THE ANDHRA PRADESH TRANSFERRED TERRITORIES (REPEAL AND EXTENSION OF LAWS) ACT, 1962 ACT No.20 OF 1962 [20th August, 1962] AN ACT TO PROVIDE FOR THE REPEAL OF THE LAWS OF THE STATE OF MADRAS APPLICABLE TO THE TERRITORIES TRANSFERRED TO THE STATE OF ANDHRA PRADESH FROM THE STATE OF MADRAS IN PURSURANCE OF THE ANDHRA PRADESH AND MADRAS (ALTERATION OF BOUNDARIES) ACT, 1959 AND FOR THE EXTENSION OF THE ANDHRA PRADESH LAWS IN FORCE IN THE ANDHRA AREA TO THOSE TERRITIORIES. BE it enacted by the Legislature of the State of Andhra Pradesh in the Thirteenth Year of the Republic of India as follows:- 1. Short title and commencement- (1) This Act may be called the Andhra Pradesh Transferred Territories (Repeal and Extension of Laws) Act, 1962. (2) It shall come into force on such date as the State Government may, by notification in the Andhra Pradesh Gazette appoint. 2. Definitions – In this Act, unless the context otherwise requires,- (a) ‘Andhra Area’ means the territories specified in sub-section (1) of section 3 of the Andhra State Act, 1953 (Central Act 30 of 1953); (b)‘’Law’’ includes any enactment, ordinance, regulation, order, bye-law; rule, scheme, notification or other instrument having the force of law; (c) ‘’transferred territories’’ means the territories specified in the First Schedule to the Andhra Pradesh and Madras (Alteration of Boundaries) Act, 1959 (Central Act 56 of 1959). 3. Repeal and extension of laws – All laws of the State of Madras which immediately before the date of commencement of this Act extended to, or were in force in, the transferred territories shall, as from that date, stand repealed and all laws of the State of Andhra Pradesh which extend to, or are in force in, the Andhra area in which those territories are included and which have not already been extended to, or have not come into force in, those territories shall, as from that date, extend to, or as the case may be, come into force in, those territories: Provided that anything done or any action taken before the date of commencement of this Act under any law in force in the transferred territories shall be deemed to have been done or taken, as from that date, under the corresponding law extended to, and in force in, those territories. 4. Power to remove difficulties – (1) If any difficulty arises in relation to the transition from any corresponding law to any law which by virtue of section 3 shall, as from the date of commencement of this Act extend to, or come into force in, the transferred territories, the State Government may after previous publication, by order notified in the Andhra Pradesh Gazette, make such provisions as appear to them to be necessary or expendient for removing the difficulty. (2) If any difficulty arises in giving effect to the provisions of this Act otherwise than in relation to the transition from any corresponding law in their application to the transferred territories, the State Government may after previous publication, by order in the Andhra Pradesh Gazette, make such provisions not inconsistent with the purposes of this Act, as appear to them to be necessary or expedient for removing the difficulty. (3) No power under sub-section (1) or sub-section (2) shall be exercised by the State Government after the expiry of five years from the date of commencement of this Act. (4) Any order made under sub-section (10 or sub-section (2) may be so made as to be retrospective to any date not earlier than the date of commencement of this Act.
