Repeal and savings. THE ANDHRA PRADESH GOVERNMENT MEDICAL AND DENTAL INSTITUTIONS (COVERSION INTO SEMI-AUTONOMOUS INSTITUTIONS) (REPEAL) ACT, 2018. (ACT No.29 of 2018) [25th October, 2018] AN ACT TO REPEAL THE ANDHRA PRADESH GOVERNMENT MEDICAL AND DENTAL INSTITUTIONS (CONVERSION INTO SEMI-AUTONOMOUS INSTITUTIONS) ACT, 2007, AND TO MERGE THESE INSTITUTIONS WITH GOVERNMENT MEDICAL COLLEGES/GOVERNMENT GENERAL HOSPITALS AND TO ABSORB THEIR EMPLOYEES IN TO REGULAR SERVICES. Whereas, the Andhra Pradesh Government Medical and Dental Institutions (Conversion into Semi-Autonomous Institutions) Act, 2007 (Act No.31/2007) was enacted to provide Semi-Autonomous status to the Government Medical/Dental Colleges and Institutions for effective functional Autonomy. And Whereas, the Semi-Autonomous institutions are functioning since 2008. However, after the implementation of University Grants Commission (UGC) scales, the remuneration offered to the teachers in the Rajiv Gandhi Institute of Medical Sciences (RIMS), semi-autonomous institutions is not attractive. The faculty structure and organizational chart needs modification as per Medical Council of India (MCI) regulations. Hence, the semi-autonomous institutions have to be converted to regular Government institutions for the sake of administrative convenience and for effective functioning. And whereas, it has, become necessary to repeal the Andhra Pradesh Government Medical and Dental Institutions (Conversion into Semi- Autonomous Institutions) Act, 2007. 2 Be it enacted by the Legislature of the State of Andhra Pradesh in the Sixty-ninth year of the Republic of India as follows:- 1.Short title and commencement - (1)This Act may be called the Andhra Pradesh Government Medical and Dental Institutions (Conversion into Semi- Autonomous Institutions) (Repeal) Act, 2018. (2) It shall come into force at once. 2. Repeal and Savings - (1) The Andhra Pradesh Government Medical and Dental Institutions (Conversion into Semi-Autonomous Institutions) Act, 2007 (Act No.31 of 2007) is hereby repealed. (2) On such repeal the provisions of sections 8 and 18 of the Andhra Pradesh General Clauses Act, 1891(Act No.1 of 1891) shall apply. (3) Notwithstanding such repeal. (a) the control and management of the following institutions comprising Medical Colleges and its attached Hospitals shall stand transferred to and vest in the Government and they shall function under the Government and continue as affiliated to Dr.N.T.R University of Health Sciences, Vijayawada :- (1) The Rajiv Gandhi Institute of Medical Sciences, Srikakulam, (2) The Rajiv Gandhi Institute of Medical Sciences, Ongole; and (3) The Rajiv Gandhi Institute of Medical Sciences, Kadapa. (b) all the properties, assets and liabilities, rights and obligations in relation to the institutions as specified in clause (a) shall devolve upon the Government; (c)the following teachers who immediately prior to such commencement were working in any of the institutions specified in clause (a), shall continue to work in the institutions and their seniority shall be fixed as follows,- (i) Professors, Associate Professors and Assistant Professors shall be placed in the seniority list below the regular Government teachers of the Andhra Pradesh Medical Education Service of the concerned category; (ii) Tutors,- 3 (1) shall be placed below the seniority list of the Civil Assistant Surgeon of the Andhra Pradesh Medical Education Service; (2) who have Post Graduate (PG) Degree and non Medical tutors who have PhD shall be eligible for lateral entry; and (3) Other shall remain as such. (iii) Teachers above 63 years of age shall not be absorbed and they shall be continued till the expiry of their term of contract.
