Statute overview

About this statute

This provision changes several criminal code penalties for crimes against public administration and adds a mitigating rule for people who help prevent further crime, preserve evidence, identify other responsible persons, or recover transferred sums or benefits. A person subject to an incapacity to contract with public administration is barred from signing contracts with it, except to obtain public-service prestations. A conviction to at least two years’ imprisonment for certain listed offences also causes termination of employment or public employment for employees of public administrations, public entities, or majority public-owned entities, subject to articles 29 and 31. Durante la sospensione, il condannato non può esercitare certe professioni, arti, industrie o attività commerciali che richiedono speciale permesso, abilitazione, autorizzazione o licenza. A public official or public service appointee who appropriates another person’s money or movable property held through their office or service is punishable by imprisonment; a shorter term applies for immediate temporary use with prompt return.
