About this statute
If a farmer buys land for farming and does not farm all or part of it for eight years from acquisition, title to the whole land or the unfarmed part is treated as extinguished. A farmer may obtain valid title to certain land if the land was acquired in good faith, farming started within eight years, and no other person had farmed it for the previous eight years; the court may also make title and compensation orders in some disputes. A person must not try to get someone else to give up possession of land except through due process of a court of competent jurisdiction. The Minister responsible for stool lands may, by legislative instrument, prescribe areas where this Act applies. This section defines “possession order” and “farming” for the Act, unless the context requires otherwise.
