Public Health and Municipal Services (Fees) Regulation (Cap. 132, section 124I) (Enacting provision omitted—E.R. 2 of 2014) [1 April 2000] 1. (Omitted as spent—E.R. 2 of 2014) 2. Interpretation In this Regulation—Food Business Regulation (《食物業規例》) means the Food Business Regulation (Cap. 132 sub. leg. X).(L.N. 84 of 2013) 3. Fees in respect of hawker licences, hawker pitches or stalls The fee payable for a matter relating to a hawker licence, hawker pitch or stall specified in Schedule 1 is the appropriate fee specified in that Schedule.(L.N. 84 of 2013) 4. Fees in respect of licences under Food Business Regulation The fee payable for a matter relating to a licence for a food business specified in Schedule 2 is the appropriate fee specified in the appropriate Part in that Schedule.(L.N. 84 of 2013) 5. Fees in respect of permissions under Food Business Regulation The fee payable for a matter relating to a permission for the sale of any food specified in Schedule 3 is the appropriate fee specified in that Schedule.(L.N. 84 of 2013) 6. Fees in respect of licences under Frozen Confections Regulation The fee payable for a matter relating to a licence for a frozen confection factory specified in Schedule 4 is the appropriate fee specified in the appropriate Part in that Schedule.(L.N. 84 of 2013) 7. Fees in respect of licences under Milk Regulation The fee payable for a matter relating to a licence for a milk factory specified in Schedule 5 is the appropriate fee specified in the appropriate Part in that Schedule.(L.N. 84 of 2013) 8. Fees relating to Government crematoria, columbaria or public cemeteries, etc. The fee payable for a matter relating to a Government crematorium, columbarium, public cemetery, garden of remembrance or the exhumation of human remains specified in Schedule 6 is the appropriate fee specified in the appropriate Part in that Schedule.(L.N. 84 of 2013) 9. Fees in respect of licences and examination under Slaughterhouses Regulation The fee payable for a matter relating to a licence for a slaughterhouse and examination specified in Schedule 7 is the appropriate fee specified in Part 2 of that Schedule.(L.N. 84 of 2013) 10. Fees in respect of licences under various regulations The fee payable for a matter relating to a licence under a regulation specified in Schedule 8 is the appropriate fee specified in that Schedule.(L.N. 84 of 2013) 11. Transitional provisions relating to Public Health and Municipal Services (Fees) (Amendment) Regulation 2025 (1) The amended Regulation does not apply in relation to a specified application made before the commencement date in relation to a food business mentioned in Part 2, 3, 4, 5, 6 or 10 of Schedule 2 (subject application).(2) The pre-amended Regulation continues to apply in relation to the subject application as if the 2025 Amendment Regulation had not been made.(3) In this section—2025 Amendment Regulation (《2025年修訂規例》) means the Public Health and Municipal Services (Fees) (Amendment) Regulation 2025;amended Regulation (《經修訂規例》) means this Regulation as amended by the 2025 Amendment Regulation;commencement date (生效日期) means 1 November 2025;pre-amended Regulation (《原有規例》) means this Regulation as in force immediately before the commencement date;specified application (指明申請) means an application for the grant of a full licence under section 31 of the Food Business Regulation.(L.N. 162 of 2025) Schedule 1 [s. 3](L.N. 60 of 2010)Fees Payable for Issue or Renewal of Hawker Licences or for Allocation and Use of Hawker Pitches or Stalls A. M);garden of remembrance (紀念花園) means a garden of remembrance specified in Part 7 of the Fifth Schedule to the Ordinance;Government crematorium (政府火葬場) means a Government crematorium specified in Part 5 of the Fifth Schedule to the Ordinance; large niche (大型龕位) means a niche— (a) that is located at a Government crematorium or columbarium; and (b) that is capable of holding 4 containers; (L.N. 14 of 2019) Public Cemeteries Regulation (《公眾墳場規例》) means the Public Cemeteries Regulation (Cap. 132 sub. leg. BI);public cemetery (公眾墳場) means a public cemetery specified in Part 1 of the Fifth Schedule to the Ordinance; (L.N. 14 of 2019) standard niche (標準龕位) means a niche— (a) that is located at a Government crematorium or columbarium; and (b) that is capable of holding 2 containers.
