I, JIM MITCHELL, Minister for Communications, in exercise of the powers conferred on me by sections 5 11 of the (No. 23 of 1946), and Section 5 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), hereby order as follows: 1 .. 1. Registration of an aircraft 4. There shall be charged and levied for the issue of a certificate of registration of an aircraft fees in accordance with the following scale— where the maximum total authorised weight of the aircraft: does not exceed 2,730 kgs. 19.00 exceeds 2,730 kgs. but does not exceed 5,700 kgs. 57.00 exceeds 5,700 kgs. but does not exceed 13,600 kgs. 76.00 exceeds 13,600 kgs. but does not exceed 45,500 kgs. 126.00 exceeds 45,500 kgs. 189.00 Certificate of type approval 5. There shall be charged and levied for the issue of a certificate of type approval and fee of an amount equivalent to the cost of such investigations as were required by the Minister for the purpose of issuing the certificate. Certificate of airworthiness 6. (1) There shall be charged and levied for the issue of a certificate of airworthiness a fee of an amount equivalent to the cost of such investigations as were required by the Minister for the purpose of issuing the certificate of airworthiness. (2) There shall be charged and levied for the issue of a certificate of airworthiness for export the following scale of fees:— in the case of a glider or balloon of which the maximum total authorised weight does not exceed 1,000 kgs. 7.00 in the case of a glider or balloon of which the maximum total authorised weight exceeds 1,000 kgs. 19.00 in the case of any other aircraft for every 500 kgs or part thereof 37.00 (3) In the case of an aircraft in respect of which a certificate of airworthiness has previously been issued there shall be charged for the validation of a certificate of airworthiness the following scale of fees for each complete year of validity specified:— in the case of a glider or balloon of which the maximum total authorised weight does not exceed 1,000 kgs. 7.00 in the case of a glider or balloon of which the maximum total authorised weight exceeds 1,000 kgs. 19.00 in the case of other aircraft of which the maximum total authorised weight does not exceed 2,000 kgs. for every 500 kgs. or part thereof 30.00 in the case of any other aircraft of which the maximum total authorised weight exceeds 2,000 kgs. for every 500 kgs. or part thereof 38.00 (4) There shall be charged and levied for the renewal of a certificate of airworthiness and for the renewal of a validation of a certificate of airworthiness the following scale of fees for each complete year of validity specified:— in the case of a glider or balloon of which the maximum total authorised weight does not exceed 1,000 kgs. 12.00 in the case of a glider or balloon of which the maximum total authorised weight exceeds 1,000 kgs. 19.00 in the case of other aircraft of which the maximum total authorised weight does not exceed 2,000 kgs. for every 500 kgs. or part thereof 30.00 in the case of any other aircraft of which the maximum total authorised weight exceeds 2,000 kgs. for every 500 kgs. or part thereof 38.00 Flight Permit 7. There shall be charged and levied for the issue of a flight permit a fee of an amount equal to the cost of such investigations as were required by the Minister for the purpose of issuing the flight permit. Modification to an aircraft 8. There shall be charged and levied for the approval of a modification to an aircraft a fee of an amount equal to the cost of such investigations as were required by the Minister for the purpose of granting the approval as may be prescribed from time to time, subject to a minimum charge of IR£13.00. Approval of an engine 9. There shall be charged and levied for the approval of an engine a fee of an amount equal to the cost of such investigations as were required by the Minister for the purpose of granting the approval. 10 Noise certificate 10. There shall be charged and levied for the issue of a noise certificate a fee of an amount equivalent to the cost of such investigations as were required by the Minister for the purpose of issuing the noise certificate. 11 Approval of an organisation and premises 11. There shall be charged and levied:— ) for the inspection of an organisation for the purpose of the approval of the organisation to overhaul and maintain aircraft and aircraft components and to manage and conduct an aviation ground training school a fee of IR£378 per annum for each branch of the organisation separately inspected; ) for the approval of an organisation for the manufacture of aviation materials, a fee of IR£95 per annum; ) for the inspection of premises for the purpose of the approval of the premises for the storage of aviation accessories and component parts, a fee of IR£95 per annum. 12 Sowing seed, dusting or spraying 12. There shall be charged and levied for the grant of permission by the Minister in respect of an aircraft engaged in the dropping of material for the purpose of sowing seed, or dusting or spraying the surface of the land or water or anything growing on the land a fee of IR£252 per aircraft per annum. 13 Inspection for seeing that an aircraft is airworthy 13. There shall be charged for an inspection on the application of an owner of an aircraft (not being an inspection made with a view to issuing or renewing or validating a certificate of airworthiness or issuing a certificate of airworthiness for export) for the purpose of seeing that an aircraft is airworthy and complies with the requirements for the issue of a certificate of airworthiness a fee equal in amount to the cost of such investigations as were made for the purpose of the inspection. 14 Course of training for Aircraft Maintenance Engineer's Licence 14. There shall be charged and levied for the approval by the Minister of a course of training connected with the requirements for the grant of an Aircraft Maintenance Engineer's licence the following charges:— ) for the grant of approval, a fee of IR£378; ) for the renewal of such approval, a fee of IR£180. 15 Fees in connection with Aerodromes 15. There shall be charged and levied for the issue, renewal or variation of a licence for an aerodrome a fee of an amount equal to the cost of such investigations as are required by the Minister for the purpose of the issue, renewal or variation of a licence subject to the following minimum charges:— ) for the issue of a licence for an aerodrome, a fee of IR£63; ) for the renewal of a licence for an aerodrome, a fee of IR£37; ) for the variation of a licence for an aerodrome, a fee of IR£19. 16 .. 16. There shall be charged and levied:— ) for the grant of special approval of an aerodrome by the Minister, a fee of an amount equal to the cost of such investigations as were required by the Minister for the grant of the approval; ) for the inspection of a proposed aerodrome site, a fee of an amount equal to the cost of such inspection. 17 Personnel Licensing 17. (1) ( ) There shall be charged and levied for a person normally resident in the State, or in a member state of the European Communities, or employed by an air transport undertaking which has its principal place of business in the State or in a member state of the European Communities, the scale of personnel licence fees in respect of the grant renewal or extension of such licence set out in the Schedule to this Order. ) In the case of persons other than those specified in paragraph (1) ( ) of this Article, there shall be charged and levied for the issue of a Basic Aeronautical Certificate or the grant, renewal or extension of an Aircraft Maintenance Engineer's Licence such fee of an amount as may be prescribed from time to time. ) Notwithstanding the provisions of paragraphs (1) ( ) and (1) ( ) of this Article, there shall be charged and levied for the validation of personnel licences the scale of fees set out in the Schedule to this Order. S.I. No. 165 of 1966 ), for the purpose of the grant, validation or renewal of a licence to act as a flight crew member, the fees payable for such an examination shall be— in the case of the grant or validation of a licence 65.00 in the case of the renewal of a licence 38.50 (ii) Where only a part or parts of a medical examination referred to in subparagraph ( ) (i) of this paragraph above is conducted, the fee payable for each such part shall be:— radiography examination 20.00 electrocardiography examination 9.00 ophthalmology examination 8.00 auditory acuity test 8.00 special medical examination The cost of such examination Special Medical Review The cost of such review. S.I. No. 141 of 1964 ), there shall be charged and levied for the grant of such approval a fee of IR£52.50, and for the renewal of such approval, a fee of IR£19.00. (3) Where an applicant for a personnel licence is exempt from examination or test, the appropriate fee may be remitted or reduced in such manner as the Minister thinks fit. (4) Where an application for a personnel licence is withdrawn by the applicant or refused by the Minister, the appropriate fees may be refunded but the Minister may retain such amount of the fees as appears to him to be reasonable in respect of any examination or test already conducted pursuant to the application. (5) If an endorsement of a personnel licence is made at the time of the issue of the licence or if at any other time the endorsement is made as a result of the passing by the applicant of an examination or test conducted by the Minister, the appropriate fee may be remitted. (6) In the case of a holder of a Flight Radiotelegraphy Operator's Licence (Temporary) who qualifies for the grant of a Flight Radiotelegraphy Operator's Licence the Minister, if he thinks fit, may remit in full the fee otherwise payable for the last mentioned licence. (7) In the case of a holder of a Flight Radiotelephony Operator's Licence (Restricted) who qualifies for the grant of a Flight Radiotelephony Operator's Licence (General) the Minister, if he thinks fit, may remit in full the fee otherwise payable for the last mentioned licence. (8) There shall be charged and levied for the re-examination of the result of the technical examination required by an applicant for a personnel licence, a fee of an amount equal to the cost of such investigations as were required by the Minister for such re-examination. 18 .. 18. The Minister may remit or reduce, in any case in which he is satisfied that it is reasonable to do so, any fee referred to or mentioned in this Order.
