I, FRANK CLUSKEY, Minister for Trade, Commerce and Tourism, in exercise of the powers conferred on me by sections 103 112 395 of the Companies Act, 1963 , (No. 33 of 1963), and the Industry, Commerce and Tourism (Alteration of Name of Department and Title of Minister) Order, 1981 ( S.I. No. 290 of 1981 ), hereby order as follows: 1. This Order may be cited as the Companies (Fees) Order, 1983. 2. This Order shall come into operation on the 5th day of September, 1983. 3. The Eighth Schedule to the Companies Act, 1963 (No. 33 of 1963), is hereby altered by the substitution for the matter (inserted by the Companies (Fees) Order, 1980 ( S.I. No. 400 of 1980 ) ), contained in the first and second columns of Part 1 of that Schedule, of the following: "Matter in respect of which fee is payable Amount of fee For registration of a company For registration of change of a company name For registration of any existing company except such companies as are by this Act exempted from payment of fees in respect of registration under this Act An amount equal to the difference, if any, between £110 and the amount already paid. For registration of an increase in the membership of a company limited by guarantee or an unlimited company An amount equal to the difference, if any, between £110 and the amount already paid For registering any document by this Act required or authorised to be registered or required to be delivered, sent or forwarded to the registrar, other than in connection with the change of company name For making a record of any fact by this Act required or authorised to be recorded by the registrar, other than in connection with the change of company name. 4. Where the Minister directs, pursuant to section 23 (2) of the Companies Act, 1963 , that a company shall change its name, any fee required to be paid in respect of the registration of the alteration of the name of the company shall not be charged, levied or paid. 5. The Companies (Fees) Order, 1964 ( S.I. No. 44 of 1964 ), is hereby amended by the substitution for Article 3 (inserted by the Companies (Fees) Order, 1980), of the following article: "3. The following fees are hereby prescribed for the purposes of sections 103 and 112 of the Act: For registering a charge required to be registered under Part IV (excluding Section 112) of the Act. For registering particulars of a series of debentures under Part IV of the Act. For registering particulars of charges under Section 112 of the Act. For inspecting the register of charges for each inspection. 6. The Companies (Fees) Order, 1980, is hereby revoked. GIVEN under my Official Seal, this 1st day of September, 1983.
