Road Transport Act, 1933 , (Part V) Regulations Order, 1933, made by the Minister for Industry and Commerce on the 13th day of October, 1933, pursuant to Section 6 of the Road Transport Act, 1933 WHEREAS it is enacted by Section 6 of the Road Transport Act, 1933 , that the Minister for Industry and Commerce may by order make regulations for prescribing anything which in that Act is referred to as prescribed, and also anything which he is by the said Act authorised to prescribe by regulations made under the Act : AND WHEREAS it is necessary that regulations should be made for the purposes of Part V of the said Act : NOW, THEREFORE, the Minister for Industry and Commerce, in exercise of the powers conferred on him by Section 6 of the Road Transport Act, 1933 , and of all other powers him in this behalf enabling hereby makes the following Regulations for the purposes of Part V of the said Act : PART I. 1.—This Order may be cited for all purposes as the Road Transport Act, 1933 , (Part V) Regulations Order, 1933. 2.—Words and expressions, defined or established by the Road Transport Act, 1933 , shall have the same meanings where they occur in this Order as in that Act. Interpretation Act, 1923 , shall apply to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas. 4.—In this Order the expression " the Act " means the Road Transport Act, 1933 PART II. Transfer and Reduction Orders Under Part V of the Road Transport Act, 1933 5.—Every application for an order under Part V of the Act shall be in the appropriate form* indicated in the Schedule hereto, that is to say :— Application by an authorised (merchandise carrying) company for an order transferring to such company a particular merchandise (existing carrier's) licence Form R.T. 8 Application by an authorised (merchandise carrying) company for an order reducing the classes of merchandise specified in a particular merchandise (existing carrier's) licence Form R.T. 9 Application by an authorised (merchandise carrying) company for an order reducing the area of operation specified in a particular merchandise (existing carrier's) licence Form R.T. 10 Application by a licensee under a merchandise (existing carrier's) licence for an order transferring such licence to a specified authorised (merchandise carrying) company Form R.T. 11 Application by an authorised (passenger carrying) company for an order transferring to such company a particular passenger licence Form R.T. 12 Application by a licensee under a passenger licence for an order transferring such licence to a specified authorised (passenger carrying) company Form R.T. 13 6.—Application for an order under Part V of the Act shall be lodged not later than two calendar months before the proposed date of the transfer or reduction, as the case may be, or such shorter period as the Minister may in special circumstances allow. * These application forms may be obtained on application to the Department of Industry and Commerce, Transport and Marine Branch, Dublin. PART III. 7.—The fee payable to the Minister on application for an order under Part V of the Act shall be Two Pounds. Every such fee shall be lodged with the application, and shall be payable in the form of a Post Office Money Order payable to the Paymaster-General at the General Post Office, Dublin, and crossed " / & Co. / " or in the form of a cheque guaranteed by the bank on which it is drawn payable to the credit of the Postmaster-General. Every fee collected in respect of applications for orders under Part V of the Act shall be paid into the Exchequer.. Dated this 13th day of October, 1933. In the case of a firm, the name by which it is ordinarily known should be given, together with the names of the partners, and the application should be signed by each of the partners. (4) A certified copy of any correspondence there may have been in this connection should be furnished and securely fastened to the form.
