the extent that Scottish Tribunal Rules require, is received by the Scottish Ministers having been submitted in accordance with section 47(1). The First-tier Tribunal may give permission under subsection (1)(b) for an appeal to be brought only if it is satisfied that there is a good reason for the application not having been made sooner. In an appeal under section 46 against a determination of an individual's entitlement to a particular type of assistance, the First-tier Tribunal may— uphold the determination, or make its own determination of the individual's entitlement to the type of assistance in question. In exercising its power under subsection (1), the First-tier Tribunal— must not take into account any circumstances which did not exist at the relevant time, but may take into account circumstances which existed but were not known at the relevant time. In this section— “the relevant time” means the time at which the individual’s entitlement fell to be determined, under the applicable regulations, by the Scottish Ministers in making the original determination under section 37 in relation to that entitlement, “the applicable regulations” means the regulations made under the section in Chapter 2 that describes the type of assistance in question. A determination of an individual's entitlement to a particular type of assistance consists of— a decision about whether or not the eligibility rules prescribed in the applicable regulations are satisfied in the individual's case, if those rules are satisfied, a decision (taken in accordance with the applicable regulations) about what assistance of the type in question the individual is entitled to be given, if the determination is to be made on the basis that the individual has ongoing entitlement to the type of assistance in question (see section 51), a decision about what assistance of the type in question the determination is to entitle the individual to be given in the future, and if the determination is of an individual's entitlement to assistance in respect of an event, a decision about whether the individual's application for assistance in respect of the event is possibly premature. If it is decided under subsection (1)(d) that an individual's application for assistance in respect of an event is possibly premature, the determination must include a statement that the individual may make another application for assistance in respect of the event. An individual's application for assistance in respect of an event is possibly premature for the purpose of subsection (1)(d) if— the decision under subsection (1)(a) is that the eligibility rules prescribed in the applicable regulations are not satisfied in the individual's case, and it is possible that circumstances may change so that, in relation to the event in question, those rules will be satisfied in the individual's case. In this section, “the applicable regulations” means the regulations made under the section in Chapter 2 that describes the type of assistance in question. The Scottish Ministers may by regulations— provide that a determination of an individual's entitlement to a specified type of assistance is to be made on the basis that the individual has ongoing entitlement to that type of assistance, and provide for exceptions to any provision made by virtue of paragraph (a). Regulations making provision by virtue of subsection (1)(a) are also to— prescribe the time, or times, at which an individual is to become entitled to be given assistance under a determination made on the basis that the individual has ongoing entitlement, ... make provision, in accordance with schedule 11, about— the circumstances in which an individual who has an entitlement to assistance in respect of a period under such a determination is not to become entitled to be given some or all of that assistance at the time at which the individual otherwise would in accordance with provision under paragraph (a), and in that event, how and when the individual is to become entitled to be given that assistance, and provide that a decision about what assistance the individual is to become entitled to be given under such a determination in respect of any future period is to be taken in accordance with the applicable regulations on the strength of such assumptions as are specified. Without prejudice to the generality of subsection (2)(b), the assumptions that may be specified include an assumption that the eligibility rules prescribed in the applicable regulations will continue to be satisfied in an individual's case for a specified duration or indefinitely. Schedule 11 makes provision about the exercise of the power conferred by subsection (2)(aa). “the applicable regulations” means the regulations made under the section in Chapter 2 that describes the type of assistance in question, “specified” means specified by regulations under this section. The Scottish Ministers may by regulations provide that, in such circumstances as the regulations specify, the Scottish Ministers are to make a determination of an individual's entitlement to a particular type of assistance without receiving an application. The Scottish Ministers may by regulations make provision about the information that is to be used, and the assumptions that are to be made, in making a determination when required to do so by regulations under subsection (1). A request for a re-determination satisfies the condition in subsection (4) of section 41, despite being made after the expiry of the period described in paragraph (b) of that subsection, if the person deciding whether the individual has a good reason for not requesting a re-determination sooner decides that the individual has a good reason that is related to coronavirus. An appeal may be brought under section 46, despite the appeal application being made after the expiry of the period described in paragraph (c) of subsection (1) of section 48, if the First-tier Tribunal gives permission for the appeal to be brought under paragraph (b) of that section on the basis of being satisfied that the good reason for the application not being made sooner is related to coronavirus. Any provision of Scottish Tribunal Rules that would (but for this subsection) have the effect of precluding an appeal being brought by virtue of subsection (2) is to be disregarded to the extent that it would have that effect. In this section, “coronavirus” has the meaning given by section 1 of the Coronavirus (Scotland) Act 2020. Subsection (2) applies where regulations under Chapter 2 make an individual's eligibility for assistance in respect of a period or event depend (in any way) on an application being made by a particular time. The person determining an individual's entitlement to the assistance may treat the individual's application as having been made by that time if satisfied that the reason for its not being made sooner is related to coronavirus. For the avoidance of doubt, regulations that make a person's age at the time of making an application material to the determination of an individual's entitlement to assistance are to be understood to make the individual's eligibility depend on the application being made by a particular time (namely the time at which the person ceases to be the specified age or fall within the specified age bracket). When— the Scottish Ministers are either— determining an individual's entitlement to assistance (whether under section 37 or 43), or considering whether regulations under section 52 require them to make a determination of an individual's entitlement to assistance without receiving an application, and they require further information in order to satisfy themselves about any matter material to the making of the determination of entitlement or (as the case may be) to their consideration of whether they are required to make a determination without receiving an application, they may request that the individual provide them with the information within such period as they specify. If— determining the individual's entitlement to a type of assistance that the individual has ongoing entitlement to, or considering whether regulations under section 52 require them to make a determination of the individual's entitlement to assistance without receiving an application, the individual fails to provide the requested information by the end of the period specified under subsection (1), and it is the first time that the individual has failed to provide the Scottish Ministers with the requested information within a specified period since they began making the determination or considering the matter mentioned in paragraph (a)(ii), the Scottish Ministers may issue a decision to suspend the assistance to the individual in accordance with regulations under section 51(2)(aa). Where the Scottish Ministers issue such a decision, they must, at the same time, request that the individual provide them with the information within such further period as they specify. If the individual fails to provide the requested information by the end of the the period specified under subsection (1) or (1B) the Scottish Ministers may, without further consideration, proceed to make the determination on the basis that the eligibility rules prescribed in the applicable regulations are not satisfied in the individual's case (see section 50). For the avoidance of doubt, the information which the Scottish Ministers may request an individual to provide under subsection (1) includes the results of an assessment, including one which the individual has not undergone at the time the request is made. The reference in subsection (1A)(a) to an individual having ongoing entitlement to a type of assistance is to an individual being entitled to be given the type of assistance in question under section 24 under a determination made on the basis that the individual has ongoing entitlement to that type of assistance. This section applies to a request for information from an individual under section 54(1) if fulfilling the request would require the individual to undergo an assessment. When making the request, the Scottish Ministers must inform the individual why they consider requiring the individual to undergo an assessment to be the only practicable way to obtain the information. If the individual would have to undergo a face-to-face assessment in order to fulfil the request, when making the request the Scottish Ministers must also inform the individual what consideration they have given to— any preference the individual has expressed to them concerning where and how assessments are carried out, whether the assessment could be carried out another way, what distance (if any) they expect the individual will have to travel in order to attend the assessment, the extent to which travelling to attend the assessment may— cause the individual distress, or adversely affect the individual's health. In subsection (3), “face-to-face assessment” means an assessment involving— the individual, and the assessor, being physically in the same place at the same time. The Scottish Ministers may place a duty to notify them about a change in circumstances on a person to whom subsection (3), (4) or (5) applies. The Scottish Ministers place a duty under subsection (1) on a person by informing the person— of the changes in circumstances which the person has a duty to notify them about, of the way in which the person is to notify them, and that failing to notify them about a change in any of those circumstances in that way may be an offence under section 72. This subsection applies to an individual who is to be given assistance under section 24 under a determination made on the basis that the individual has ongoing entitlement to the type of assistance in question. This subsection applies to a person acting on behalf of an individual to whom subsection (3) applies in relation to any application for the assistance or the determination of the individual's entitlement. This subsection applies to a person to whom payments are to be made under section 24 by way of assistance to another person under a determination made on the basis that that other person has ongoing entitlement to the type of assistance in question.

A duty to notify the Scottish Ministers about a change of circumstances placed on a person under section 56 ceases to apply when— it is lifted under subsection (2), or it stops being the case that a change in any of the circumstances to which the duty relates can affect someone's entitlement to be given assistance under section 24. The Scottish Ministers may lift a duty placed on a person under section 56 by informing the person that the duty is lifted. Under subsection (2), the Scottish Ministers may lift a duty as it relates to some or all of the changes in circumstances which the person has a duty to notify them about. The Scottish Ministers must comply with an individual's wish to have another person (“a supporter”) present during any discussion or assessment relating to the individual's entitlement to a type of assistance described in Chapter 2, unless the wish is unreasonable. The Scottish Ministers' duty under subsection (1) includes ensuring that any person acting on their behalf complies with such a wish, unless the wish is unreasonable. The role of a supporter is to support the individual in question during the discussion or (as the case may be) assessment, and includes making representations on the individual's behalf. Nothing in this section is to be read as requiring the Scottish Ministers to provide or pay for a supporter. If an individual requests it, the Scottish Ministers must give the individual a copy of any assessment report held by the Ministers that they took into account in making a determination of the individual's entitlement to assistance. Subsection (1) does not require the Scottish Ministers to provide an individual with information that they are exempt from the obligation to provide to the individual under Article 15 of the UK GDPR (whether by virtue of an enactment or otherwise). In subsection (2), “the UK GDPR” has the meaning given in section 3(10) of the Data Protection Act 2018. An individual may appeal to the First-tier Tribunal for Scotland against a decision by the Scottish Ministers— to reject something purporting to be an application for assistance (see section 38), that something purporting to be a request for a re-determination does not satisfy the condition in section 41(3), that an individual has no good reason for not requesting a re-determination sooner (see section 42). An appeal under this section— may be brought without the First-tier Tribunal's permission within the period of 31 days beginning with the day the individual was informed of the decision in accordance with this Act, may be brought only with the First-tier Tribunal's permission after the period mentioned in paragraph (a), may not be brought after the end of the period of one year beginning with the day the individual was informed of the decision in accordance with this Act. The First-tier Tribunal may give permission under subsection (2)(b) for an appeal to be made only if it is satisfied that there is a good reason for the appeal not having been made sooner. A decision by the First-tier Tribunal about— the outcome of an appeal under this section, or whether to give permission under subsection (2)(b) for an appeal to be brought, is final. Accordingly (and without prejudice to the generality of subsection (4)), any such decision by the First-tier Tribunal may be neither— reviewed under section 43 of the Tribunals (Scotland) Act 2014, nor appealed against under section 46 of that Act. Subsection (2) applies in relation to the references in sections 41, 48 and 61 to someone being informed of something by the Scottish Ministers in accordance with a provision of this Act. Where, in order to fulfil their duty to inform an individual of something, the Scottish Ministers send information— through the postal service to the last known address the Scottish Ministers have for the individual, or by email to the email address most recently provided to the Scottish Ministers by the individual for the purposes of this Act, the individual is to be taken to have received the information 48 hours after it is sent by the Scottish Ministers unless the contrary is shown. This section applies in relation to a duty of the Scottish Ministers arising from section 38(5), 40(1), 41(6), 42(2), 44(1) or 53(2) to inform a person (“the recipient”) of certain things in connection with the determination of an individual's entitlement to assistance. Nothing in the duty is to be regarded as requiring the Scottish Ministers to disclose information if subsection (3) applies to it. This subsection applies to information if— it relates to the physical or mental health of the individual, and a registered medical practitioner or a registered nurse has informed the Scottish Ministers that disclosure of the information would be likely to cause serious harm to the physical or mental health of the recipient. An individual is liable to pay the Scottish Ministers the value of any assistance that was given to the individual due to an error (but see section 64). For the avoidance of doubt, the individual's liability under subsection (1) is limited to the difference in value between— the assistance that was given, and the assistance (if any) that would have been given had the error not been made. If the assistance was given in a form other than money, its value for the purposes of this section is what giving it cost the Scottish Ministers (excluding any administration costs). In this section and section 64, references to an error are to— an error in the performance of a function conferred by virtue of this Part, including a decision under section 50(1) being made— wrongly, or correctly but on the basis of— incorrect information, or an assumption which proves to be wrong, a new decision under section 50(1) not being made after an assumption on the basis of which an earlier decision was made has proved to be wrong. An individual has no liability under section 63(1) in respect of assistance given due to an error if the error is neither— the individual's fault, nor the kind of error that an individual could reasonably be expected to notice. For the purpose of this section, an error is an individual's fault if it is caused or contributed to by the individual— providing false or misleading information, failing to notify the Scottish Ministers about a change in circumstances in breach of a duty to do so under section 56, or causing another person to do either of those things. In considering whether an error is of a kind that an individual could reasonably be expected to notice, the following are amongst the matters to which regard is to be had— the extent to which the value of the assistance given in error exceeds the value of the assistance that would have been given (if any) had the error not been made, whether any information given to the individual by the Scottish Ministers prior to, or immediately after, the assistance being given would have alerted a reasonable person to the fact that a decision had been, or was to be, made on the basis of incorrect information or a wrong assumption. In— subsection (2)(a), the reference to providing information includes making a statement, subsection (3)(b), the reference to information given to the individual by the Scottish Ministers does not include information explaining why the Ministers consider the assistance to have been given in error. This section applies to decisions of the Scottish Ministers about— whether to seek to recover money owed under section 63, and the method by which money owed under that section is to be recovered. In making a decision to which this section applies, the Scottish Ministers must have regard to the financial circumstances of the individual who owes the money (so far as those circumstances are known to the Ministers). An individual given assistance in error has no non-statutory obligation based on redress of unjustified enrichment to pay the value of that assistance to the Scottish Ministers. “non-statutory obligation” means an obligation that arises from a rule of law rather than an enactment, the reference to assistance being given in error is to be construed in accordance with section 63(4). An individual's estate is liable to pay the Scottish Ministers the value of any assistance that was given to the individual under section 24 in respect of a period after the individual's death. For the avoidance of doubt, assistance may be regarded as having been given to an individual for the purposes of this section despite being given after the individual's death. The value of funeral expense assistance given in connection with an individual's funeral is to be treated as a funeral expense that the individual's estate is liable to pay the Scottish Ministers. A person commits an offence if— the person provides, or causes another person to provide, information which is false or misleading, and the person does so with the intention of causing an individual to be given assistance under section 24 which would not otherwise be given. For the purpose of subsection (1), providing information includes making a statement. A person who commits an offence under subsection (1) is liable— on summary conviction, to— imprisonment for a term not exceeding 12 months, a fine not exceeding the statutory maximum, or both, on conviction on indictment, to— imprisonment for a term not exceeding 5 years, a fine, or both. the person fails to notify the Scottish Ministers about a change in circumstances to which subsection (2) applies as soon as reasonably practicable after it occurs, the person does not have a reasonable excuse for failing to do so, and the person knew or ought to have known that the change might result in an individual ceasing to be entitled to assistance, or becoming entitled to less assistance. For the purpose of subsection (1)(a), a change in circumstances to which this subsection applies is a change— which the person has a duty under section 56 to notify the Scottish Ministers about, and which would, under a determination of an individual's entitlement, result in the individual ceasing to be entitled to assistance, or becoming entitled to less assistance. A person is not to be regarded as having notified a change in circumstances for the purpose of subsection (1)(a) unless the person notified the Scottish Ministers about it in the way the Ministers informed the person that such notification is to be given (see section 56(2)(b)). the person causes another person to fail to notify the Scottish Ministers about a change in circumstances to which subsection (2) applies as soon as reasonably practicable after it occurs, and the person knew or ought to have known that— the change might result in an individual ceasing to be entitled to assistance, or becoming entitled to less assistance, and the other person has a duty under section 56 to notify the Scottish Ministers about the change. For the purpose of subsection (1)(a), a change in circumstances to which this subsection applies is a change which would, under a determination of an individual's entitlement, result in the individual ceasing to be entitled to assistance, or becoming entitled to less assistance. Subsection (2) applies where— an offence under this Act or any regulations made under it is committed by a relevant organisation, and the commission of the offence involves the connivance or consent of, or is attributable to the neglect of— a responsible official of the organisation, or an individual purporting to act in the capacity of a responsible official. The responsible official (or, as the case may be, the individual purporting to act in that capacity), as well as the organisation, commits the offence. “Relevant organisation” means— a company, a partnership (including a limited liability partnership), another body or association. “Responsible official” means— in the case of a company— a director, secretary, manager or similar officer, or where the affairs of the company are managed by its members, a member, in the case of a limited liability partnership, a member, in the case of a partnership other than a limited liability partnership, a partner, in the case of another body or association, a person who is concerned in the management or control of its affairs. The Scottish Ministers may by regulations provide for financial assistance to be given to an individual who— is entitled to a reserved benefit, and appears to the Scottish Ministers to require financial assistance (in addition to any amount the individual receives by way of reserved benefit) for the purpose, or one of the purposes, for which the benefit is being provided. The power conferred by subsection (1) includes the power to make provision about— determining entitlement (including specifying further eligibility rules that are to be used to determine whether an individual is entitled to the assistance), the amount of assistance, applications for assistance, obtaining information, appeals, assistance given in error, offences. In this section and section 80, “reserved benefit” means a benefit which is to any extent a reserved matter within the meaning of schedule 5 of the Scotland Act 1998. Regulations under section 79 may not provide for financial assistance to be given to meet or help to meet housing costs. Regulations under section 79 may not provide for financial assistance to be given where the need for the assistance arises solely from reduction, non-payability or suspension of a reserved benefit as a result of an individual's conduct (for example, non-compliance with work-related requirements relating to the benefit). But subsection (2) does not prevent assistance from being given where the need for the assistance in question— also arises from some exceptional event or exceptional circumstances, and is immediate. The maximum penalty that may be provided for in regulations under section 79 in respect of an offence under those regulations is— on summary conviction— on conviction on indictment— Sections 71 to 73 (which establish offences) apply in connection with financial assistance given by virtue of top-up assistance regulations as they apply in connection with assistance given under section 24. But subsection (1) is subject to any contrary provision in top-up assistance regulations. Where they apply by virtue of subsection (1), sections 71 to 73 apply subject to the following modifications— a reference to assistance is to be read as a reference to financial assistance provided for by top-up assistance regulations, a reference to giving notice in accordance with section 56 is to be read as a reference to giving notice in accordance with top-up assistance regulations, sections 72(3) and 73(3) do not apply unless, in accordance with top-up assistance regulations, the Scottish Ministers have informed the person in question about the way in which notification of a change of circumstances is to be given. For the avoidance of doubt, the reference in section 74 to an offence under this Act or any regulations made under it includes— an offence under any of sections 71 to 73 as applied by virtue of subsection (1), an offence under top-up assistance regulations. In this section, “top-up assistance regulations” means regulations under section 79. The Scottish Ministers must make a payment (a “carer's allowance supplement”) to qualifying individuals in respect of each of the following periods of each financial year— 1 April to 30 September, and 1 October to 31 March. A qualifying individual is an individual to whom subsection (2) or (2A) applies. This subsection applies to an individual who, on the qualifying date, was— in receipt of a carer’s allowance under section 70 of the Social Security Contributions and Benefits Act 1992 by virtue of article 4 (transitional provision) of the Regulatory Reform (Carer’s Allowance) Order 2002, and resident in Scotland. This subsection applies to an individual whom the Scottish Ministers have determined in accordance with Part 2 of the Carer’s Allowance Supplement and Young Carers Grants (Residence Requirements and Procedural Provisions) (EU Exit) (Scotland) Regulations 2020 (S.S.I. 2020/475)— met the eligibility conditions in subsection (9) on the qualifying date (where the qualifying date is before IP completion day), met the eligibility conditions in subsection (11) on the qualifying date (where the qualifying date is after IP completion day and the individual has rights arising from a relevant EU regulation), or met the eligibility conditions in subsection (13) on the qualifying date (where the qualifying date is after IP completion day and the individual has rights arising from the UK-Ireland convention mentioned in that subsection). The qualifying date is a date determined by the Scottish Ministers falling within the period to which the payment relates. The amount of a carer's allowance supplement is to be calculated according to the following formula (but see also subsection (4B)) — where— JSA is whichever is the higher of— the weekly amount specified in regulation 79(1)(c) of the Jobseeker's Allowance Regulations 1996 (S.I. 1996/207) as it has effect on the qualifying date, and that amount as it would have effect on the qualifying date if it were adjusted for inflation in accordance with subsection (5), and CA is the weekly rate of carer's allowance specified in Part 3 of schedule 4 of the Social Security Contributions and Benefits Act 1992 as it has effect in Scotland on the qualifying date. The amount of a carer’s allowance supplement in respect of the period of 1 October 2021 to 31 March 2022 is £231.40 greater than that calculated according to the formula in subsection (4). The Scottish Ministers must, before the start of each new tax year, beginning with the first new tax year beginning after this section comes into force— calculate what the weekly amount specified in regulation 79(1)(c) of the Jobseeker's Allowance Regulations 1996 (“the JSA Regulations”) would be if it were adjusted for inflation, publish a statement explaining how they have calculated inflation for this purpose. In calculating the amount for the purpose of subsection (5)(a), the Scottish Ministers may take account of any change in the weekly amount specified in regulation 79(1)(c) of the JSA Regulations since this section came into force. For the purposes of subsection (5), a tax year means a period beginning with 6 April in one year and ending with 5 April in the next. The Scottish Ministers may by regulations modify this section so as to modify who is a qualifying individual for the purposes of this section. An individual met the eligibility conditions referred to in subsection (2A)(a) on a given date if, on that date, the individual— was in receipt of— a carer’s allowance under section 70 of the Social Security Contributions and Benefits Act 1992, ... was an individual— to whom a relevant EU Regulation applied, and in respect of whom the United Kingdom was competent for payment of sickness benefits in cash for the purposes of Chapter 1 of Title III of the Regulation in question, was resident in— Switzerland, or an EEA State other than the United Kingdom, and had a genuine and sufficient link to Scotland. The reference in subsection (9)(d) to an individual’s link to Scotland being sufficient is to it being sufficiently close that if the individual were not entitled to the carer’s allowance supplement this section— would be incompatible with EU law, or would have been incompatible with EU law immediately before IP completion day. An individual met the eligibility conditions referred to in subsection (2A)(b) on a given date if, on that date, the individual— to whom the rules set out in a relevant EU regulation applied by virtue of— Title III of Part 2 of the EU withdrawal agreement, Part 3 or Article 23(4) of the Swiss citizens’ rights agreement (as defined in section 39(1) of the European Union (Withdrawal Agreement) Act 2020), Title III of the EEA EFTA separation agreement (as defined in that section), ... the agreement constituted by the exchange of letters set out in the schedule of the Family Allowances, National Insurance and Industrial Injuries (Gibraltar) Order 1974 (S.I. 1974/555) between the United Kingdom and Gibraltar, or the agreement constituted by the exchange of letters set out in the schedule of the Social Security (Gibraltar) Order 2024 (S.I. 2024/149) between the United Kingdom and Gibraltar, and in respect of whom the United Kingdom is, as a result, competent for payment of sickness benefits in cash, Switzerland, an EEA State, or Gibraltar, and The reference in paragraph (d) of subsection (11) to an individual’s link to Scotland being sufficient is to it being sufficiently close that if the individual were not entitled to the carer’s allowance supplement this section would be incompatible with the applicable agreement mentioned in paragraph (b)(i) of that subsection. An individual met the eligibility conditions referred to in subsection (2A)(c) on a given date if, on that date, the individual— to whom the convention on social security between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of Ireland signed at Dublin on 1 February 2019, as modified from time to time in accordance with any provision of it, applied, and in respect of whom the United Kingdom is, as a result, competent for payment of long term care benefits, was resident in Ireland, and The reference in paragraph (d) of subsection (13) to an individual’s link to Scotland being sufficient is to it being sufficiently close that if the individual were not entitled to the carer’s allowance supplement, this section would be incompatible with the convention mentioned in paragraph (b) of that subsection. “EEA State” means— a member State of the European Union, or any other State that is a party to the agreement on the European Economic Area signed at Oporto on 2 May 1992, together with the Protocol adjusting that Agreement signed at Brussels on 17 March 1993, as modified or supplemented from time to time, “EU law” has the meaning given by subsection (9) of section 126 of the Scotland Act 1998, or if that subsection has been repealed, the meaning given by that subsection immediately before its repeal, “relevant EU Regulation” means— one of the following Regulations— Council Regulation (EC) No 1408/71 of 14 June 1971 on the application of social security schemes to employed persons, to self-employed persons and to members of their families moving within the Community, Regulation (EC) No 883/2004 of the European Parliament and of the Council of 29April2004 on the coordination of social security systems, or in relation to an individual to whom the exchange of letters mentioned in subsection (11)(b)(i)(D) or subsection (11)(b)(i)(E) applies, a Regulation mentioned in paragraph (a) as it forms part of domestic law by virtue of section 3 of the European Union (Withdrawal) Act 2018. repeal section 81 and revoke any regulations made under it, and repeal this section. Any assignation of or charge on, or agreement to assign or charge, an individual's entitlement to assistance under or by virtue of this Act is void. Nothing in subsection (1) prevents the Scottish Ministers from giving the assistance to which an individual is entitled to another person if the individual (or a person acting on the individual's behalf) has agreed to that. An individual's entitlement to assistance under or by virtue of this Act does not transfer to another person— on the individual's sequestration, or on the appointment of a judicial factor on the individual's estate under section 41 of the Solicitors (Scotland) Act 1980. The Scottish Ministers may by regulations make provision about the investigation of offences under this Act or regulations under section 79. Regulations under subsection (1) may, in particular— confer powers to— enter and search premises (other than dwelling-houses), and seize anything relevant to the investigation which is found on the premises, create offences relating to— a failure to provide information requested for the purposes of an investigation, obstruction of the conduct of an investigation, any breach of the regulations, make provision about the time limit for bringing proceedings. The maximum penalty that may be provided for in regulations under subsection (1) is, on summary conviction, a fine not exceeding level 3 on the standard scale. The Scottish Ministers must publish a code of practice on investigations carried out by virtue of section 84A. The Scottish Ministers— must keep the code of practice under review, may from time to time revise the code of practice. Before publishing the code of practice, the Scottish Ministers must consult publicly on a draft of the code. The Scottish Ministers must, as soon as practicable after publication, lay before the Scottish Parliament a copy of the code of practice. A court or tribunal in civil or criminal proceedings must take the code of practice into account when determining any question to which the code is relevant. Breach of the code of practice does not of itself give rise to grounds for any legal action. Subsections (2) to (6) apply in relation to a revised code of practice as they apply in relation to the first published code of practice. Subsection (2) applies if, in the course of their making a determination of an individual's entitlement to assistance under Part 2 or (as the case may be) regulations under section 79, it appears to the Scottish Ministers that the individual may be eligible for other assistance. inform the individual that the individual may be eligible for the other assistance, and either— provide the individual with information about how to apply for it, or if regulations under section 52 , or (as the case may be) section 79 so allow, ask the individual whether they should proceed with making a determination of the individual's entitlement to the other assistance without receiving an application. Subsection (2)(b)(ii) does not preclude the Scottish Ministers from requesting further information under section 54(1) , or (as the case may be) regulations under section 79 for the purpose of determining the individual's entitlement to the other assistance. In this section, “other assistance” means— where the determination mentioned in subsection (1) relates to an individual's entitlement to assistance under Part 2— a different type of assistance described in Chapter 2 of that Part from the type of assistance that the determination mentioned in subsection (1) relates to, the same type of assistance as that determination relates to, but in respect of a different period or (as the case may be) event, or assistance under regulations under section 79, where the determination mentioned in subsection (1) relates to an individual's entitlement to assistance under regulations under section 79— a different type of assistance described in regulations under section 79 from the type of assistance that the determination mentioned in subsection (1) relates to, a type of assistance described in Chapter 2 of Part 2. The Scottish Ministers may require a person mentioned in subsection (2) to supply information held by the person to the Ministers for the purpose of a social security function. The persons are— a local authority, a Health Board constituted under section 2(1)(a) of the National Health Service (Scotland) Act 1978 or a Special Health Board constituted under section 2(1)(b) of that Act, an integration joint board established by order under section 9 of the Public Bodies (Joint Working) (Scotland) Act 2014, the Registrar General for Scotland, the Keeper of the Records of Scotland, the Scottish Courts and Tribunals Service, a person specified in regulations made by the Scottish Ministers. Where information is supplied to the Scottish Ministers under subsection (1) for use for any purpose, they may use it for any other purposes for which information held by them for that purpose may be used. In subsection (1), references to information held by a person include information held by another person providing services to the person. Information held by the Scottish Ministers for the purpose of a social security function may be supplied by the Ministers to a person mentioned in subsection (2) for use for the purposes of such function of the person as is specified in regulations made by the Ministers. Where information is supplied to a person under subsection (5) for use for any purpose, the person may use it for any other purposes for which information held by the person for that purpose may be used. In subsection (5), references to information held by the Scottish Ministers include information held by a person providing services to them. Information supplied under subsection (5) must not be supplied by the recipient of the information to any other person without the authority of the Scottish Ministers. This section does not permit or require the provision of information in breach of a prohibition or restriction on the disclosure of information arising by virtue of an enactment or rule of law. In this section, “social security function” means a function of the Scottish Ministers under or by virtue of this Act. The Scottish Ministers may appoint a person (an “appointee”) to act on behalf of a child in connection with the determination of the child's entitlement to assistance under section 24 or regulations under section 79. An appointment under subsection (1) may, if the Scottish Ministers consider it appropriate, include an appointment of the person to receive such assistance on the child's behalf. The Scottish Ministers may only appoint an appointee if it appears to them that there is no person who— has authority to act on behalf of the child, resides with, and has care of, the child, and is willing, and practicably able, to act on the child's behalf in relation to the matter mentioned in subsection (1). An individual who is under 16 years may not be appointed as an appointee. Where an appointee is appointed under subsection (1) to act on behalf of a child— the appointee can do anything that a person with authority (however arising) to act on behalf of the child in relation to the determination of the child's entitlement to assistance could do in connection with the determination of the child's entitlement to assistance (including making an application for assistance), the Scottish Ministers may request that the appointee provide them with information that the Ministers may otherwise request under section 54 or (as the case may be) the regulations under section 79 (and in the case of section 54, subsections (2) and (3) of that section apply to that request as they apply to a request made to the child), any information that would be given to the child under or by virtue of Part 2 or (as the case may be) the regulations, must be given to the appointee instead. The Scottish Ministers must consider whether to make an appointment under subsection (1), or to terminate such an appointment, if requested to do so by— the child, or anyone else who appears to the Ministers to— have authority to act on behalf of the child, reside with, and have care of, the child, or have an interest in the welfare or financial affairs of the child. Subsection (5C) applies where the Scottish Ministers are deciding whether to make or terminate an appointment under subsection (1). In making the decision the Scottish Ministers must, insofar as practicable, have regard to the views of— the child, anyone who is a relevant person in relation to the child within the meaning of section 200 of the Children's Hearings (Scotland) Act 2011, and anyone else who appears to the Ministers to have an interest in the welfare or financial affairs of the child. The Scottish Ministers may terminate an appointment under subsection (1) at any time. In this section, “child” means an individual who is under 16 years. The Scottish Ministers may appoint a person (an “appointee”) to act on behalf of an individual in connection with the determination of the individual's entitlement to assistance under section 24 or regulations under section 79. An appointment under subsection (1) may, if the Scottish Ministers consider it appropriate, include an appointment of the person to receive such assistance on the individual's behalf. The Scottish Ministers may only appoint an appointee if— the individual is 16 years or over and the conditions in subsection (4) are met, or it appears to them that subsection (6) or (7) applies. The conditions are— the individual indicates (in such form as the Scottish Ministers require) that the individual agrees to the appointment, and an appropriate person certifies (in such form as the Scottish Ministers require) that in the person's opinion— the individual is not incapable within the meaning of the Adults with Incapacity (Scotland) Act 2000, the individual understands the effect of the appointment, the individual has not been subject to any undue influence in agreeing to the appointment, and the person proposed to be appointed is suitable to act as the individual's appointee. The Scottish Ministers are to make regulations defining “appropriate person” for the purposes of subsection (4)(b). This subsection applies if— the individual is deceased, and there is no executor appointed on the individual's estate. This subsection applies if, in relation to the matter mentioned in subsection (1)— the individual is incapable within the meaning of the Adults with Incapacity (Scotland) Act 2000, there is no guardian acting or appointed under that Act, the individual's estate is not being administered by a judicial factor, and there is no other person who has authority to act on behalf of the individual and is willing to do so. Where an appointee is appointed under subsection (1) to act on behalf of an individual— the appointee can do anything that a relevant individual could do in connection with the determination of the individual's entitlement to assistance (including making an application for assistance), the Scottish Ministers may request that the appointee provide them with information that the Ministers may otherwise request under section 54 or (as the case may be) the regulations under section 79 (and in the case of section 54, subsections (2) and (3) of that section apply to that request as they apply to a request made to the individual), any information that would be given to the individual under or by virtue of Part 2 or (as the case may be) the regulations, must be given to the appointee instead. In subsection (9)(a), “relevant individual” means— in the case of an appointment by virtue of subsection (3)(a), the individual in relation to whom the appointment is made, in the case of an appointment by virtue of subsection (6), an executor appointed on the individual's estate, in the case of an appointment by virtue of subsection (7), a person with authority (however arising) to act on behalf of the individual in relation to the determination of the individual's entitlement to assistance. terminate an appointment made by virtue of subsection (3)(a) if the individual withdraws agreement to it, consider whether to terminate an appointment made by virtue of subsection (3)(a) if requested to do so by anyone who appears to the Ministers to have an interest in the welfare or financial affairs of the individual. The Scottish Ministers must consider whether to terminate an appointment made by virtue of subsection (6) if requested to do so by anyone who appears to the Ministers to have an interest in the financial affairs of the individual. The Scottish Ministers must consider whether to make an appointment by virtue of subsection (7), or to terminate such an appointment, if requested to do so by— the individual, or have authority to act on behalf of the individual, or have an interest in the welfare or financial affairs of the individual. Subsection (16) applies where the Scottish Ministers are deciding whether to make an appointment by virtue of subsection (7) or to terminate such an appointment. In making the decision, the Scottish Ministers must, insofar as practicable, have regard to— the wishes and feelings of the individual, and the views of anyone else who appears to the Ministers to have an interest in the welfare or financial affairs of the individual. must prepare guidelines governing their decisions in connection with appointments under sections 85A and 85B, may revise the guidelines, must make the latest version of the guidelines publicly available by such means as they consider appropriate. The guidelines must, in particular, set out— the steps that the Scottish Ministers will take to determine that a person is suitable for appointment, how a request that an appointment be made or terminated may be made and how it will be handled, the process by which persons with an interest in the making or termination of an appointment will be involved in those decisions, the steps that the Scottish Ministers will take to review appointments periodically (being in any case no more than 5 years) and the process by which that will occur, how concerns about the acts, or omissions, of an appointee may be raised and how any concerns raised will be handled. In preparing or revising the guidelines, the Scottish Ministers must have regard (among other things) to the following considerations— that an appointment in the case of a living individual should be made only if it appears to secure a benefit in respect of the individual that cannot reasonably be achieved without the appointment, that such an appointment should last for only so long as it continues to secure that benefit, that, so far as reasonably practicable, before decisions are made— persons who may be affected are consulted, and due account is taken of their views (or, if they are incapable within the meaning of the Adults with Incapacity (Scotland) Act 2000, their wishes and feelings), that decisions should be made on the basis of good information, that decision-making processes should, so far as reasonably practicable, take account of the circumstances of individual cases, that persons who may be affected by decisions are given adequate information and support in relation to their involvement in the decision-making process. In preparing or revising the guidelines, the Scottish Ministers must consult— the Commissioner for Children and Young People in Scotland, the Mental Welfare Commission for Scotland, the Public Guardian (established by section 6 of the Adults with Incapacity (Scotland) Act 2000), and local authorities. A person appointed under section 85A or 85B must have regard to any guidance issued by the Scottish Ministers about the way in which the role of appointee should be carried out. The Scottish Ministers must make guidance issued for the purpose of subsection (1) publicly available. The Scottish Ministers may by regulations provide for the functions conferred on them by virtue of Part 2 to be exercised on their behalf by local authorities, but only in relation to― housing assistance, and short-term assistance that an individual is eligible to be given on account of the individual's entitlement to housing assistance being under review within the meaning of paragraph 1(1)(c) of schedule 10. Regulations under this section may in particular— specify the functions that local authorities are to exercise on the Scottish Ministers' behalf, make provision identifying the persons in relation to whom a local authority is to exercise those functions, and provide for any enactment (including this Act) to apply subject to such modifications as the Ministers consider appropriate in consequence of functions falling to be exercised by a local authority on the Ministers' behalf. Regulations under this section do not affect the Scottish Ministers' responsibility for the exercise of their functions. In subsection (1), “functions” does not include regulation-making functions. Before the end of each financial year, the Scottish Ministers must— calculate the inflation-adjusted level of each relevant figure, prepare a report that complies with subsection (2), lay a copy of the report before the Scottish Parliament, and make the report publicly available by such means as the Ministers consider appropriate. A report prepared under subsection (1)(b) complies with this subsection if it— states what the Scottish Ministers have most recently calculated to be the inflation-adjusted level of each relevant figure, explains how the Ministers calculated the inflation-adjusted levels, and states what (if anything) the Ministers have done, or intend to do, in light of their calculations and their reasons for that decision. In this section, “relevant figure” means― a figure prescribed as the value, or part of the value, of the assistance that is to be given to an individual in regulations under— any section in Chapter 2 of Part 2, ... section 79, or section 93A, but not a figure which is so prescribed to apply only in respect of periods that have ended, or events that occurred, before a particular date. The inflation-adjusted level of a figure prescribed in regulations is to be calculated for the purposes of this Chapter as follows— f is the figure prescribed, and i is the number of percentage points which the Scottish Ministers consider reflects the change in the general level of relevant prices since a copy of a report was last laid before the Scottish Parliament under subsection (1)(c). It is for the Scottish Ministers to decide what prices are “relevant prices” in terms of subsection (4). Before the end of each financial year, having calculated in accordance with section 86A the inflation-adjusted level of each relevant figure ...the Scottish Ministers must bring forward legislation to replace any relevant figure ... which is, in their opinion, materially below its inflation-adjusted level with a figure of at least that level (subject to any rounding they think appropriate). The reference in subsection (1) to bringing forward legislation to replace a figure is a reference to laying before the Scottish Parliament for approval by resolution a draft Scottish statutory instrument containing regulations that would have the effect of replacing the figure. If the Scottish Parliament approves a draft instrument laid before it by the Scottish Ministers in fulfilment of their duty under subsection (1), the Ministers must make the regulations contained in the draft instrument. In this section ... “relevant figure” is to be construed in accordance with section 86A(3). a report on the number of individuals who obtained the right to appeal to the First-tier Tribunal under section 46 and the number of individuals who exercised that right. The first report under this section must include a plan setting out how the Scottish Ministers intend to collect this data. In reporting to the Scottish Parliament under subsection (1), the Scottish Ministers must indicate whether, in the opinion of the Ministers, amendment of the process for determining entitlement under this Act is appropriate. The Scottish Ministers may by regulations transfer to the First-tier Tribunal for Scotland some or all of the competence and jurisdiction that a sheriff has in relation to the recovery of— money owed under section 63, or money owed under regulations under Part 3. Before laying a draft Scottish statutory instrument containing regulations under subsection (1) before the Scottish Parliament for approval by resolution, the Scottish Ministers must consult— the Lord President of the Court of Session, the President of the Scottish Tribunals, sheriffs principal. exercise the power conferred by subsection (1) at least once, before 1 April 2021, consult the persons mentioned in subsection (2) about making regulations under subsection (1). The Scottish Ministers may request an individual who is entitled to assistance by virtue of this Act to provide, within such period as Ministers specify in the request, information about— the individual’s entitlement to assistance, and the payment of assistance to the individual. A request under subsection (1) may only be made for the purposes of— auditing the monetary value of error and fraud in the Scottish social security system, and carrying out corrections of apparent errors and investigations into potential fraud (and other activities connected to auditing). Information received in response to a request under subsection (1) may only be used for the purposes mentioned in subsection (2). The Scottish Ministers may require the response to a request under subsection (1) to take the form of— an interview in person, a telephone call or a video call, in circumstances prescribed by the Scottish Ministers in regulations, a written response, or such other form of response prescribed by the Scottish Ministers in regulations. The Scottish Ministers may by regulations prescribe categories of individuals who are not to be requested to provide information under subsection (1). Before making regulations under subsection (5), the Scottish Ministers must consult publicly on the categories of individuals who are not to be requested to provide information under subsection (1). If an individual fails to provide the requested information by the end of the period specified in the request under subsection (1), the Scottish Ministers may issue a decision to suspend the assistance to the individual in accordance with regulations under section 51(2)(aa). Where the Scottish Ministers issue a decision to suspend the assistance to the individual under subsection (7) they must, at the same time, make a further request under subsection (1) that the individual provide them with the information within such further period as they specify. Subsections (7) and (8) may apply more than once in respect of the same individual. An individual who has received a request for information under section 87B(1) may, before the end of the period prescribed by the Scottish Ministers in regulations, ask the Scottish Ministers to withdraw the request. The Scottish Ministers may only withdraw the request for information if the individual has a good reason for it to be withdrawn. It is for the Scottish Ministers to decide whether, for the purpose of subsection (2), an individual has a good reason for the request to be withdrawn. The Scottish Ministers must make a decision under subsection (3) before the end of the period prescribed by the Scottish Ministers in regulations. Regulations under subsection (4) may also make provision about cases where the Scottish Ministers fail to make a decision under subsection (3) within the period prescribed in the regulations. The Scottish Ministers’ decision under subsection (3) is final. Having made a decision under subsection (3), the Scottish Ministers must inform the individual concerned— of the decision, that the decision is final, and if the decision is that there is a good reason for withdrawal, that the request for information is withdrawn. The Scottish Ministers must fulfil their duty under subsection (7) in a way that leaves the individual with a record of the information which the individual can show to, or otherwise share with, others. Where the Scottish Ministers decide under subsection (3) that an individual has a good reason for withdrawal, they must withdraw the request for information. The Scottish Ministers must comply with an individual’s wish to have another person (“a supporter”) present during any interview, telephone call, video call, drafting of a written response or any other form of provision of a response relating to a request to provide information under section 87B(1), unless the wish is unreasonable. The Scottish Ministers’ duty under subsection (1) includes ensuring that any person acting on their behalf complies with such a wish, unless the wish is unreasonable.

The role of a supporter is to support the individual during the interview, telephone call, video call, drafting of a written response or (as the case may be) other form of provision of a response, and includes making representations on the individual's behalf. Every individual to whom subsection (3) applies has a right of access to independent advocacy in connection with the individual’s engagement with the process for a request for information under section 87B(1). This subsection applies to an individual if, owing to a disability, the individual requires an advocate’s help to engage effectively with the process for a request for information under section 87B(1). “advocacy services” means services of support and representation that are made available for the purpose of enabling an individual to whom they are provided to have as much control of, or capacity to influence, the individual’s engagement with the process of a request for information under section 87B(1) as is, in the circumstances, appropriate, A local authority has power to give financial assistance to a qualifying individual to meet, or help towards meeting, the individual's housing costs. In subsection (1), “qualifying individual” means an individual who— is entitled to— housing benefit, or an award of universal credit which includes an amount for rent, and appears to the authority to need financial assistance under subsection (1) (in addition to any assistance of a kind mentioned in paragraph (a) which the individual receives) in order to meet housing costs. For the purposes of subsection (2)(a)— “housing benefit” means housing benefit provided by virtue of a scheme under section 123 of the Social Security Contributions and Benefits Act 1992, an award of universal credit includes an amount for rent if— the calculation of the award includes an amount under section 11 of the Welfare Reform Act 2012, and that amount is included (wholly or partly) in respect of a liability to make payments within the meaning of paragraph 2 of schedule 1 of the Universal Credit Regulations 2013 (S.I. 2013/376). Financial assistance under this section may be given to an individual by way of— payment to the individual, payment to another person to meet, or contribute towards meeting, any liability the individual has to that person, deduction from any liability the individual has to the authority giving the assistance which is connected to housing costs, any combination of the ways mentioned in the preceding paragraphs. Financial assistance may not be given under section 88 by way of a loan. Financial assistance may not be given under section 88 where the need for the assistance arises solely from reduction, non-payability or suspension of a reserved benefit as a result of an individual's conduct (for example, non-compliance with work-related requirements relating to the benefit). In subsection (2), “reserved benefit” means a benefit which is to any extent a reserved matter within the meaning of schedule 5 of the Scotland Act 1998. Each local authority must make available to the public resident in its area information about— how to apply to the authority for financial assistance under section 88, which housing costs the authority gives assistance in relation to, the rules the authority applies in deciding— whether to give someone assistance, the amount of assistance to give, and what period to give assistance for, how to apply for a review challenging a decision by the authority— to refuse to give assistance, as to the amount of assistance it will give, or as to the period for which it will give assistance. Local authorities must have regard to any guidance issued by the Scottish Ministers in connection with the exercise of the power conferred by section 88. Guidance under subsection (1) may, in particular, deal with— the rules which authorities are to apply in deciding— whether to give someone financial assistance, the form of applications for— assistance, and review of authorities' decisions about the giving of assistance, the processes which authorities are to follow in— determining applications for assistance and review, and deciding whether to stop giving someone assistance, the circumstances in which authorities should, and should not, seek to recover the value of assistance given in error or following a breach of any of the conditions under which it was given. Guidance under subsection (1) may be addressed to— an authority, or more than one authority, identified in the guidance, or all authorities. Before issuing guidance under subsection (1), the Scottish Ministers must consult such body representing authorities as the Ministers think fit. As soon as reasonably practicable after issuing guidance under subsection (1), the Scottish Ministers must lay a copy of the guidance before the Scottish Parliament. The Scottish Ministers must make guidance issued under subsection (1) publicly available. The power to issue guidance under subsection (1) includes the power to— issue guidance which varies guidance issued under that subsection, and revoke guidance issued under that subsection. The Scottish Ministers may make grants to local authorities to fund the giving of financial assistance under section 88. Monies granted to an authority under subsection (1) may be spent only on giving financial assistance under section 88. If an authority has spent all monies granted to it under subsection (1), the authority may refuse to consider any application for financial assistance under section 88. If, by virtue of subsection (3), an authority is refusing to consider applications, it need not comply with section 90. For the avoidance of doubt, subsection (3) does not prevent an authority from considering applications or giving financial assistance under section 88 should it choose to. The Scottish Ministers may by regulations make whatever amendment to section 88 they think appropriate in consequence of— an enactment mentioned in that section being amended, repealed or revoked, or the creation of a reserved benefit payable in respect of a liability to make rent payments. Expressions used in subsection (1)(b) have the same meaning as they have for the purposes of exception 6 in Section F1 of Part 2 of schedule 5 of the Scotland Act 1998. The Scottish Ministers may by regulations establish one or more schemes to give financial assistance to individuals who have had experience of being in the care system. In this Act, assistance given by virtue of subsection (1) is known as “care experience assistance”. who is to give the assistance, determining entitlement to the assistance (including specifying further eligibility rules that are to be used to determine whether an individual is entitled to the assistance), the making of payments to entitled individuals or their representatives, reviews, re-determinations and appeals, the recovery of assistance given in error, offences, applying the provisions of this Act to schemes established by virtue of subsection (1) subject to such modifications as the Scottish Ministers consider appropriate. The maximum penalty that may be provided for in care experience assistance regulations in respect of an offence under those regulations is— Sections 71 to 73 (which establish offences) apply in connection with care experience assistance as they apply in connection with assistance given under section 24. But subsection (5) is subject to any contrary provision in the care experience assistance regulations. Where they apply by virtue of subsection (5), sections 71 to 73 apply subject to the following modifications— a reference to assistance is to be read as a reference to care experience assistance, a reference to giving notice in accordance with section 56 is to be read as a reference to giving notice in accordance with the care experience assistance regulations, sections 72(3) and 73(3) do not apply unless, in accordance with the care experience assistance regulations, the Scottish Ministers have informed the person in question about the way in which notification of a change of circumstances is to be given. an offence under any of sections 71 to 73 as applied by virtue of subsection (5), an offence under the care experience assistance regulations. may give directions in relation to the giving of assistance under schemes established by virtue of subsection (1) to the persons responsible for giving it (which those persons must comply with), and must make publicly available any directions they give under paragraph (a). Before laying a draft of a Scottish statutory instrument containing care experience assistance regulations before the Scottish Parliament for approval by resolution, the Scottish Ministers must consult— such persons as they consider representative of individuals who have had experience of being in the care system, and such other persons as they consider appropriate. For the purpose of subsection (10), it is immaterial that anything done by way of consultation was done before section 2(2) of the Social Security (Amendment) (Scotland) Act 2025 comes into force. In this section, “care experience assistance regulations” means regulations under subsection (1). The Scottish Ministers must bring forward regulations under section 30 of the Scotland Act 2016 to give effect to the proposal described in subsection (3). In subsection (1), “bring forward” means— consult the Secretary of State about the practicability of implementing the regulations in accordance with section 30(3) of the Scotland Act 2016, and lay regulations before the Scottish Parliament. The regulations must give effect to the proposal that, despite regulation 47(4) to (6) of the 2013 Claims and Payments Regulations (payment of universal credit to joint claimants), universal credit payable in respect of Scottish joint claimants is to be split between the couple in such proportion as the Scottish Ministers consider appropriate unless the Scottish joint claimants elect to nominate a single bank or other account into which that benefit is to be paid. For the avoidance of doubt, the regulations under subsection (1) must give effect only to the proposal described in subsection (3). The Scottish Ministers may by regulations repeal this section and revoke any regulations made under it. “the 2013 Claims and Payments Regulations” means the Universal Credit, Personal Independence Payment, Jobseeker's Allowance and Employment and Support Allowance (Claims and Payments) Regulations 2013 (S.I. 2013/380), “couple” has the meaning given by section 39 of the Welfare Reform Act 2012, “Scottish joint claimants” means a couple living in Scotland who jointly make a claim for, or have been awarded, universal credit. The Scottish Ministers may by regulations make any incidental, supplementary, consequential, transitional, transitory or saving provision they consider appropriate for the purposes of, or in connection with, or for giving full effect to this Act or any provision made under it. A power to make regulations conferred by this Act includes the power to make different provision for different purposes and areas. Regulations under any of the following provisions are subject to the affirmative procedure: sections 11(2), 13(3), 22(1)(e), any section in Chapter 2 of Part 2, sections 51(1), 52(1), 52(2), 63(12), 79(1), 81(8), 82, 84A(1), 85(2)(g), 85(5), 85F(1), 86(1), 87A(1), 87B(5), 93(1), 93A(1), 94A(3), 94A(5), 94B(2), 94H(4), 94M(5), 94Q(9), 94T(1), 94U(1), 94V(1), 94W(1), 97(12), paragraph 4(2)(c) of schedule 1 and paragraph 3 of schedule 12. Regulations under any of the following provisions are subject to the negative procedure: sections 41(4)(a) , 43(5), 49C(1), 69A(4)(a), 69C(6), 85B(5), 87B(4)(c), 87B(4)(d), 87C(1), 87C(4), 94C(4), 94C(8), 94C(9), 94N(7) and 94P(9) and paragraph 13(2) of schedule 1. Regulations under section 95— are subject to the affirmative procedure if they add to, replace or omit any part of the text of an Act (including this Act), but otherwise are subject to the negative procedure. Regulations under section 22(1)(e), which modify the functions of the Scottish Commission on Social Security, may not be made after the Commission is established unless the Scottish Ministers have consulted the Commission about the modification. This section applies (subject to subsection (11)) in relation to regulations under— section 11(2), section 13(3), any section in Chapter 2 of Part 2, section 41(4)(a), section 43(5), section 51(1), section 52, section 63(12), section 69A(4)(a), section 69C(6), section 79(1), section 81(8), section 82, section 84A(1), section 85B(5), section 85F(1), section 87B(4)(c), section 87B(4)(d), section 87B(5), section 87C(1), section 87C(4), section 93A(1), and section 95, where the power to make regulations conferred by that section is exercised together with any of the powers to make regulations listed in paragraphs (a) to (v). This section applies (subject to subsection (11)) in relation to regulations made under section 13(1) of the Social Security Act 1988 and section 175(4) of the Social Security Contributions and Benefits Act 1992, where the powers to make regulations conferred by those sections are exercised together. Before the Scottish Ministers finalise regulations to which this section applies, they must ...— inform the Scottish Commission on Social Security of their proposals, notify the Scottish Parliament that they have done so, and make their proposals publicly available by such means as the Ministers consider appropriate. For the purposes of subsection (2), proposals must take the form of draft regulations. Having been informed of the Scottish Ministers' proposals, the Commission must prepare a report setting out its observations and recommendations in relation to the proposals. The Scottish Ministers must ensure that the Commission has such time to prepare the report as the Commission deems appropriate. In preparing its report, the Commission— must have regard to— the Scottish social security principles, and any relevant international human rights instruments (as defined in section 22(5)), and may consult any persons it considers appropriate. If the Commission's members are unable to agree the terms of its report unanimously, the report must set out the matters over which members differ. Having prepared its report, the Commission must— submit a copy of the report to— the Scottish Ministers, and the Scottish Parliament, and make the report publicly available by such means as the Commission considers appropriate. When the Scottish Ministers finalise regulations to which this section applies, they must also lay before the Parliament either— a response to the Commission's report on the proposals for the regulations, or a statement explaining why the Ministers consider it appropriate to finalise the regulations before the Commission has submitted its report on the proposals for the regulations. The response mentioned in subsection (9)(a) must, in particular, give details of— how (if at all) the regulations differ from the proposals, how the Scottish Ministers have sought to address the observations and recommendations contained in the Commission's report, and any observations or recommendations contained in the report that the Ministers disagree with and have not sought to address. This section does not apply in relation to regulations made only for the purpose of the consolidation of earlier regulations. The Scottish Ministers may by regulations modify subsections (1) and (1A) so as to add, remove or vary the description of a power to make regulations conferred by this Act or by any other enactment. In this section, “finalise” means— in the case of regulations subject to the affirmative procedure, laying the draft Scottish statutory instrument containing the regulations before the Scottish Parliament for approval by resolution, in the case of regulations subject to the negative procedure, making the regulations. The following provisions come into force on the day after Royal Assent: this section and sections 95, 96, 97, 98 and 100. The other provisions of this Act come into force on such day as the Scottish Ministers may by regulations appoint. The power conferred by subsection (2) includes the power to make transitional, transitory or saving provision. The short title of this Act is the Social Security (Scotland) Act 2018. In performing its functions, the Scottish Commission on Social Security is not subject to the direction or control of any member of the Scottish Government. This paragraph is subject to any contrary provision in this or any other enactment. The Commission— is not a servant or agent of the Crown, and does not enjoy any status, immunity or privilege of the Crown. The Commission may do anything which appears to it— to be necessary or expedient for the purposes of, or in connection with, the performance of its functions, or to be otherwise conducive to the performance of its functions. has a right of access at reasonable times to any relevant information that it may reasonably require for the purpose of performing its functions, and may require any person who holds or is accountable for relevant information to provide at reasonable times any assistance or explanation that the Commission may reasonably require for the purpose of— performing its functions, or exercising the right conferred by paragraph (a). In sub-paragraph (1), “relevant information” means information in the possession or under the control of— any member of the Scottish Government, any person, or person of such description, as is specified by the Scottish Ministers in regulations. Sub-paragraph (1) is subject to any enactment or rule of law that prohibits or restricts— the disclosure of any information, or the giving of any assistance or explanation. The Commission may establish committees and sub-committees. The membership of the Commission's committees and sub-committees may include (but may not consist entirely of) persons who are not members of the Commission but those persons are not entitled to vote at meetings. The Commission may regulate its own procedure (including quorum) and that of its committees and sub-committees. The Commission may authorise— any of its members, or any of its committees or sub-committees, to perform such of its functions (and to such extent) as it may determine. The giving of authority under sub-paragraph (1) does not— affect the Commission's responsibility for the performance of the function, or prevent the Commission from performing the function itself. The validity of anything done by the Commission, its committees or sub-committees is not affected by— a vacancy in its membership, a defect in the appointment of a member, the disqualification of a person as a member after appointment. The Commission's members are entitled to be paid by the Scottish Ministers such— remuneration, and sums in respect of expenses incurred in performing their functions as members of the Commission, as the Ministers determine. In sub-paragraph (1)— the reference to the Commission's members includes a person who is not a member of the Commission but is a member of one of the Commission's committees or sub-committees, and the reference to performing functions as a member of the Commission, in the case of a person described in paragraph (a), is to be read as though it were a reference to performing the person's functions as a member of the committee or (as the case may be) sub-committee. A person who attends a meeting of the Commission at its request is entitled to be paid by the Scottish Ministers such travelling and other allowances (including compensation for loss of time) as the Ministers determine. In sub-paragraph (1) the reference to the Commission includes any of its committees or sub-committees. The Scottish Ministers are to provide the Commission with such staff and other resources as it requires to carry out its functions. The Commission is to consist of— a member to chair the Commission, and at least 2 but no more than 4 other members. The Scottish Ministers may by regulations amend sub-paragraph (1)(b) by substituting a different number for any number for the time being specified there. The Scottish Ministers are to appoint the Commission's members. The Scottish Ministers may not appoint a person who is disqualified from being a member (see paragraph 17). When appointing members the Scottish Ministers must have regard to the desirability of— securing that the Commission (taken as a whole) has experience in or knowledge of— the formulation, implementation and evaluation of social security policies in Scotland and elsewhere in the United Kingdom, research in connection with social security, and the effect of disability, arising from a physical or mental impairment, on daily life, having a member with personal experience of having a disability arising from a physical or mental impairment, and having as members people who have not previously been members. A person's membership of the Commission continues until the end of the period of appointment (subject to paragraph 16(1) and (2)). In sub-paragraph (1), “the period of appointment” means the period specified by the Scottish Ministers on appointing the person as a member. The Scottish Ministers may not specify a period of appointment that is longer than 4 years, beginning with the day that the appointment takes effect. Nothing in this paragraph prevents a person from being a member of the Commission for two or more consecutive periods of appointment. The Scottish Ministers may determine other terms and conditions of membership, in relation to matters not covered by this schedule. A member of the Commission may resign by giving notice in writing to the Scottish Ministers. A person's membership of the Commission ends if— the person becomes disqualified from being a member (see paragraph 17), or the Scottish Ministers give the person written notice that the person is removed from the Commission. The Scottish Ministers may remove a member of the Commission by virtue of sub-paragraph (2)(b) only if they consider that the member is— unfit to continue to be a member, or unable to perform the member's functions. A person is disqualified from being a member of the Commission if sub-paragraph (2) or (3) applies to the person. This sub-paragraph applies to a person who is— a member of the— Scottish Parliament, House of Commons, House of Lords, National Assembly for Wales, Northern Ireland Assembly, or European Parliament, a councillor of any local authority, a member of the Scottish Government, an office-holder of the Crown in right of Her Majesty's Government in the United Kingdom, an office-holder in the Scottish Administration, a civil servant, one of the members of the Scottish Tribunals, as defined in section 13(3) of the Tribunals (Scotland) Act 2014, a judge, or other member, of the Upper Tribunal or First-tier Tribunal established by section 3 of the Tribunals, Courts and Enforcement Act 2007. This sub-paragraph applies to a person (subject to sub-paragraph (4)) who is or has been— disqualified as a company director under the Company Directors Disqualification Act 1986, disqualified as a charity trustee under the Charities and Trustee Investment (Scotland) Act 2005, the subject of a disqualification under a disqualification provision analogous to either of those mentioned in paragraph (a) or (b) anywhere in the world. Sub-paragraph (3) does not apply to a person who is or has been disqualified as mentioned in that sub-paragraph only by— section 11 of the Company Directors Disqualification Act 1986 (undischarged bankrupts), section 69(2)(b) of the Charities and Trustee Investment (Scotland) Act 2005 (which disqualifies undischarged bankrupts from being charity trustees), or a provision analogous to either of those mentioned in paragraph (a) or (b) anywhere in the world. In schedule 3 of the Ethical Standards in Public Life etc. (Scotland) Act 2000, after the entry relating to the Scottish Children's Reporter Administration insert— “ The Scottish Commission on Social Security ”. In schedule 1 of the Freedom of Information (Scotland) Act 2002, after paragraph 80B insert— The Scottish Commission on Social Security. In schedule 2 of the Public Appointments and Public Bodies etc. (Scotland) Act 2003, under the heading “Other Public Bodies”, in the appropriate place alphabetically, insert— “ Scottish Commission on Social Security ”. In schedule 5 of the Public Services Reform (Scotland) Act 2010, after the entry relating to the Scottish Commission for Human Rights insert— “ The Scottish Commission on Social Security ”. The regulations must be framed so that (subject to any provision of the kind described in paragraph 2) an individual's eligibility in respect of a given period depends on the individual having provided regular and substantial care during that period to another individual to whom a disability benefit is normally payable. The regulations— are to set out the circumstances in which an individual is to be regarded as having provided regular and substantial care to another individual during a period, and may, in particular, do so by reference to whether or not the number of hours of care provided during the period exceeds (or is deemed to exceed) a threshold specified in the regulations. In sub-paragraph (1), “disability benefit” has the meaning given in the interpretation provision in Section F1 of Part 2 of schedule 5 of the Scotland Act 1998. The regulations may be framed so that, despite the criterion described in paragraph 1(1) not being fulfilled in relation to a given period, an individual may nevertheless be eligible in respect of that period. Where the regulations allow an individual to be eligible in respect of a period in relation to which the criterion described in paragraph 1(1) is not fulfilled, they must be framed so that the individual's eligibility depends on the individual— having at some time provided care to another individual who has a disability, and as a result of doing so, having received— carer's assistance, carer's allowance, or invalid care allowance. In sub-paragraph (2)(b), “carer's allowance” and “invalid care allowance” both mean an allowance payable under section 70 of the Social Security Contributions and Benefits Act 1992. The regulations may make an individual's eligibility depend on— whether or not the individual is in— employment, or education, the length of time the individual spends over a given period in— education. The regulations may make an individual's eligibility depend on being the individual (or one of the individuals) selected through a process set out in the regulations in a case where more than one individual would otherwise be eligible as a result of providing care to the same cared-for person during a given period. The regulations may make an individual's eligibility depend on either or both— the cared-for person, being resident and present in a particular place. The regulations may make an individual's eligibility depend on the age of either or both— the cared-for person. The regulations may make an individual's eligibility depend on the individual's financial circumstances. The regulations may make an individual's eligibility depend on the individual— being, or not being, in receipt of another type of assistance (whether under this Act or another enactment), being, or not being, eligible or entitled to receive such assistance. The regulations may provide that an individual ceases to be eligible in respect of a given period unless, by a deadline specified in the regulations— the individual has applied for carer's assistance in respect of the period, or the Scottish Ministers have become required to make a determination of the individual's entitlement to carer's assistance in respect of the period by regulations under section 52. The regulations may provide for the carer's assistance that is to be given to an individual to be given (in whole or in part) by way of— payment to another person in order to meet, or contribute towards meeting, any liability the individual has to that person, deduction from any liability the individual has to the Scottish Ministers under section 63. The regulations may allow carer's assistance to be given to an individual in a form other than money only if the individual (or a person acting on the individual's behalf) has agreed to the assistance being given in that form. If the regulations include provision of the kind mentioned in sub-paragraph (1), they must allow an individual (or a person acting on the individual's behalf) to withdraw agreement to being given carer's assistance in a form other than money at any time. Despite sub-paragraph (1), the regulations may provide for carer's assistance to be given (in whole or in part) by way of deduction, at a reasonable level, from any liability the individual has to the Scottish Ministers under section 63 if the individual has unreasonably refused to agree to the assistance being given in that form. For the purpose of sub-paragraph (3), “reasonable level” means a level that is reasonable having regard to the financial circumstances of the individual. Provision may be made in the regulations for the value of the carer's assistance that is to be given to an individual in respect of a period to be £0, but— such provision must be framed so as to apply by reference to at least one of the following matters— the individual being resident and present in a particular place during the period, the individual being in receipt of another type of assistance (whether under this Act or another enactment) during the period, and the Scottish Ministers may only make such provision where they consider that it would be in the interests of the individuals to whom it applies to be entitled to carer's assistance with a value of £0 in respect of a period rather than not being entitled to carer's assistance at all. Nothing in sub-paragraph (1)(a) is to be taken to preclude provision being framed so as to apply by reference to further matters in addition to those mentioned there. Nothing in this schedule, apart from the following provisions, is to be taken to limit what may be prescribed in the regulations— Chapter 1 of Part 1, paragraphs 11 and 11A in Part 2. In this schedule— “cared-for person” means the individual by providing care to whom the individual whose eligibility is in question has fulfilled the criterion described in paragraph 1(1) or 2(2), “eligibility” means eligibility for carer's assistance and “eligible” means eligible for carer's assistance, “the regulations” means regulations under section 28(2). The regulations must be framed so that (subject to any provision of the kind described in paragraph 2) an individual's eligibility in respect of a given period depends on the area in which the individual's home is situated experiencing a cold spell during that period. The regulations may be framed so that, despite the criterion described in paragraph 1 not being fulfilled (or its being uncertain whether it will be fulfilled) in relation to a given period, an individual may nevertheless be eligible in respect of that period. Where the regulations allow an individual to be eligible in respect of a period in relation to which the criterion described in paragraph 1 is not fulfilled (or may not be fulfilled), they must be framed so that the individual's eligibility depends on the area in which the individual's home is situated being, or having been, forecast to experience a cold spell during the period. The regulations are to set out, for the purpose of determining entitlement to cold-spell heating assistance— a definition of “home”, the circumstances in which an area is to be regarded as experiencing a cold spell, if provision of the kind described in paragraph 2 is made, the circumstances in which an area is to be regarded as being, or having been, forecast to experience a cold spell. anyone else who lives in the individual's home. The regulations may make an individual's eligibility depend on either or both the individual and anyone else who lives in the individual's home— the individual has applied for cold-spell heating assistance in respect of the period, or the Scottish Ministers have become required to make a determination of the individual's entitlement to cold-spell heating assistance in respect of the period by regulations under section 52. The regulations may make the value of the cold-spell heating assistance that is to be given to an individual depend on— whether or not other people live in the individual's home, the age of either or both— The regulations may allow cold-spell heating assistance to be given to an individual in a form other than money only if the individual (or a person acting on the individual's behalf) has agreed to the assistance being given in that form. If the regulations include provision of the kind mentioned in sub-paragraph (1), they must allow an individual (or a person acting on the individual's behalf) to withdraw agreement to being given cold-spell heating assistance in a form other than money at any time. paragraph 9 in Part 2. “eligibility” means eligibility for cold-spell heating assistance and “eligible” means eligible for cold-spell heating assistance, “the regulations” means regulations under section 29(2). The regulations may make an individual's eligibility depend on the individual being resident and present in a particular place. The regulations may make an individual's eligibility depend on the age of either or both― anyone who lives with the individual. Subject to paragraph 4, the regulations may not make an individual's eligibility depend on the financial circumstances of either or both— The regulations may make an individual's eligibility depend on either or both the individual and anyone who lives with the individual— the individual has applied for winter heating assistance in respect of the period, or the Scottish Ministers have become required to make a determination of the individual's entitlement to winter heating assistance in respect of the period by regulations under section 52. The regulations may make the value of the winter heating assistance that is to be given to an individual depend on― whether or not other people live with the individual, Subject to paragraph 8, the regulations may not make the value of the winter heating assistance that is to be given to an individual depend on the financial circumstances of either or both— The regulations may make the value of assistance depend on either or both the individual and anyone who lives with the individual— being, or not being, eligible to receive such assistance. The regulations may allow winter heating assistance to be given to an individual in a form other than money only if the individual (or a person acting on the individual's behalf) has agreed to the assistance being given in that form. If the regulations include provision of the kind mentioned in sub-paragraph (1), they must allow an individual (or a person acting on the individual's behalf) to withdraw agreement to being given winter heating assistance in a form other than money at any time. paragraph 3 in Part 1, paragraphs 7 and 9 in Part 2. “eligibility” means eligibility for winter heating assistance and “eligible” means eligible for winter heating assistance, “the regulations” means regulations under section 30(2). The regulations must be framed so that (subject to any provision of the kind described in paragraph 2) an individual's eligibility in respect of a given period depends on the individual having, during that period— a physical or mental impairment that― has a significant and not short-term adverse effect on the individual's ability to carry out normal day-to-day activities, or otherwise gives rise to a significant and not short-term need, or The regulations must provide that an individual is to be regarded as having a terminal illness for the purpose of determining entitlement to disability assistance if, having had regard to the guidance mentioned in sub-paragraph (3), it is the clinical judgement of an appropriate healthcare professional that the individual has a progressive disease that can reasonably be expected to cause the individual's death. The regulations may provide that, in the situation mentioned in sub-paragraph (2B), an individual who is not resident in the United Kingdom is to be regarded as having a terminal illness despite the clinical judgement described in sub-paragraph (2) not having been formed with regard to the guidance mentioned in sub-paragraph (3). The situation referred to in sub-paragraph (2A) is that it would not be reasonable in the circumstances to insist on a clinical judgement being provided that has been formed with regard to the guidance. The regulations are to define “appropriate healthcare professional” for the purpose of determining entitlement to disability assistance on the basis of an individual having a terminal illness. In defining “appropriate healthcare professional” the regulations— must provide that being a registered medical practitioner or registered nurse is a requirement for being an appropriate healthcare professional, may provide that being a registered member of a healthcare profession otherwise than as mentioned in paragraph (a) is a requirement for being an appropriate healthcare professional, may include additional requirements that a person must satisfy in order to be an appropriate healthcare professional, including by reference to a person's— skills, training, qualifications and experience, professional relationship to the individual in question, being authorised to act as an appropriate healthcare professional in relation to the individual in question by— a Health Board constituted under section 2(1)(a) of the National Health Service (Scotland) Act 1978, a Special Health Board constituted under section 2(1)(b) of that Act, the Scottish Ministers. may make different provision about the requirements for being an appropriate healthcare professional for the purposes of determining the entitlement to disability assistance of individuals who are resident in the United Kingdom and those who are not. The Chief Medical Officer of the Scottish Administration is— to prepare and from time to time revise, and to make publicly available by such means as the Chief Medical Officer considers appropriate, guidance that sets out when a progressive disease can reasonably be expected to cause an individual's death for the purpose of determining entitlement to disability assistance. Before preparing or revising guidance under sub-paragraph (3), the Chief Medical Officer must consult appropriate healthcare professionals (as defined in sub-paragraph (2C)) who are registered in the United Kingdom as members of a healthcare profession. The regulations may be framed so that, despite the criterion described in paragraph 1(1) not being fulfilled in respect of a given period, an individual may nevertheless be eligible in respect of that period. Where the regulations allow an individual to be eligible in respect of a period in relation to which the criterion described in paragraph 1(1) is not fulfilled, they must be framed so that the individual's eligibility depends on the individual having had, during some other period, a physical or mental impairment of the kind described in paragraph 1(1)(a). The regulations may make an individual's eligibility depend on the nature and extent of— the individual's impairment, the needs of the individual in consequence of the impairment. The regulations may make an individual's eligibility depend on the individual's age. Subject to paragraph 7, the regulations may not make an individual's eligibility depend on the financial circumstances of either or both— the individual has applied for disability assistance in respect of the period, or the Scottish Ministers have become required to make a determination of the individual's entitlement to disability assistance in respect of the period by regulations under section 52. The regulations may not make the eligibility of an individual who has a terminal illness depend on the individual having had the illness for any length of time. The regulations may not make the eligibility of an individual who has a terminal illness depend on the individual producing any evidence of that fact beyond a diagnosis by an appropriate healthcare professional (see paragraph 1(2C)). The regulations must be framed so that an individual who applies for disability assistance on the basis of having a terminal illness, and does have a terminal illness, is eligible, at the latest, from the day the application is made. The regulations must be framed so that an individual who is eligible by reason of having a terminal illness is entitled to the maximum amount of the assistance that the individual is eligible for. The regulations may make the value of the disability assistance that is to be given to an individual depend on the nature and extent of― The regulations may make the value of the disability assistance that is to be given to an individual depend on the individual's age. Provision may be made in the regulations for the value of the disability assistance that is to be given to an individual in respect of a period to be £0, but— the Scottish Ministers may only make such provision where they consider that it would be in the interests of the individuals to whom it applies to be entitled to disability assistance with a value of £0 in respect of a period rather than not being entitled to disability assistance at all. The regulations may provide for the disability assistance that is to be given to an individual to be given (in whole or in part) by way of— The regulations may provide that, if the Scottish Ministers consider it appropriate in the circumstances, the disability assistance that is to be given to an individual may be given (in whole or in part) by way of payment to another person who is to use the payment to benefit the individual entitled to the assistance. The regulations may allow disability assistance to be given to an individual in a form other than money only if the individual (or a person acting on the individual's behalf) has agreed to the assistance being given in that form. If the regulations include provision of the kind mentioned in sub-paragraph (1), they must allow an individual (or a person acting on the individual's behalf) to withdraw agreement to being given disability assistance in a form other than money at any time. Despite sub-paragraph (1), the regulations may provide for disability assistance to be given (in whole or in part) by way of deduction, at a reasonable level, from any liability the individual has to the Scottish Ministers under section 63 if the individual has unreasonably refused to agree to the assistance being given in that form. The regulations may not provide for the disability assistance that is to be given to an individual to be given by way of a lump-sum payment where the individual's entitlement arises on account of the individual having, or having had— pneumoconiosis, byssinosis, diffuse mesothelioma, bilateral diffuse pleural thickening, or primary carcinoma of the lung where there is accompanying evidence of— asbestosis, paragraph 6 in Chapter 2 of Part 1, Chapter 3 of Part 1, paragraph 14A in Chapter 1 of Part 2, paragraphs 17 and 18 in Chapter 2 of Part 2. “eligibility” means eligibility for disability assistance and “eligible” means eligible for disability assistance, “the regulations” means regulations under section 31(2). The regulations must be framed so that an individual's eligibility depends on the individual satisfying one of the primary eligibility criteria. The primary eligibility criteria are that the individual— is, or has been, more than a specified number of weeks pregnant, has a relationship of a specified kind to another individual who is, or has been, more than a specified number of weeks pregnant, is to, or has, become responsible for a child within a specified period of the child's birth, is responsible for a child when a specified event in the child's life occurs or has become responsible for the child within a specified period of the event. The regulations are to define what being responsible for a child means for the purpose of determining entitlement to early years assistance. The regulations may provide that an individual is not eligible, despite satisfying one of the primary eligibility criteria, on account of one of those criteria being satisfied in respect of the same child by someone else. The regulations may provide that an individual ceases to be eligible on account of satisfying a primary eligibility criteria unless, by a deadline specified in the regulations— the individual has applied for early years assistance, or the Scottish Ministers have become required to make a determination of the individual's entitlement to early years assistance by regulations under section 52. The regulations may allow early years assistance to be given to an individual in a form other than money only if the individual (or a person acting on the individual's behalf) has agreed to the assistance being given in that form. If the regulations include provision of the kind mentioned in sub-paragraph (1), they must allow an individual (or a person acting on the individual's behalf) to withdraw agreement to being given early years assistance in a form other than money at any time. Part 2. “eligibility” means eligibility for early years assistance and “eligible” means eligible for early years assistance, “the regulations” means regulations under section 32(2), “specified” means specified in the regulations. The regulations must be framed so that (subject to any provision of the kind described in paragraph 2) an individual's eligibility depends on the individual— having suffered a relevant personal injury caused by an accident arising out of and in the course of the individual's employment, or developing a relevant disease, or suffering a relevant personal injury, due to the nature of the individual's employment. The regulations may be framed so that, despite the criterion described in paragraph 1 not being fulfilled, an individual may nevertheless be eligible. Where the regulations allow an individual to be eligible despite the criterion described in paragraph 1 not being fulfilled, they must be framed so that the individual's eligibility depends on the individual having, or having had, a relationship of a kind specified in the regulations to an individual who suffered a personal injury, or developed a disease, in the circumstances mentioned in paragraph 1. The regulations are to define the following terms for the purpose of determining entitlement to employment-injury assistance— employment, relevant personal injury, relevant disease. The regulations may not define “employment” so as to include employment, or training for employment, that is not “relevant employment” as defined in the interpretation provision of Section F1 of Part 2 of schedule 5 of the Scotland Act 1998. The regulations may define “relevant personal injury” and “relevant disease” by reference to the circumstances in which an injury is suffered or a disease is developed as well as by reference to its kind and severity. The regulations may make an individual's eligibility depend on where, geographically, the injury was suffered or the disease developed (or is deemed to have been suffered or developed).

Subject to paragraph 8, the regulations may not make an individual's eligibility depend on the financial circumstances of either or both— The regulations may provide that an individual ceases to be eligible on account of an injury being suffered or a disease developed unless, by a deadline specified in the regulations— the individual has applied for employment-injury assistance, or the Scottish Ministers have become required to make a determination of the individual's entitlement to employment-injury assistance by regulations under section 52. The regulations may make the value of the employment-injury assistance that is to be given to an individual depend on the— kind, and severity, of the injury or disease in respect of which the assistance is to be given. The regulations may make the value of the employment-injury assistance that is to be given to an individual depend on the individual's age. Provision may be made in the regulations for the value of the employment-injury assistance that is to be given to an individual in respect of a period to be £0, but— the Scottish Ministers may only make such provision where they consider that it would be in the interests of the individuals to whom it applies to be entitled to employment-injury assistance with a value of £0 in respect of a period rather than not being entitled to employment-injury assistance at all. The regulations may provide for the employment-injury assistance that is to be given to an individual to be given (in whole or in part) by way of— The regulations may allow employment-injury assistance to be given to an individual in a form other than money only if the individual (or a person acting on the individual's behalf) has agreed to the assistance being given in that form. If the regulations include provision of the kind mentioned in sub-paragraph (1), they must allow an individual (or a person acting on the individual's behalf) to withdraw agreement to being given employment-injury assistance in a form other than money at any time. Despite sub-paragraph (1), the regulations may provide for employment-injury assistance to be given (in whole or in part) by way of deduction, at a reasonable level, from any liability the individual has to the Scottish Ministers under section 63 if the individual has unreasonably refused to agree to the assistance being given in that form. The regulations may not provide for the employment-injury assistance that is to be given to an individual to be given by way of a lump-sum payment where the individual's entitlement arises on account of someone having, or having had— paragraph 7 in Chapter 2 of Part 1, paragraph 11A in Chapter 1 of Part 2, paragraphs 13 and 14 in Chapter 2 of Part 2. “eligibility” means eligibility for employment-injury assistance, and “eligible” means eligible for employment-injury assistance, “the regulations” means regulations under section 33(2). The regulations must be framed so that an individual's eligibility for funeral expense assistance depends on the individual having met, or being responsible for meeting, the expenses of a funeral. The regulations are to define “funeral” for the purpose of determining entitlement to funeral expense assistance. The regulations may make an individual's eligibility depend on where the funeral takes place. being related to the deceased person, or having a relationship of a kind described in the regulations with the deceased person immediately before the death. The regulations may make an individual's eligibility depend on the value of the deceased person's estate being below a level specified in the regulations. the individual being resident and present in a particular place, the deceased person having been resident and present in a particular place at the date of death. The regulations may make an individual's eligibility depend on either or both the individual and, immediately before dying, the deceased person— The regulations may provide that an individual ceases to be eligible in respect of a funeral unless, by a deadline specified in the regulations— the individual has applied for funeral expense assistance in respect of the funeral, or the Scottish Ministers have become required to make a determination of the individual's entitlement to funeral expense assistance in respect of the funeral by regulations under section 52. The regulations may specify items of expense in relation to which funeral expense assistance will, or will not, be given. The regulations may set a limit on the value of the funeral expense assistance that will be given in relation to items of expense. The regulations may set a limit on the total value of the funeral expense assistance that will be given. The regulations may provide for the amount of funeral expense assistance that will be given to be reduced to reflect the availability of other funds that may be used to meet, or help to meet, any of the expenses. The regulations may allow funeral expense assistance to be given to an individual in a form other than money only if the individual (or a person acting on the individual's behalf) has agreed to the assistance being given in that form. If the regulations include provision of the kind mentioned in sub-paragraph (1), they must allow an individual (or a person acting on the individual's behalf) to withdraw agreement to being given funeral expense assistance in a form other than money at any time. paragraph 13 in Part 2. “deceased person” means the person in respect of whose funeral assistance is sought, “eligibility” means eligibility for funeral expense assistance and “eligible” means eligible for funeral expense assistance, “the regulations” means regulations under section 34(2). Subject to sub-paragraph (2) and paragraph 2, the regulations must be framed so that an individual's eligibility in respect of a given period depends on meeting the conditions described in either— sub-paragraph (3), or sub-paragraph (4). The regulations need not be framed so that eligibility depends on meeting the conditions described in sub-paragraph (3) or (4) if it is not (or is no longer) possible for circumstances to arise enabling the conditions described in the sub-paragraph to be met. The conditions referred to in sub-paragraph (1)(a) are— the individual is entitled to an award of universal credit in respect of the period in question, an amount under section 11 of the Welfare Reform Act 2012 (housing costs) is to be included in the calculation of that award, the amount relates to the individual's liability to make payments in respect of accommodation in the social rented sector other than temporary accommodation, were it not for regulations made by the Scottish Ministers by virtue of section 29(2) of the Scotland Act 2016, the amount would be lower on account of its being reduced due to the number of bedrooms in the property that the individual lives in, as a result of being entitled to more than would otherwise be the case because of the regulations referred to in paragraph (d), the value of the assistance to which the individual is entitled under an enactment is reduced in accordance with regulations under section 96 of the Welfare Reform Act 2012 (benefit cap). The conditions referred to in sub-paragraph (1)(b) are— during that period, the individual is— 18 years of age or over, but not more than 21 years of age, no amount under section 11 of the Welfare Reform Act 2012 is to be included in the calculation of the award, and an amount under that section would fall to be included in the calculation, in respect of accommodation in Scotland, if the individual were older. The regulations are to define “accommodation in the social rented sector” and “temporary accommodation” for the purpose of determining entitlement to housing assistance under provision made in accordance with paragraph 1(3). The regulations may be framed so that, despite the conditions described in paragraph 1 not being met in relation to a given period, an individual may nevertheless be eligible in respect of that period. Where the regulations allow an individual to be eligible in respect of a period in relation to which the conditions described in paragraph 1 are not met, they must be framed so that the individual's eligibility depends on the individual needing assistance to meet housing costs in a connection with a property that is not owned (wholly or partly) by the individual. For the purpose of sub-paragraph (2), an individual is not an owner of property if, in relation to the property, the individual is party to a shared ownership agreement within the meaning of section 83(3) of the Housing (Scotland) Act 2001. If provision of the kind described in this paragraph is made, the regulations are to set out, for the purpose of determining entitlement to housing assistance— a definition of “housing costs”, the circumstances in which an individual is to be regarded as needing assistance to meet housing costs. whether or not the individual, or anyone who lives with the individual, is in education, and the length of time the individual, or someone who lives with the individual, spends over a given period in education. The regulations may make an individual's eligibility depend on the financial circumstances of either or both— the individual has applied for housing assistance in respect of the period, or the Scottish Ministers have become required to make a determination of the individual's entitlement to housing assistance in respect of the period by regulations under section 52. The regulations must provide for the value of housing assistance to be given in a case to which this paragraph applies to be the amount described in sub-paragraph (3). This paragraph applies to a case in which an individual is entitled to housing assistance in respect of a given period by virtue of meeting the conditions described in paragraph 1(3). The amount referred to in sub-paragraph (1) is the lower of— the difference between— the amount under section 11 of the Welfare Reform Act 2012 included in the calculation of the individual's universal credit award for the period in question, and the amount that would have been included under that section in the calculation were it not for the regulations referred to in paragraph 1(3)(d), or the amount by which the value of the assistance to which the individual is entitled from the Secretary of State in respect of the period in question is reduced in accordance with regulations under section 96 of the Welfare Reform Act 2012. Sub-paragraph (1) does not apply if, by virtue of paragraph 1(2), the regulations need not provide for eligibility to depend on the conditions described in paragraph 1(3) being met. In a case to which paragraph 9 does not apply, the regulations may make the value of housing assistance that is to be given to an individual depend on— anyone who lives with the individual, the financial circumstances of either or both— Provision may be made in the regulations for the value of the housing assistance that is to be given to an individual in respect of a period to be £0, but— the Scottish Ministers may only make such provision where they consider that it would be in the interests of the individuals to whom it applies to be entitled to housing assistance with a value of £0 in respect of a period rather than not being entitled to housing assistance at all. The regulations may provide for housing assistance that is to be given to an individual to be given (in whole or in part) by way of— The regulations may allow housing assistance to be given to an individual in a form other than money only if the individual (or a person acting on the individual's behalf) has agreed to the assistance being given in that form. If the regulations include provision of the kind mentioned in sub-paragraph (1), they must allow an individual (or a person acting on the individual's behalf) to withdraw agreement to being given housing assistance in a form other than money at any time. Despite sub-paragraph (1), the regulations may provide for housing assistance to be given (in whole or in part) by way of deduction, at a reasonable level, from any liability the individual has to the Scottish Ministers under section 63 if the individual has unreasonably refused to agree to the assistance being given in that form. paragraphs 9 , 10A and 12 of Part 2. In this schedule (unless stated otherwise)— “eligibility” means eligibility for housing assistance and “eligible” means eligible for housing assistance, “the regulations” means regulations under section 35(2). The regulations must be framed so that an individual is eligible for short-term assistance if— the individual is, or was, entitled to a particular type of assistance (other than short-term assistance) under a determination made on the basis that the individual has ongoing entitlement, that determination has been superseded by a determination under section 37 with the result that the individual— is no longer entitled to the type of assistance in question, or is entitled to less assistance of the type in question, the individual's entitlement to the type of assistance in question is under review, and any further eligibility rules prescribed in the regulations are satisfied in the individual's case. An individual's entitlement to a particular type of assistance is under review within the meaning of sub-paragraph (1)(c) if— the individual has, under section 41, requested a re-determination of the individual's entitlement to the type of assistance in question and— the Scottish Ministers have yet to make a determination of the individual's entitlement under section 43, and the individual has not, since requesting the re-determination, made an appeal to the First-tier Tribunal against a determination of the individual's entitlement, or the individual has, under section 46, appealed to the First-tier Tribunal against a determination of the individual's entitlement to the type of assistance in question and the First-tier Tribunal has yet to make a decision under section 49, or the First-tier Tribunal is considering, under section 48(1)(b), whether to give permission for the individual to bring an appeal against a determination of the individual's entitlement to the type of assistance in question. This paragraph applies to any case in which an individual is eligible for short-term assistance by virtue of provision made in accordance with paragraph 1(1). In this paragraph, “the superseded determination” means the determination that has been superseded with one of the results mentioned in paragraph 1(1)(b), as a consequence of which the individual in question is eligible for short-term assistance. In relation to a case to which this paragraph applies, the regulations must provide for the value of the short-term assistance given to an individual in respect of any period to be equal to— V1 is the value of the assistance that the individual would have been given in respect of the period under the superseded determination had it not been superseded, and V2 is the value of the assistance that the individual is to be given in respect of the period under what is, at the time the individual becomes eligible for short-term assistance in respect of the period, the most recent determination of the individual's entitlement to the type of assistance to which the superseded determination relates. In relation to a case to which this paragraph applies, the regulations must provide for the rules regarding the form in which short-term assistance is given to an individual to be the same as the rules governing the form in which the type of assistance to which the superseded determination relates may be given. Nothing in this schedule is to be taken to preclude the regulations from providing for an individual to be eligible for short-term assistance in circumstances other than those described in paragraph 1. In this schedule, “the regulations” means regulations under section 36(2). The regulations may provide for an individual's assistance to be suspended in the following circumstances only— under section 54(1A) or 87B(7) the Scottish Ministers have issued a decision to suspend assistance to the individual due to a failure to provide information which the individual is yet to provide, where the Scottish Ministers have made arrangements (whether under section 85A, 85B or otherwise) for a person to receive the assistance on the individual's behalf, and the Ministers consider that it is necessary to suspend the assistance— in order to protect the individual from the risk of financial abuse, because the person with whom the Ministers have made arrangements is unable to continue to receive the assistance, or for any other reason specified in the regulations, or the individual has requested that the Scottish Ministers temporarily stop giving the assistance in question and is yet to request that they resume doing so. For the purpose of sub-sub-paragraph (1)(b), “financial abuse” includes— having money or other property stolen, being defrauded, being put under pressure in relation to money or other property, having money or other property misused. The regulations must require the Scottish Ministers, before suspending the assistance given to an individual, tohave regard to the financial circumstances of the individual. The regulations must confer a right on an individual whose assistance has been suspended to require the Scottish Ministers to review their decision to suspend the individual's assistance. The regulations must require the Scottish Ministers to inform an individual whose assistance they have suspended— of their decision to suspend the individual's assistance, of the reasons for their decision, of any steps which might be taken by the individual in order for the Scottish Ministers to consider ending the suspension, and of the individual's right in accordance with the regulations to require the Scottish Ministers to review their decision to suspend the individual's assistance. The regulations must provide that the Scottish Ministers are to fulfil the duty described by sub-paragraph (1) in a way that leaves the individual with a record of the information which the individual can show to, or otherwise share with, others. The regulations must provide that when— the suspension of an individual's assistance ends, and under the latest determination of the individual's entitlement to the type of assistance in question, the individual would have become entitled to be given assistance during the period of the suspension, the individual is immediately to be given under section 24 the assistance that the individual would have become entitled to be given under the determination during that period. Nothing in this schedule is to be taken to limit the provision that may be included in the regulations except to the extent stated. references to an individual's assistance being suspended are to an individual, by virtue of the regulations, not becoming entitled to be given some or all of the assistance in respect of a period that the individual otherwise would at the time, or times, prescribed by regulations under section 51(2)(a), “the regulations” means regulations under section 51(1).
