WHEREAS it is enacted by subsection (1) of section 6 of the Army Pensions Act, 1923 (No. 26 of 1923), as amended by the Army Pensions Act, 1927 (No. 12 of 1927), that the Minister for Defence may from time to time make regulations for the medical examination and periodical re-examination of persons who are or claim to be entitled to wound pensions under the said Army Pensions Act, 1923 , or under the said Army Pensions Act, 1923 , as amended by the said Army Pensions Act 1927 , or under the said Army Pensions Act, 1927 , or to disability pensions under the said Army Pensions Act, 1927 AND WHEREAS it is enacted by subsection (2) of the said section 6 of the said Army Pensions Act, 1923 , as amended by the said Army Pensions Act, 1927 , that regulations made under the said section 6 shall provide that unless and until the disablement has reached its final condition no final grant of a wound pension or disability pension shall be made to any person within two years after the first grant of a wound pension or disability pension to such person : NOW, I, DESMOND FITZGERALD, Minister for Defence, in exercise of the powers conferred on me by section 6 of the Army Pensions Act, 1923 (No. 26 of 1923), as amended by the Army Pensions Act, 1927 (No. 12 of 1927), and of every and any other power me in this behalf enabling, do hereby make the following regulations, that is to say :— 1. These regulations may be cited for all purposes as the Army Pensions (Medical Examination and Re-examination) Regulations, 1928. 2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas. 3. In these regulations— the expression " the Minister " means the Minister for Defence ; the expression " the Principal Act " means the Army Pensions Act, 1923 (No. 26 of 1923) ; the expression " the Act of 1927 " means the Army Pensions Act, 1927 (No. 12 of 1927). 4. These regulations apply to a person who has been granted a pension under the Principal Act, or under the Principal Act as amended by the Act of 1927, or under the Act of 1927. 5. The Minister may from time to time refer to the Army Pensions Board for medical examination a person to whom these regulations apply, and the result of such examination shall be reported by the said Board to the Minister in such form as he may from time to time prescribe. 6. Before examining a person under these regulations the Army Pensions Board shall consider any statement of claim made by such person. 7. Unless and until the disablement has reached its final condition no final grant of a pension under the Principal Act or under the Principal Act as amended by the Act of 1927, or under the Act of 1927, shall be made to any person within two years after the first grant of such pension to such person. 8. The Regulations made under section 6 of the Principal Act by the Minister on the 14th day of February, 1924, are hereby revoked. Given under My Seal of Office, this 30th day of August, 1928. D.
