XVIII OF 2015 (Received the assent of the Governor on 20th May, 2015) THE ASSAM MUNICIPAL (AMENDMENT) ACT, 2015 548 THE ASSAM GAZETTE, EXTRAORDINARY, MAY 29, 2015 AN ACT further to amend the Assam Municipal Act, 1956 Preamble Whereas it is expedient further to amend the Assam Municipal Act, Assam Act 1956,hereinafter referred to as the principal Act, in the manner hereinafter XV of 1957 appearing; It is hereby enacted in the Sixty-sixth year of the Republic of India as follows Short title, 1(1) This Act may be called the Assam Municipal (Amendment) Act, 2015. extent and commencement (2) It shall have the like extent as the principal Act. (3) It shall come in to force at once. Amendment of 2. In the principal Act, in section 37, in sub-section (1), in the first proviso, section 37 the words “where such officer is”, appearing in between the words “officer” and “appointed” shall be deleted. Amendment of 3. In the principal Act, in section 53, after sub-section (2), the following new section 53 sub-section(3) shall be inserted, namely:- “(3), (i) Every order or instrument of the Municipal Board or the Town Committee shall be expressed to be made in the name of the Municipal Board or the Town Committee concerned, as the case may be. (ii) Save in cases where an Officer has been specifically empowered to sign an order or an instrument of the Municipal Board or the Town Committee, every order or instrument shall be signed by the Executive Officer with approval of the Chairman, Municipal Board/Town Committee and such signature shall be deemed to be proper authentication of such order. (iii) The Executive Officer shall sign any Notification of the Municipal Board or Town Committee on behalf of the Municipal Board or Town Committee with approval of the Chairman, Municipal Board/Town Committee for publication in the Official Gazette.” S.
