DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC LOCAL OFFICES AND EMPLOYMENTS (GAELTACHT) ORDER, 1928. WHEREAS by Section 15 of the Local Government (Temporary Provisions) Act, 1923 , it is enacted in effect as follows that is to say:— (1) The Minister for Local Government shall have with respect to all persons now employed or hereafter to be employed by any Local Authority in any office or employment to which this section applies and with respect to the accounts of such persons all the same powers as he now has by law with respect to officers of Boards of Guardians of Poor Law Unions, and the accounts of such officers respectively. (2) This section shall apply to such offices and employments as the Minister for Local Government shall from time to time by Order prescribe. AND WHEREAS by the Local Offices and Employments Order, 1924, the Minister for Local Government did order and prescribe that the above recited section should apply to the offices and employments set forth in the first schedule to this Order: AND WHEREAS at the date of the passing of the said Local Government (Temporary Provisions) Act, 1923 Adaptation of Enactments Act, 1922 , to determine the continuance in office of officers of Boards of Guardians of Poor Law Unions: AND WHEREAS the powers of the Minister for Local Government under the above recited section are now vested in the Minister for Local Government and Public Health: NOW, THEREFORE, I, the Minister for Local Government and Public Health, in exercise of the above recited powers and of all other powers enabling me in this behalf do, by this my Order, make and prescribe the following rules and regulations with respect to the continuance of persons in the offices and employments set forth in the first schedule to this Order, that is to say:— 1.—This Order may be cited as the Local Offices and Employments (Gaeltacht) Order, 1928. 2.—In this Order, unless the context otherwise requires the word "Minister" means the Minister for Local Government and Public Health; the express on "the Gaeltacht" means and includes the areas specified in the second schedule to this Order; the expression "local authority" has the same meaning as in the Local Government (Temporary Provisions) Act, 1923 3.—A person who is appointed by a local authority after the this Order to any of the offices or employments set forth in the first schedule to this Order and who was not immediately before such appointment in the service of the local authority, shall not if the duties of such office or employment or any of them are to be performed in or in relation to the Gaeltacht or any part thereof, continue in such office or employment after the expiration of three years from the date of such appointment unless before such expiration the Minister shall be satisfied that such person possesses a knowledge of the Irish language sufficient to enable him adequately to perform the duties of such office and employment through the medium of the said language. 4.—For the purposes of this Order the Minister shall satisfy himself as to the knowledge of the Irish language possessed by any person appointed to an office or employment in pursuance of a recommendation from the Local Appointments Commissioners made under the Local Authorities (Officers and Employees) Act, 1926 by means of a report from the said Commissioners. Any office or employment the duties of which are, wholly or in part, professional or clerical. 3. Any office or employment the duties of which include the supervision or control of any person or persons employed by the Local Authority. 4. Any office or employment the duties of which include or relate to the receipt or disbursement of any moneys for or on behalf of the Local Authority. 5. Any office or employment the duties of which include or relate to the issuing of licenses to drive motor cars or use mechanically propelled vehicles on roads. SECOND SCHEDULE.
