Statute overview

About this statute

This part creates the Scottish Legal Complaints Commission and gives it duties and powers to classify, reject, remit, investigate, and resolve complaints about legal professionals and services. This provision sets out the Commission’s complaints-handling rules, its reporting and monitoring duties, and confidentiality rules, and gives related powers to request information, issue guidance, and take enforcement steps. This provision gives the court and professional bodies powers over appeals, compensation, training directions, complaints handling, and legal-aid-related administration. The Board must prepare and publish a criteria plan, submit it to the Scottish Ministers, and follow ministerial directions. The Scottish Ministers can approve, modify, withdraw approval of, or require a new plan, and the Commission has governance, reporting, and accounting duties. The solicitor, firm, incorporated practice, and the Council may appeal a Tribunal decision to the Court within 21 days, and the Court may make directions on the appeal, including about expenses.
