Jersey Law 1/1976 SEA-FISHERIES (AMENDMENT) (JERSEY) LAW, 1975. ____________ A LAW to amend the Sea-Fisheries (Jersey) Law, 1962, and to extend the powers of the States under that Law to regulate sea-fisheries, sanctioned by Order of Her Majesty in Council of the 19th day of DECEMBER, 1975. ____________ ( Registered on the 16 th day of January , 1976). ____________ STATES OF JERSEY. ____________ The 10th day of June, 1975. ____________ T HE STATES , subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law: - ARTICLE 1 The purposes of the Sea-Fisheries (Jersey) Law, 1962 1 (hereinafter referred to as “the Law of 1962”) are hereby extended so as to enable provision to be made for the establishment and conduct of fisheries and accordingly in the long title of that Law for the words “to provide for matters incidental thereto” there shall be substituted the following words – “to provide for the establishment and conduct of fisheries and for matters incidental to the foregoing”. ARTICLE 2 In Article 1 of the Law of 1962 – (a) in paragraph (1) in the definition of “sea-fish” for the words “or cured” there shall be substituted the words “or frozen, cured or otherwise preserved”. (b) after paragraph (2) there shall be inserted the following paragraph – “(3) Except where the context otherwise requires, references in this Law to any enactment (including an enactment of the Parliament of the United Kingdom) include references to that enactment as amended, extended or applied by or under any other enactment, and to any enactment repealing and re-enacting that enactment with or without further amendment.” ARTICLE 3 In paragraph (1) of Article 2 of the Law of 1962 after sub-paragraph (b) there shall be inserted the following sub-paragraph – “ ( ba ) for controlling the establishment of, and for regulating, protecting and developing, fisheries for all or any specified kinds of sea-fish;”. ARTICLE 4 (1) In paragraph (4) of Article 9 of the Law of 1962 for the words “by virtue of section eleven of the Sea Fisheries Act, 1883 (46 and 47 Vict ., c.22), or section twenty-five of the Sea Fish Industry Act, 1951 (14 and 15 Geo. 6, c.30)” there shall be substituted the words “within the meaning of section 7 of the Sea Fisheries Act 1968 (c.77)”. (2) In Article 12 of the Law of 1962 – (a) for sub-paragraphs (a) to (f) inclusive of paragraph (1) there shall be substituted the following sub-paragraphs – “ (a) the Sea Fisheries Act, 1868 (31 and 32 Vict ., c.45); (b) the Merchant Shipping Act, 1894 (57 and 58 Vict ., c.60); (c) the Fishery Limits Act 1964 (c.72); (d) the Sea-Fisheries (Shellfish) Act 1967 (c. 83); (e) the Sea-Fisheries Act 1968 (c. 77);”. (b) p aragraph (2) is hereby repealed. ARTICLE 5 The “ Loi (1882) sur les parcs à huitres” 2 (hereinafter referred to as “the ‘ Loi ’ ”) is hereby repealed: Provided that the “ Loi ” shall continue in force in relation to any Act of Authorization granted in pursuance thereof which Act, notwithstanding the provisions of any regulations made under sub-paragraph ( ba ) of paragraph (1) of Article 2 of the Law of 1962, as amended by this Law, shall continue to be valid until it expires, is cancelled by agreement of the parties concerned or is revoked in accordance with the terms of the “ Loi ”. ARTICLE 6 (1) This Law may be cited as the Sea-Fisheries (Amendment) (Jersey) Law, 1975, and this Law and the Law of 1962 may be cited together as the Sea-Fisheries (Jersey) Laws, 1962 and 1975. (2) This Law shall come into force on such day or days as the States may by Act appoint and different days may be appointed for different purposes of the Law. R.S.
