Statute overview

About this statute

This Ordinance sets up a resolution regime for certain financial institutions and gives the Financial Secretary and resolution authorities powers to designate institutions, set control functions, and manage resolution. The resolution authority has notice, review, direction, valuation, and resolution powers over within-scope financial institutions and related entities, and certain failures to comply are offences. The provision gives a resolution authority powers to use bail-in, transfer securities, suspend certain obligations and termination rights, and direct continued services, while requiring reports and compliance with directions. This Part sets out how an appointing person and an independent valuer are appointed, how valuation and compensation decisions work, and how the two tribunals handle review, procedure, confidentiality, and appeals. This part gives the Court of Appeal appeal powers, lets resolution authorities seek clawback orders, and gives resolution authorities, authorized persons, investigators, and magistrates powers to obtain information, inspect premises, and suspend or defer certain disclosure and trading obligations.
