AGRICULTURAL PRODUCE (FRESH MEAT) (BEEF, PORK AND MUTTON) REGULATIONS, 1934. WHEREAS by virtue of Sections 29 30 of the Agricultural Produce (Fresh Meat) Act, 1930 (No. 10 of 1930), the Minister for Agriculture is empowered by order to make regulations in regard to the several matters respectively referred to in the said sections as being the subject of regulations thereunder respectively: AND WHEREAS it is enacted by sub-section (1) of Section 51 of the said Act that the said Minister may by order make regulations in regard to any matter or thing referred to in that Act as prescribed; AND WHEREAS these regulations (except such of them as are made under the said Sections 29 and 30) relate to things referred to in the said Act as prescribed; AND WHEREAS in exercise of the powers conferred on him by the said Act the said Minister made the Agricultural Produce (Fresh Meat) (Beef, Pork and Mutton) Regulations, 1930 (Statutory Rules and Orders No. 62 of 1930): NOW, I, SÃAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Agricultural Produce (Fresh Meat) Act, 1930 (No. 10 of 1930), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say:— 1. —(1) These regulations may be cited for all purposes as the Agricultural Produce (Fresh Meat) (Beef, Pork and Mutton). Regulations, 1934. (2) The Agricultural Produce (Fresh Meat) (Beef, Pork and Mutton) Regulations, 1930 (Statutory Rules and Orders No. 62 of 1930), and these Regulations may be cited together as the Agricultural Produce (Fresh Meat) (Beef, Pork and Mutton) Regulations, 1930 and 1934. 2. In these Regulations:— the expression "the Act" means the Agricultural Produce (Fresh Meat) Act, 1930 (No. 10 of 1930); the expression "the Principal Regulations" means the Agricultural Produce (Fresh Meat) (Beef, Pork and Mutton) Regulations, 1930. 3. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas. 4. —(1) An exporter's licence under sub-sections (1), (2), or (3) of Section 12 of the Act shall be in the Form F.M.6 in the Schedule hereto. (2) Paragraph 9 of the Principal Regulations is hereby revoked. 5. —(1) A certificate of indebtedness under sub-section (7) of Section 13 of the Act shall be in the Form F.M.7 in the Schedule hereto. (2) A certificate of indebtedness under sub-section (5) of Section 17 of the Act shall be in the Form F.M. 8 in the Schedule hereto. (3) Paragraph 10 of the Principal Regulations is hereby revoked. 6. —(1) Notice under sub-section (6) of Section 22 of the Act shall be in the Form F.M.10 in the Schedule hereto. (2) Paragraph 12 of the Principal Regulations is hereby revoked. 7. Paragraph 5 of the Fifth Schedule to the Principal Regulations is hereby amended by the insertion at the end of the said paragraph of the words "Exemption from the requirement as to crating before being put on board ship may be granted by the Minister, either in respect of an individual consignment or of a number of consignments exported over a specified period, in the case of pork carcases weighing 120 lb. or over, each, which are shipped through ports at which crating facilities are not available and in respect of which, having regard to special trade requirements, the Minister is of opinion that such exemption should be granted" and the said Schedule shall be construed and have effect accordingly. 8. Paragraph 3 of the Sixth Schedule to the Principal Regulations is hereby amended in the following respects and the said Schedule shall be construed and have effect accordingly, that is to say:— ) by the insertion in sub-paragraph ( ) of the said paragraph of the words "or hung" after the word "crated" now contained therein; and ) by the insertion at the end of the said paragraph of the following additional sub-paragraph, that is to say:— ) all pork carcases which have been scalded and dehaired and which are not crated shall be suspended by means of hanging facilities of a type approved by the Minister and in such a manner that no part of a carcase shall touch the deck or other flooring of the ship."
