About this statute

A licensed person must not export rough diamonds unless they have applied for and been issued a Kimberley Process Certificate by the Minister. An application for a Kimberley Certificate must follow Form 1 and be made to the Minister. The Minister may issue a Kimberley Certificate for the rough diamonds in the application if the required section 2 information is supplied, and must do so within 3 days. An applicant who does not comply with section 2 will not be issued a certificate. Exporters of rough diamonds must prepare a Form 3 report, present it to a customs officer at export time, and send a copy to the Minister within seven days after export. Importers of rough diamonds must prepare a Form 4 report, present it to a customs officer when clearing the import, and send a copy of the Form 4 plus the Kimberley Certificate to the Minister within 7 days after importation.
