Jersey Law 1/1974 CONSENT TO MEDICAL TREATMENT (JERSEY) LAW, 1973. ____________ A LAW to make provision for the giving of consent by minors who have attained the age of sixteen years to medical treatment, sanctioned by Order of Her Majesty in Council of the 12th day of DECEMBER, 1973. ____________ ( Registered on the 25 th day of January , 1974). ____________ STATES OF JERSEY. ____________ The 11th day of September, 1973. ____________ T HE STATES , subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law: - ARTICLE 1 (1) The consent of a person who has attained the age of sixteen years but is under twenty years of age to any surgical, medical or dental treatment which, in the absence of consent, would constitute a trespass to his person, shall be as effective as it would be if he had attained the age of twenty years; and where such a person has by virtue of this Article given an effective consent to any treatment it shall not be necessary to obtain any further consent from his parent or guardian. (2) In this Article “surgical, medical or dental treatment” includes any procedure undertaken for the purposes of diagnosis, and this Article applies to any procedure (including in particular, the administration of an anaesthetic) which is ancillary to any treatment as it applies to that treatment. (3) Nothing in this Article shall be construed as making ineffective any consent which would have been effective if this Article had not been enacted.
