THE ANDHRA PRADESH (TRANSFERRED TERRITORIES) EXTENSION OF LAWS ACT, 1961 ANDHRA PRADESH ACT No.VII OF 1961 (24th January, 1961) AN ACT TO EXTEND THE ANDHRA PRADESH PANCHAYAT SAMITHIS AND ZILLA PARISHADS ACT, 1959, THE ANDHRA PRADESH (ANDHRA AREA) DISTRICT BOARDS ACT, 1920, AND THE ANDHRA PRADESH (ANDHRA AREA) VILLAGE PANCHAYATS ACT, 1950, AS IN FORCE IN ANDHRA AREA TO THE TERRITORIES IN THE STATE OF ANDHRA PRADESH SPECIFIED IN THE FIRST SCHEDULE TO THE ANDHRA PRADESH AND MADRAS (ALTERATION OF BOUNDARIES) ACT, 1959 (CENTRAL ACT 56 OF 1959). BE it enacted by the Legislature of the State of Andhra Pradesh in the Eleventh Year of the Republic of India as follows:- 1. Short title, extent and commencement- (1) This Act may be called the Andhra Pradesh (Transferred Territories) Extension of Laws Act, 1961. (2) It extends to the territories specified in the First Schedule to the Andhra Pradesh and Madras (Alteration of Boundaries) Act, 1959 (Central Act 56 of 1959). (3) It shall come into force at once. 2. Definitions – In this Act,- (1)‘Andhra area’ means the territories specified in sub-section (1) of section 3 of the Andhra State Act, 1953 (Central Act 30 of 1953); (2)‘transferred territories’ means the territories specified in the First Schedule to the Andhra Pradesh and Madras (Alteration of Boundaries) Act, 1959 (Central Act 56 of 1959). 3. Extension of Andhra Pradesh Act XXXV of 1959 and Acts XIV of 1920 and X of 1950 to the transferred territories – The following Acts, namely:- (i) The Andhra Pradesh Panchayat Samithis and Zilla Parishads Act, 1959 (Andhra Pradesh Act XXXV of 1959); (ii) the Andhra Pradesh (Andhra Area) District Boards Act, 1920 (XIV of 1920); (iii) the Andhra Pradesh (Andhra Area) Village Panchayats Act, 1950 (Act X of 1950); as in force in the Andhra area at the commencement of this Act and all the rules, regulations, bye-laws, notifications and orders made or issued thereunder are hereby extended to, and shall be in force in, the transferred territories and the territorial extent of the Acts, rules, regulations, bye-laws, notifications and orders so extended shall, as from such commencement, be deemed to include the transferred territories. 4. Repeals and saving – The following Acts, namely:- (i) the Madras District Boards Act, 1920; (ii) the Madras Village Panchayats Act, 1950; (iii) the Madras District Development Councils Act, 1958; (iv) the Madras Panchayats Act, 1958; as in force in the transferred territories immediately before the commencement of this Act are hereby repealed: Provided that such repeal shall not affect the previous operation of the said Acts and any panchayat constituted or deemed to have been constituted under the repealed Madras Village Panchayats Act, 1950 and functioning at the commencement of this Act, shall be deemed to have been constituted under (the Andhra Pradesh (Andhra Area) Village Panchayats Act, 1950 as extended by section 3. 5. Power to remove difficulties - If any difficulty arises in giving effect in the transferred territories to the provisions of any Act extended by section 3 to those territories, the State Government may, by order notified in the Andhra Pradesh Gazette, make such provisions or give such directions as appear to them to be necessary for the removal of the difficulty.
