Statute overview

About this statute

When a person dies, their movable and immovable property devolves to their personal representatives from the time of death. Personal representatives must represent the deceased in relation to the deceased’s movable and immovable property. This section defines which interests count as property of a deceased person for this Act. An intestate’s interest in property that could have been disposed of by customary-law testamentary disposition is treated as the intestate’s property. This Part applies to estates where the court may grant probate or letters of administration.
