The Road Transport ( Road Transport Act, 1932 ) Regulations made by the Minister for Industry and Commerce on the 3rd day of November, 1933, pursuant to the Road Transport Act, 1932 , as amended by the Road Transport Act, 1933 WHEREAS it is enacted by Section 4 of the Road Transport Act, 1932 , that the Minister For Industry and Commerce may by order make regulations for prescribing anything which in that Act is referred to as prescribed and also anything which he is by the said Act authorised to prescribe by regulations made under the Act : NOW, THEREFORE, the Minister for Industry and Commerce in the exercise of the powers conferred on him by Section 4 of the Road Transport Act, 1932 , and of all other powers him in this behalf enabling, hereby makes the Regulations :— PART I. 1.—These Regulations may be cited for all purposes as the Road Transport ( Road Transport Act, 1932 ) Regulations, 1933, and these Regulations together with the Road Transport Regulations, 1932, may be cited for all purposes as the Road Transport ( Road Transport Act, 1932 ) Regulations, 1932 and 1933. 2.—Words and expressions, defined or established by the Road Transport Act, 1932 , and the Road Transport Regulations, 1932, shall have the same meanings where they occur in these Regulations as in that Act and those Regulations. Interpretation Act, 1923 , shall apply to the interpretion of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas. 4.—The Regulations numbered 6 and 8 of the Road Transport Regulations, 1932, are hereby revoked and in lieu thereof the Regulations numbered 5 and 6 of these Regulations shall respectively have effect. PART II. PASSENGER LICENSES. 5.—(1) Application for the grant of an annual passenger licence in respect of a continuous passenger road service shall be lodged not later than two calendar months before the proposed date of commencement of the licence or such shorter period as the Minister may, in special circumstances, allow. (2) Application for the grant of an annual passenger licence in respect of a seasonal passenger road service shall be lodged not later than one calendar month before the proposed date of commencement of the season or such shorter period as the Minister may in special circumstances, allow. (3) Application for the renewal of an annual passenger licence in respect of a continuous passenger road service shall be lodged not later than the first day of October next preceding its expiry or such other date during the month of October as the Minister may, in special circumstances, allow. (4) Application for the renewal of an annual passenger licence in respect of a seasonal passenger road service shall be lodged not later than one calendar month before the date of commencement of the season authorised by the licence or such shorter period as the Minister may, in special circumstances, allow. (5) Application for the grant of an occasional passenger licence for one occasion shall be lodged not later than one week before the occasion or such shorter period as the Minister may, in circumstances, allow. (6) Application for the grant of an occasional passenger licence for two or more occasions shall be lodged not later than one calendar month before the first of such occasions or such shorter period as the Minister may, in special circumstances, allow. (7) Application for the transfer of a passenger licence shall be lodged not later than one calendar month before the proposed date of transfer, or such shorter period as the Minister may, in special circumstances, allow. PART III. PASSENGER ROAD SERVICE CHARGES. 6.—The route of every omnibus service shall be divided into such stages as the licensee may determine. Provided that the stages so determined in respect of any continuous or seasonal omnibus service whose terminal points are both situated withinfifteen miles from the General Post Office in Dublin shall include a division of the route into stages for which the maximum fare chargeable shall be 1d., a division of the route into stages for which the maximum fare chargeable shall be 1½d., and a division of the route into stages for which the maximum fare chargeable shall be 2d. PART IV. ACCOUNTS AND RETURNS. 7.—Part I ( ) of the fourth schedule to the Road Transport Regulations, 1932, is hereby amended by the insertion of a sub-head entitled " Transfer to (or from) renewal or suspense account " immediately below the sub-head " Engines " under the head of Maintenance and Renewal of Motor Vehicles," and a sub-head " Road-Tax " immediately below the sub-head " Uniforms " under the head " Traffic Expenses," and the said Part I ( ) of the said schedule shall be construed and have effect accordingly.
