Repeal of Ordinance I of 1969 THE ANDHRA PRADESH (ANDHRA AREA) PROPRIETARY ESTATES’ VILLAGE SERVICE AND THE ANDHRA PRADESH (ANDHRA AREA) HEREDITARY VILLAGE OFFICES LAWS (REPEAL) ACT,1969 (ACT No. 16 OF 1969) [20th September, 1969] AN ACT TO REPEAL THE ANDHRA PRADESH (ANDHRA AREA) PROPRIETARY ESTATES’ VILLAGE SERVICE ACT, 1894, THE ANDHRA PRADESH (ANDHRA AREA) HERIDITARY VILLAGE OFFICES ACT, 1895 AND AND CERTAIN OTHER ENACTMENTS AND TO PROVIDE FOR MATTERS CONNECTED THEREWITH. Be it enacted by the Legislature of the State of Andhra Pradesh in the Twentieth Year of the Republic of India as follows:- 1. Short title, extent and commencement – (1) This Act may be called the Andhra Pradesh (Andhra Area) Proprietary Estates’ Village Service and the Andhra Pradesh (Andhra Area) Hereditary Village Offices Laws (Repeal) Act,1969. (2) It extends to the whole of the State of Andhra Pradesh, other than the territories specified in sub-section (1) of section 3 of the States Reorganisation Act, 1956. (3) It shall be deemed to have come into force on the 22nd May, 1969. 2. Repeal of Acts II of 1894 and III of 1895 and Chapter XI of Central Act XVIII of 1881 – (1) The Andhra Pradesh (Andhra Area) Proprietary Estates’ Village Service Act, 1894 and the Andhra Pradesh (Andhra Area) Hereditary Village Offices, Act, 1895 and Chapter XI of Central Provinces Land Revenue Act, 1881, in its application to the area to which this Act extends, are hereby repealed. ( 2) Every holder of a village office appointed under the Acts repealed by sub-section (1), before the commencement of this Act shall, notwithstanding the repeal of the Acts, continue to hold such office subject to such rules as may be made under the proviso to article 309 of the Constitution. (3) Any legal Proceeding or remedy in respect of any right, privilege, obligation or liability acquired accrued or incurred in regard to matters relating to appointment, conditions of service and dismissal or removal under the Acts repealed by sub-section (1) and pending immediately before the commencement of this Act shall be continued or enforced subject to the such rules as may be made under the proviso to article 309 of the Constitution. (4) Every suit, appeal, application, revision on other proceeding, not being a proceeding or remedy falling under sub-section (3), instituted, made or taken under the Acts repealed by sub-section (1) and pending on the commencement of this Act shall abate. 3. Repeal - The following enactments are hereby repealed:- (1) The Andhra Pradesh (Andhra Area) Permanent Settlement Regulation, 1802, (Regulation XXV of 1802) section 11; (2) The Andhra Pradesh (Andhra Area) Karnams Regulation, 1802 (Regulation XXIX of 1802); (3) The Andhra Pradesh (Andhra Area) Village Officers Restoration Act, 1926 (Act IV of 1926); (4) The Andhra Pradesh (Andhra Area) Restoration of Village Officers (Validation) Act, 1939 (Act XVIII of 1939). 4. Repeal of Ordinance I of 1969 - The Andhra Pradesh (Andhra Area) Proprietary Estates’ Village Service and the Andhra Pradesh (Andhra Area) Hereditary Village Offices Laws (Repeal) Ordinance, 1969, is hereby replaced.
