THE WEIGHTS AND MEASURES (BOTTLE FACTORY) REGULATIONS, 1928, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE FIFTEENTH DAY OF NOVEMBER, 1928, PURSUANT TO SECTION 7 of THE WEIGHTS AND MEASURES ACT, 1928 Pursuant to the powers conferred on him by Section 7 of the Weights and Measures Act, 1928 , and all other powers in that behalf enabling him, the Minister for Industry and Commerce hereby makes the following Regulations :— 1. These Regulations may be cited as the Weights and Measures (Bottle Factory) Regulations, 1928. 2. These Regulations shall come into force on the First day of December, 1928. 3. In these Regulations :— " The Minister " means the Minister for Industry and Commerce ; " Special Inspector " means a special inspector appointed under Section 4 of the Weights and Measures Act, 1928 ; and " bottles " means bottles authorised by licence under Section 7 of the Weights and Measures Act, 1928 , to be stamped during process of manufacture. 4. The licence shall be in the form set out in the Schedule hereto. 6. ( ) No bottle shall be manufactured except from a mould in respect of which a certificate has been given under the preceding Regulation. ) No bottle shall be manufactured except in the presence of a special inspector, and under his supervision of the stamping thereof. Any person who manufactures bottles in contravention of the requirements of this Regulation, or either of them, shall be liable, on conviction, to a fine not exceeding £2, in respect of every bottle so manufactured. 7. All bottles on which a stamp of verification has been cast, shall remain in the custody of a special inspector, from the time of manufacture until released by him for use in trade, or destroyed by him, or under his supervision, in the manner required by these Regulations. 8. The special inspector shall supervise the entire output of bottles from the delivery end of the manufacturing plant. He shall select and shall test, in accordance with the requirements of the Weights and Measures (General) Regulations, 1928, such number of bottles in each hour of delivery as the Minister shall direct from time to time. Should he ascertain that any bottle so tested is inaccurate, he shall require the mould from which the inaccurate bottle is produced to be removed forthwith from the machine. He shall then examine the bottles which are passing through the mechanical stages of delivery, and shall set aside for test all bottles as regards the accuracy of which any doubt exists. 9. Every bottle of the accuracy of which the special inspector has not been fully satisfied, or which in other respects is not in accordance with the requirements of the Weights and Measures (General) Regulations, 1928, shall be broken up by, or under the supervision of the special inspector. 10. A special inspector shall affix to each bottle tested by him a label showing the result, date, and hour of the test. Every such bottle shall be retained by the special inspector for a period of seven days, or such lesser period as shall be determined by the Minister, and shall be produced by the special inspector for any inspection that may be required by the Minister. The special inspector shall keep such records and furnish such returns as shall be required by the Minister. 11. The following conditions are imposed on the proprietor of a licensed factory (hereinafter referred to as the " licensee ") :— ) The licensee shall satisfy the special inspector of the safe custody of every mould which bears a verification stamp, and which is not in actual use for manufacture of bottles ; ) The licensee shall, otherwise than in the event of breakdown or other such emergency as cannot be reasonably anticipated, give to the Minister and to the Commissioner, An Garda Siochana, not less than seven days' notice of an intention to suspend the manufacture of bottles under licence. ) The licensee shall provide for the special inspector such accommodation, equipment, requisites and assistance as the Minister shall direct ; subject to account being taken of such provision on the prescribing of fees for verification and stamping. ) The licensee shall comply with all instructions given by a special inspector in conformity with these Regulations. 12. Save as otherwise provided by these Regulations, the penalty which may be inflicted on any person (other than a special inspector) found by a court of summary jurisdiction to be guilty of contravening these Regulations, shall be a fine not exceeding twenty-five pounds or, at the discretion of the court, imprisonment for any term not exceeding three months.
