AGRICULTURAL PRODUCE (CEREALS) (WHEAT GROWING AND FEEDING STUFFS) REGULATIONS, 1933. WHEREAS Parts I, IV, and VI of the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933), will, by virtue of the Agricultural Produce (Cereals) Act, 1933 (Commencement) Order, 1933, come into operation on the 24th day of May, 1933: AND WHEREAS the Minister for Agriculture is empowered by the said Parts I, IV and VI to make, by order, regulations in relation to the several matters and things which are the subject of these regulations: AND WHEREAS it is expedient for the purpose of bringing the said Parts I, IV and VI into operation on the said 24th day of May, 1933, that these regulations should be made forthwith: NOW, I, Séamas ORiain, Minister for Agriculture, in exercise of the powers conferred on me by the joint operation of the Interpretation Act, 1923 (No. 46 of 1923), and the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say:— 1. These Regulations may be cited for all purposes as the Agricultural Produce (Cereals) (Wheat Growing and Feeding Stuffs) Regulations, 1933. 2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas. 3. In these regulations the expression "the Act" means the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933). 4. The certificate of appointment to be furnished by the Minister for Agriculture to every inspector of the said Minister, pursuant to subsection (2) of section 12 of the Act, shall be in the Form A.P.C.1 in the Schedule hereto. 5. For the purposes of paragraph ( ) of subsection (9) of section 47 of the Act— ) every application for registration in the register of wheat importers shall be in the Form A.P.C. in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that form; ) every application for registration in the register of wheat dealers shall be in Form A.P.C. in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that form; ) every application for registration in the register of wheat growers shall be in Form A.P.C. in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that form; ) every application for registration in the register of maize millers shall be in Form A.P.C. in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that form; ) every application for registration in the register of maize importers shall be in Form A.P.C. in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that form; ) every application for registration in the register of manufacturers of compound feeding stuffs shall be in Form A.P.C. in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in that form. 6.—(1) Every registered wheat importer shall within seven days after the expiration of every month furnish to the Minister for Agriculture a return in the Form A.P.C.8 in the Schedule hereto giving in respect of such month the particulars indicated in that form. (2) Every registered wheat dealer shall within seven days after the expiration of the month of August, 1933, and every subsequent month furnish to the Minister for Agriculture a return in the Form A.P.C. in the Schedule hereto giving in respect of such month the particulars indicated in that form. (3) Every registered maize miller shall within seven days after the expiration of every month furnish to the Minister for Agriculture a return in the Form A.P.C.10 in the Schedule hereto giving in respect of such month the particulars indicated in that form. (4) Every registered maize importer shall within seven days after the expiration of every month furnish to the Minister for Agriculture a return in the Form A.P.C.11 in the Schedule hereto giving in respect of such month the particulars indicated in that form. (5) Every registered manufacturer of compound feeding stuffs shall within seven days after the expiration of every month furnish to the Minister for Agriculture a return in the Form A.P.C.12 in the Schedule hereto, and such form shall give in respect of such month the following particulars, that is to say— ) in the first column of Part I thereof the name of each kind of raw material purchased by him for use in his business, and in the second and subsequent columns of the said Part in respect of each such raw material the particulars indicated at the head of such second and subsequent columns respectively; ) in the first column of Part II thereof the name of each kind of compound feeding stuff (as defined by section 8 of the Act) manufactured by him, and in the second and subsequent columns of the said Part in respect of each such compound feeding stuff the particulars indicated at the head of such second and subsequent columns respectively. 7. For the purposes of subsection (1) of section 56 of the Act the statement to be furnished by every registered wheat grower shall be in the Form A.P.C.13 in the Schedule hereto, and shall contain the particulars indicated in that form. 8. For the purposes of subsection (2) of section 57 of the Act— ) the records required by that section to be kept by every registered wheat importer shall be in the Form A.P.C.14 in the Schedule hereto, and the particulars to be entered therein shall be those indicated in the said form; ) the records required by that section to be kept by every registered wheat dealer shall be in the Form A.P.C.15 in the Schedule hereto, and the particulars to be entered therein shall be those indicated in the said form; ) the records required by that section to be kept by every registered maize miller shall be in the Form A.P.C.16 in the Schedule hereto, and the particulars to be entered therein shall be those indicated in the said form; ) the records required by that section to be kept by every registered maize importer shall be in the Form A.P.C.17 in the Schedule hereto, and the particulars to be entered therein shall be those indicated in the said form; ) the records required by that section to be kept by every registered manufacturer of compound feeding stuffs shall be in the Form A.P.C.18 in the Schedule hereto, and the particulars to be entered therein shall be as those indicated in the said form. 9. For the purposes of sub-paragraph (ii) of paragraph ( ) of subsection (1) of section 81 of the Act, a package of maize meal sold for human consumption shall be secured either ( ) by affixing an adhesive paper label across the top of the package in such manner that the package cannot be opened without tearing the label, or ( ) by affixing a linen label in such manner that the package cannot be opened without removing the label. 10. —(1) For the purposes of paragraph ( ) of subsection (1) of section 82 of the Act the prescribed percentage shall be twenty per cent. (2) For the purposes of paragraph ( ) of subsection (1) of section 82 of the Act the prescribed percentage shall be eighty-five per cent. (3) For the purposes of paragraph ( ) of subsection (1) and subsection (2) of section 82 of the Act, the following provisions shall have effect, that is to say— ) maize meal mixtures which include therein oats in the form of the entire product derived from grinding the kernels only of oats shall be divided into the following classes, that is to say— (i) Class I—i.e., where amount by weight of oats is less than ten per cent. of the weight of the maize meal mixture; (ii) Class II—i.e, where the amount by weight of oats is ten per cent. of the weight of the maize meal mixture; ) the prescribed percentage in respect of Class I shall be eighty-five per cent.; ) the prescribed percentage in respect of Class II shall be ninety per cent. 11. For the purposes of paragraph ( ) of subsection (1) of section 83 of the Act, particulars of the percentage by weight of each of the component parts of a maize meal mixture shall be given either ( ) on an adhesive paper label securely affixed across the top of the package in such manner that the package cannot be opened without tearing such label, or ( ) on a linen label affixed to the package in such manner that the package cannot be opened without removing the label.
